A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, DECLARING ITS INTENTION TO GRANT
THE GAS FRANCHISE APPLIED FOR BY SOUTHERN CALIFORNIA
EDISON COMPANY AFFIXING A TIME AND PLACE FOR HEARING ON
OBJECTIONS TO THE GRANTING THEREOF.
The City Council of the City of Rancho Cucamonga, California,
does hereby resolve as follows:
The City Council of the City of Rancho Cucamona intends to grant for
an indefinite term, under and pursuant to Division 3, Chapter 2 of the
Public Utilities Code of the State of California, known as the Franchise
Act of 1937, to Southern California Gas Company, a corporation, a franchise
to lay and use pipes and appurtenances for transmitting and distributing
gas for any and all purposes under, along, across or upon the public
streets, ways, alleys or places, as the same now or may hereafter exist
with the City of Rancho Cucamonga.
The grantee of said franchise, and its successors and assigns,
will, during the life of said franchise, pay to the City of Rancho
Cucamonga two percent (2%) of the gross annual receipts of the grantee
and its successors and assigns arising from the use, operation or possession
of said franchise; provided, however, that such payment shall in no event
be less than one percent (1%) of the gross annual receipts of the grantee,
its successors and assigns, d~rived from the sale of gas within the limits
of the City of Rancho Cucamonga under said gas franchise. Said percentage
will be paid annually from the date of granting of said franchise, and in
the event such payment shall not be made said franchise will be forfeited.
NOTICE IS HEREBY GIVEN THAT 7:30 P.M., WEDNESDAY, FEBRUARY 15, 1978,
AT 9161 BASELINE, RANCHO CUCAMONGA, CALIFORNIA, IS FIXED AS THE TIME AND
PLACE OF A PUBLIC HEARING AT WHICH THE CITY COUNCIL WILL HEAR ALL PERSONS
HAVING ANY OBJECTION TO THE GRANTING OF SAID FRANCHISE.
At any time not later than the hour set for the Hearing of
objections, any person interested may make written protest stating
objections against the granting of the franchise. Such protest shall
be signed by the protestant and be delivered to the City Clerk.
The City Clerk is hereby directed to publish this Resolution at
least once within fifteen (15) days after its passage in a newspaper of
general circulation within the City, to-wit: The Cucamonga Times.
PASSED, APPROVED, and ADOPTED this 18th day of January, 1978.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, DECLARING ITS INTENTION TO
GRANT A GAS FRANCHISE TO SOUTHERN CALIFORNIA GAS
COMPANY.
WHEREAS, SOUTHERN CALIFORNIA GAS COMPANY, a California ~ ~oration,
has filed with the City Council of the City of Rancho Cucamonga an .~pplicatiion
requesting that a franchise be granted to it of the character and for the
purpose mentioned in the form of notice hereinafter set forth;and
WHEREAS, in the opinion of said City Council the public good
requires that said franchise be granted;
NOW, THEREFORE, BE IT RESOLVED that said City Council intends
to grant said franchise, that hearing of objections to the granting
thereof will be held at the time and place specified in the form of
notice hereinafter set forth which the City Clerk of said City is hereby
directed to publish at least once in THE CUCAMONGA TIMES, a newspaper
of general circulation published nearest to said City, and to post in
three (3) public places in said City, within fifteen (15) days after
the passage :T this resolution, and that said notice shall be substantially
in the following words and figures:
"NOTICE OF INTENTION TO GRANT FRANCHISE"
NOTICE IS HEREBY GIVEN that Southern California Gas Company, a
California corporation, has filed its application with the City Council of
the City of Rancho Cucamonga requesting that said City Council grant to it
a franchise for an indeterminate period, pursuant to the Franchise Act of
1937, to use and to construct and use, for transmitting and distributing
gas for any and all purposes, to lay and use pipes and appurtenances
necessary or proper therefor, in, along, and under the public streets,
ways, alleys and places within the City of Rancho Cucamonga.
If said franchise shall be granted to it, said Southern
California Gas Company, its successors and assigns, hereinafter designated
grantee, during the life of said franchise will pay to said City two
percent (2%) of the gross annual receipts of said grantee arising from
the use, operation or possession of said franchise; provided, however, that
such payment shall in no event be less than one percent (1%) of the
gross annual receipts derived by grantee from the sale of gas within the
limits of said City. Such percentage shall be paid annually from the
date of the granting of the franchise applied for, and in the event
such payment shall not be made said franchise shall be forfeited.
The City Council of the City of Rancho Cucamonga proposes to
grant said franchise for an indeterminate period.
NOTICE IS HEREBY FURTHER GIVEN that any and all persons having
any objections to the granting of said franchise may appear before said
City Council at the Community Services Building, 9161 Baseline Road,
Rancho Cucamonga, California, at the hours of 7:30 p.m. on Wednesday,
the 15th day of February, 1978, and be heard thereon; and
NOTICE IS HEREBY FURTHER GIVEN that at any time not later than
the hour set for hearing objections, any person interested may make
written protest stating objections against the granting of said franchise:
which protest must be signed by the protestant and be delivered to the
City Clerk of said City. The City Council at the time set for hearing
said objections shall proceed to hear and pass upon all protests so made;
and
For further particulars reference is hereby made to said
Application which is on file in the office of said City Clerk, and also to
the resolution adopted by said City Council on the 18th day of January, 1978,
declaring its intention to grant said franchise.

The foregoing Resolution was duly passed and adopted by the City Council
of the City of Rancho Cucamonga at a regular meeting of said City Council
held on the 18th day of January, 1978, by the following vote:
