A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAHONGA, CALIFORNIA, REVERSING THE ACTION REPRESENTED BY
RESOLUTION NO. 85-46 OF THE PLANNING COMHISSION OF THE CITY
OF RANCHO CIICANONGA AND DENYING APPROVAL OF TENTATIVE TRACT
NO, 10349
A. RECITALS
(i) Heretofore, Plaza Builders submitted an application for
approval of Tentative Tract Map No. 10349 ("the Map" hereinafter), for the
purpose of subdividing approximately 33.2 acres of certain real property
depicted on the map into 53 lots.
(ii) The Map is located approximately at the west side of
Sapphire Street, south of Jennet Street, within the City of Rancho Cucamonga in
an area zoned VL (Very Low Residential).
(iii) On March 27, 1985, following the conclusion of a duly
noticed and conducted public hearing the Planning Commission of the City of
Rancho Cucamonga adopted its Resolution No. 85-46 thereby approving the Map
subject to conditions specified in said Re~olution 85-46.
(iv) The action represented by said Planning Commission
Resolution 85-46 was timely appealed on April 5, 1985, by an interested party
in accordance with California Covermnent Code Section 66452.5 (d).
(v) In accordance with California Government Code Section
66452.5 (d), this Council set this matter for a public hearing to occur on May
1, 1985.
(vi) On May 1, 1985, this Council conducted and concluded a duly
noticed public hearing on the subject matter of the Map.
(vii) All legal prerequisites to the adoption of this Resolution
have occurred.
B. RESOLUTION
NOI/, THEREFORE, the City Council of the City of Rancho Cucamonga does
hereby find, determine, conclude, and resolve as follows:

are true and correct·
that all of the facts set
Part A, of this Resolution
Based upon substantial evidence presented to this
Council during the public hearing referred to in Recital
(vi) above, this Council hereby specifically finds as
follows:

The Map provides for the extension of THoroughbred
Street from Turquoise Street easterly to Sapphire
Street, an approximate distance of 1500 feet for a
total distance between Turquoise Street and Sapphire
Street of approximately 2600 feet;
The proposed extended THoroughbred Street is aligned
approximately in a straight direction, lacking any
significant curving;
THere now are present on Thoroughbred Street 22
single family homes occupied in part by children
with no sidewalks adjacent to those homes;

There are 25 additional single family ho~es proposed
to be developed on the proposed extension of
Thoroughbred Street referred to above in accordance
with the Map;
The proposed extended Thoroughbred Street as aligned
on the map presents an opportunity for the high
speed operation of motor vehicles over a straight,
lengthy portion of that street with attendant
hazards to children and other pedestrian users of
the street, which, again, in part will lack
sidewalks; and
The Map could be redesigned to cause a significant
curving of the alignment of the proposed extension
of Thoroughbred Street referred to above, which
would significantly reduce the public safety hazard
identified in Subparagraph 2 E, above·
Based upon the findings of facts set forth in paragraphs
I and 2 above, this Council hereby concludes that the
design of the Map is likely to cause serious health
problems.
Based upon the findings of fact set forth in paragraphs
1 and 2 above and the conclusion specified in paragraph
3 above and in accordance with California Government
Code Section 66474(f), this Council hereby reverses the
action of the Planning Commission of the City of Rancho
Cucamonga represented by its Resolution No. 85-46 and
denies approval of Tentative Tract No. 10349.
Plaza Builders hereby is notified that the time within
which judicial review of the decision represented by
this Resolution may be sought is governed by the
provisions of California Code of Civil Procedures,
Section 1094.6.
The City Clerk shall certify to the adoption of this
Resolution and shall forthwith mail a copy of this
Resolution to Plaza Builders at that party's last known
address of record with the City of Rancho Cucamonga.
