HomeMy WebLinkAbout83-152 - ResolutionsRESOLUTION NO. 83-152 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA GIVING ITS PRELIMINARY APPROVAL TO THE ENGINEER'S REPORT FOR THE LANDSCAPE MAINTENANCE DISTRICT NO. 3 WHEREAS, Part 2 of Division t5 (commencing with Section 22500) of the California Streets and Highways Code authorizes this City Council to initiate proceedings for the formation of an assessment district to improve and maintain landscaping, basin and storm drain located therein; and WHEREAS, pursuant to Resolution No. 83-151 this City Council initiated proceedings for the formation of an assessment district to be known as "Landscape Maintenance District No. 3" to improve and maintain landscaping, basin and storm drain to be located in the boundaries of said Landscape Maintenance District and ordered the preparation and filing of a report in accordance with Article 4 (commencing with Section 22565) of Chapter 1 of the California Streets and Highways Code; and WHEREAS, there has been presented to this City Council that certain "City of Rancho Cucamonga Engineer's Report for Landscape Maintenance District No. 3"; and WHEREAS, this City Council has duly considered said Engineer's Report in each and every part thereof, and finds that each and every part of said Engineer's Report is adequate and sufficient and that said Report does not require modification in any respect. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby resolve as follows: SECTION 1: This City Council hereby gives its preliminary approval to the Engineer's Report referred to in the recitals hereinabove. SECTION 2: Said Engineer's Report which is referred to in the recitals hereinabove shall stand as the City Engineer's Report for the purposes of all subsequent proceedings in connection with the formation "Landscape Maintenance District No. 3"- PASSED, APPROVED, and ADOPTED this 7th day of September, 1983- AYES: Dahl, Buquet, Schlosser, Frost, Mikels NOES: None ABSENT: None ATTEST: Lauren M. Wasserman, City Clerk Resolution No. 83-152 Page 2 CITI OF RINCHO CUCtMONGI ENGINEER ' S REPORT FOR LANDSCAPE NILINTENINCE DISTRICT 1~0. ~ SECTION 1. AUTHORITY FOR REPORT This report is prepared in compliance with the requirements of Article 4, Chapter 1, Division 5 of the Streets and Highways Code, State of California (Landscaping and Lighting Act of 1972). SECTION 2. GENERAL DESCRIPTION The report deals with the establishment of Landscape Maintenance District No. 3 in the City of Rancho Cucamonga. Area to be included in the work program are specifically defined in the body of the report and on the attached Assessment Diagram. The total area of said parkways being 6,057 square feet, and a detention basin located on Parcel No. 8. Work to be provided for, with the assessments established by the District, are: The furnishin~ of services and materials for the ordinary and usual mintenanee, operating and serviein~ or any parkn~ay and detention basin improve, ent. Improve, ent maintenance is eonsldered of general benefit to all aree~ in the District and cost shall be divided on a par lot basis. SECTION 3. PLANS AND SPECIFICATIONS The plans and specifications for landscaping, detention basin and storm drain are to be prepared by the developer. The plans are as stipulated in the conditions of approval and as approved by the City Engineer and City Planning Division. Reference is hereby made to the subject Parcel Map and the assessment diagram for the exact location of the landscape area. The plans and specifications for landscape improvements on the individual Parcels are hereby made a part of this report to the same extent as if said plans and specifications were attached hereto. Detailed maintenance activities include: The mpair, teeoval or replacement of all or any part of any inUreresent, to include landseapin~, detention basin and storm drain, providin~ for the life, growth, health and beauty of the landscaping, ineludin~ cultivation, irTi~ation, trisain~, spraying, fertiliztn~ or treatin~ for disease or injury; the re~val of trimain~s, rubbish, debris and other solid waste, the maintenance, repair and replacement as necessary of all irrl~ation systems, and cleanin6 of drains6e inlet and outlet structures, past control, debris teeoval, fenee repair and all associated work for the successful functionin~ of the systems. SECTION 4. ESTIMATED COSTS No costs will be incurred for improvement construction. All improvements will be constructed by developers. Based on data from other cities, contract analysis and developed work standards, it is estimated tha maintenance costs for assessment purposes will equal thirty cents ($.30) per square foot per year for parkway and a Lump Sum $1000 annually for detention basin maintenance. These costs are estimated only, actual assessments will be based on actual cost data. The estimated total cost for Landscape Maintenance District No. 3 comprised of 8 lots and per lot costs are shown below: Resolution No. 83-152 Page 3 Total Annual Maintenance Cost: Landscaping 0.30 x 6057 Detention Basin - Lump Sum and Storm Drain TOTAL $1817.10 1000.00 $2817.10 Per Lot Annual Assessment $2817 divided by 8 = $352.14 Per Lot Monthly Assessment = $29.35 Assessment shall apply to each lot as enumerated in Section 6 and the attached Assessment Diagram. SECTION 5- ASSESSMENT DIAGRAM A copy of the proposed Assessment diagram is attached to this report and labeled "Exhibit A". SECTION 6. ASSESSMENT Improvement for the entire district is found to be of general benefit to all lots within the District and that assessment shall be equal for each parcel. SECTION 7. ORDER OF EVENTS 1. City Council approves institution of District proceedings. 2. City Council adopts Resolution of Preliminary Approval of City Engieer's report. 3. City Council adopts Resolution of Intention to form a District and sets a public hearing date. 4. City Council conducts public hearing, considers all testimony and determines to form a District or abandon proceedings. 5- Every year in May, the City Engineer files a report with City Council. 6. Every year in June, the City Council conducts a public hearing and approves, or modifies and approves the individual assessments.
