HomeMy WebLinkAbout82-2 - ResolutionsRESOLUTION NO. 82-2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE, PERTAINING TO MATERIALS SUBMITTED TO THE ELECTORATE AND THE COSTS THEREOF FOR THE GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, APRIL 13, 1982 WHEREAS, Section 10012 of the Elections Code of the State of California provides that the governing body of any local agency adopt regulations pertaining to materials prepared by any candidate for a municipal election, including costs thereof. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1: GENERAL PROVISIONS: That pursuant to Section 10012 of the Elections Code of the State of California, each candidate for elective office to be voted for at the General Municipal Election to be held in the City of Rancho Cucamonga on April 13, 1982, may prepare a candidate's statement on an appropriate form provided by the City Clerk. Such statement may include the name, age and occupation of the candidate and a brief description of no more than 200 words of the candidate's education and qualifications expressed by the candidate himself. Such statement shall not include party affiliation of the candidate, nor membership or activity in partisan political organizations. Such statement shall be filed in the office of the City Clerk at the time the candidate's nomination papers are filed. Such statement may be withdrawn, but not changed, during the period for filing nomination papers and until 5:00 'p.m. of the next working day after the close of the nomination period. SECTION 2: SPANISH LANGUAGE: The City Clerk shall provide a Spanish translation to those candidates who wish to have one. Such candidate shall be responsible for the additional cost involved for such translation. The City Clerk shall also make available a copy of all election materials in Spanish to anyone upon request. SECTION 3: ADDITIONAL MATERIALS: No candidate will be permitted to include additional materials in the sample ballot package. SECTION 4: PAYMENT: Candidate's Statement: Each candidate filing a candidate's statement shall, at the time of filing said statement, pay a deposit of $175.00 for the printing of the statement in English only and an additional $75.00 for a Spanish translation as his or her pro rata share of the printing and mailing of the candidate's statement in the Sample Ballot and Voter Information Pamphlet. The City Clerk shall bill each candidate for any cost in excess of the deposit and shall refund any unused portion of any deposit. Filing Fee: In accordance with Section 22843 of the Election Code of the State of California, the City Council hereby determines that each candidate for municipal office shall at the time of filing, pay a fee of $25.00 to cover costs of processing nomin- ation papers. SECTION 5: BALLOT MEASURES: It is hereby resolved that arguments will be permitted to be exchanged and rebuttals, not to exceed 250 words, thereto filed, pursuant to Elections Code Section 4015.5 or 5014.5. SECTION 6: The City Clerk shall provide each candidate or the candidate's representative a copy of this Resolution at the time nominating petitions are issued. Resolution No. 82-2 Page 2 SECTION 7: The City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of passage and adoption ~th~reef/in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
