HomeMy WebLinkAbout83-128 - ResolutionsRESOLUTION NO. 83-128 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA GUARANTEEING MAINTENANCE OF FLOOD PROTECTION MEASURES IN CONJUNCTION WITH TRACTS 11934, 12044, 12045, AND 12046 WHEREAS, the City of Ranoho Cucamonga California Municipal Code Chapter 19.12 Flood Control requires that the City shall review all development permit applications to determine if the site of a proposed development is reasonably safe from flooding; and WHEREAS, Section 19.12.090 further stipulates that the governing body of the City will ensure that the flood carrying capacity within the altered or relocated portion of any watercourse is maintained; and WHEREAS, to meet the provisions of Municipal Code Chapter 19.12 and conditions of the United States Department of Housing and Urban Development and Federal Emergency Management Agency requirements for Title X financing, the developers of Tracts 11934, 12044, 12045 and 12046 have been required to install various levees, walls, channels, basins and other appurtenant drainage facilities, to provide 100 year flood protection for said tracts; and WHEREAS, it is required that said facilities must be maintained to function as designed until such time as sufficient permanent facilities have been installed. NOW, THEREFORE, BE IT RESOLVED, that the City of Rancho Cucamonga through agreement with the R.C. Land Company has received sufficient agreements and security to assure the maintenance of the following interim drainage and flood control facilities in conjunction with Tracts 11934, 12044, 12045, and 12046. A. Training Levee Extending from approximately the intersection of the west boundary of Tentative Tract 11934 with Highland Avenue (State Route 30) northeasterly at an angle of approximately thirty degrees to intersection with the east tract boundary. Said levee to be designed in conformance with the requirement of the U.S. Army Corp of Engineers. B. Retaining wall along west boundary of Tracts 11934, 12044, 12045, and 12046. C. Flood wall along Highland Avenue coinciding with the north boundary of Tract 12046. D. Temporary Earthen Channel Approximately 160 feet wide located on the westerly boundary of the Edison transmission easements along the future alignment of Day Creek Boulevard from Highland Avenue to south of Base Line Road. Maintenance to include all appurtenant inlet, outlet and cross culverts servicing said channel. E. Interim Retarding Basin Retarding basin located south of Base Line designed to retard flow discharging from the storm drain Resolution No. 83-128 Page 2 systems servicing tract 11934, 12044, 12045 and 12046 to reduce increased runoff to historic natural levels. F. Master Plan Storm Drain Facilities All drainage facilities part of the Victoria Drainage Master Plan included for construction in Subdivision Agreement for Tracts 11934, 12044, 12045 and 12046. BE IT FURTHER RESOLVED, that said drainage facilities shall be inspected and maintained upon completion and acceptance by the City in accordance with the minimum schedule outlined in Exhibit "A". Maintenance will be continuous until completion of the Master Plan improvement of Day Creek Channel and Debris Basin adjacent to said tract boundaries. Mikels, Mayor Mayor Pro Tem Resolution No. 83-128 Page 3 EXHIBIT "A" Minimum Inspection Schedule: 1. Prior to September 15 each year subsequent to April 15 (Before and after normal rainfall season). 2. After breakout of flow from the Day Creek reception levee impacting tract drainage facilities. Maintenance Schedule is as follows: All pipes and culverts in conjunction with training levee earthen channel and basin shall be clear of debris. Any failures of the rock slope of the training levee and earth channel shall be repaired to original plan configuration. The sedimentation along the training levee, retaining walls or flood walls and earthen channel will not be allowed to exceed 12 inches and will be scheduled for removal when its depth reaches 9 inches. 4. Any retaining walls or flood wall indanger of failure shall be repaired as soon as possible. Interim retarding basin maintenance shall include the yearly cleaning of debris from the Basin, to maintain design capacity, removal of vegetation, maintenance of all fencing, inlet and outlet structures and pest control, restoration of private property between the Basin and existing channel facilities. All such maintenance shall be done prior to November 1 of each year. Inspection and maintenance shall be under the supervision of the City Engineer, who is a registered Civil Engineer in the State of California.
