HomeMy WebLinkAbout78-10 - ResolutionsRESOLUTION NO. 78-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, SCHEDULING A PUBLIC HEARING ON A PROPOSED ORDINANCE TO ADOPT BY REFERENCE THE "SAN BERNARDINO COUNTY CODE" INCLUDING ANY APPLICABLE GENERAL PLAN PROVISIONS, DESCRIBING THE FORM OF NOTICE OF HEARING AND DIRECTING THE PUBLICATION OF THE NOTICE. WHEREAS, the City Council of the City of Rancho Cucamonga, California, did, on March 1, 1978, give first reading of the title of the Ordinance hereinafter described and of title of the primary Code to be adopted thereby, and the titles of all secondary codes; and, WHEREAS, Government Code Section 50022.3 requires that the City Council schedule a public hearing thereon and publish notice thereof, pursuant to Government Code Section 6066, in a newspaper of general circulation published in or nearest to the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rancho Cucamonga, California, as follows: SECTION 1: 7:30 p.m. on Wednesday, March 29, 1978, at the Community Services Building located at 9161 Baseline Road, Rancho Cucamonga, California, is fixed as the time and place of the public hearing by the City Council of the City of Rancho Cucamonga, California, on the Ordinance hereinafter described. SECTION 2: The City Clerk of the City of Rancho Cucamong. California, is directed to forthwith publish, pursuant to Government Code Section 6066, in the Rancho Cucamonga Times, a newspaper of general circulation published nearest to said City, and to post in three (3) public places in said City, the following notice in substantially the following words and figures: "NOTICE OF PUBLIC HEARING ON ORDINANCE OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, TO ADOPT THE 'SAN BERNARDINO COUNTY CODE' BY REFERENCE, "NOTICE IS HEREBY GIVEN that the City Council of the City of Rancho Cucamonga, California, will hold a public hearing prior to consideration for adoption of the hereinafter described Ordinance. The public hearing will be on Wednesday, March 29, 1978, at 7:30 p.m. and the place of the hearing will be the Community Services Building located at 9161 Baseline Road, Rancho Cucamonga, California. Any and all persons desiring to be heard on the subject of said Ordinance may appear before said City Council and be heard thereon. "The Ordinance which is the subject of said public hearing is entitled: "'AN ORDINANCE OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, ADOPTING BY REFERENCE, PURSUANT TO GOVERNMENT CODE SECTION 50022.9, THAT CERTAIN CODE KNOWN AS THE "CODIFIED ORDINANCES OF THE COUNTY OF SAN BERNARDINO" ALSO KNOWN AS THE "SAN BERNARDINO COUNTY CODE", PROVIDING FOR AMENDM~ENTS AND ADDITIONS THERETO AND DELETIONS THEREFROM, PROVIDING FOR THE IMPOSITION OF PENALTIES FOR THE VIOLATION THEREOF, PROVIDING FOR THE PAYMENT OF FEES PURSUANT THERETO AND DECLARING THE URGENCY THEREOF.' Resolution No. 78-10 Page 2 "Three (3) copies of said 'San Bernardino County Code' and all secondary codes which have been adopted by reference therein are on file with the City Clerk and are open to public inspection. The title of all secondary codes adopted by reference therein are: "(a) Uniform Building Code, 1976 Edition; "(b) Uniform Fire Code, 1976 Edition; "(c) Uniform Mechanical Code, 1976 Edition; "(d) Uniform Plumbing Code, 1976 Edition; and, "(e) Uniform Wiring Code, 1975 Edition. "Prior to the incorporation of the City of Rancho Cucamonga, California, the San Bernardino County Code was applied to the territory which is now the City. It was adopted upon incorporation, as required by law, for a period of one hundred twenty (120) days. The purpose of the above-mentioned Ordinance is to adopt, on a permanent basis or until subsequently amended, selected portions of the San Bernardino County Code and those secondary codes adopted by reference therein as Ordinances of the City of Rancho Cucamonga, California. "Dated this 1st day of March, 1978. "BY ORDER OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA. City Clerk". SECTION 3: The City Council deems the foregoing notice s,~ficient to give notice to interested persons of the purpose of the aforemenL~oned Ordinance and the subject matter thereof. The foregoing Resolution was duly passed and adopted by the City Council of the City of Rancho Cucamonga, California, at a regular meeting of said City Council held on the 1st day of March, 1978.
