Home My WebLink About84-134 - ResolutionsRESOLUTION NO. 84-134 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, OF PRELIMINARY APPROVAL OF CITY ENGINEER'S ANNUAL REPORT FOR LANDSCAPE MAINTENANCE DISTRICT NO. 1 RESOLVED by the City Council of the City of Rancho Cucamonga that: WHEREAS, pursuant to the Landscape and Lighting Act of 1972, the City Engineer is required to make and file with the City Clerk of the City an annual report in writing for which assessments are to be levied and collected to pay the costs of the improvement of said Landscape Maintenance District No. 1; and WHEREAS, the City Engineer has made and filed with the City Clerk of said City a report in writing as called for under and pursuant to said Act, which has been presented to this Council for consideration; and WHEREAS, said Council has duly considered said report and each and every part thereof, and finds that each and every part of said report is sufficient, and that said report, nor any part thereof, requires or should be modified in any respect. NOW, THEREFORE, it is ordered as follows: 1. That the Engineer's Estimate of the itemized costs and expenses of said work and of the incidental expenses in connection therewith, contained in said report be, and each of them are hereby preliminarily approved and confirmed. 2. That the diagram showing the Assessment District referred to and described in said report, the boundaries of the subdivisions of land within said Assessment District are hereby preliminarily approved and confirmed. 3. That the proposed assessment upon the subdivisions of land in said Assessment District in proportion to the estimated benefit to be received by said subdivision, respectively, from said work and of the incidental expenses thereof, as contained in said report is hereby preliminarily approved and confirmed. 4. That said report shall stand as the City Engineer's Annual Report for the fiscal year 1984-85 for the purposes of all subsequent proceedings. PASSED, APPROVED, and ADOPTED this 16th day of May, 1984. SECTION 2. Gr~ssnAL DESCRIPTION The report deals with the actual costs for Fiscal Year 1983-84 and the estimated assessments for Fiscal Year 1984-85 of Landscape Maintenance District No. 1 for various subdivisions throughout the City of Rancho Cucamonga. Areas to be included in the work program are specifically defined in the body of the report and on the attached Assessment Diagrams. The total area of said parkways being 377,077 square feet. Work to be provided for, with the assessments established by the District area: The furnishing of services and materials for the ordinary and usual maintenance, operating, servicing and restoration of any parkway improvement. Improvement maintenance is considered of general benefit to all areas in the District and cost shall be divided on a per lot basis. SECTION 5- PLANS AND SPECIFTCATIONS Parkway improvements were constructed by the developers for the individual subdivision parkways. The plans and parkways are as stipulated in the conditions of approval for each subdivision and as approved by the City Planning Division. Reference is hereby made to the subject tract maps and the assessment diagram for the exact location of the landscape areas. The plans and specifications for landscape improvement on the individual tracts are hereby made a part of this report to the same extent as if said plans and specifications were attached hereto. Detailed maintenance activities on the enumerated parkway areas include: the repair, removal or replacement of all or any part of any improvement, providing for the life, growth, health and beauty of the landscaping, including cultivation, irrigation, trimming, spraying, fertilizing or treating for disease or injury; the removal of trimmings, rubbish, debris and other solid waste, the maintenance, repair, and replacement as necessary of all irrigation system, and the removal of graffiti from walls ~mmediately adjacent to the cultivated areas. SECTION ~. ESTINATED COSTS Due to the general deterioration, vandalism or loss various parkways within the District will be renovated, repaired and replanted at an estimated cost of $26,452.46. Based on historical data adjusted for inflation, it is estimated that maintenance cost for assessment purposes will equal seventeen cents ($.17) per square foot for the fiscal year 1984-85. ASSESSMENT Improvement for the entire district are found to be of general benefit to all lots within the District and that assessment shall be equal for each parcel. It is proposed that all future development shall be annexed to the District.
