HomeMy WebLinkAbout83-68A - ResolutionsRESOLUTION NO. 83-68A A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, DECLARING ITS INTENTION TO LEVY AND COLLECT ASSESSMENTS WITHIN LANDSCAPE MAINTENANCE DISTRICT NO. 1 FOR THE FISCAL YEAR 1983-84 PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972; AND OFFERING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO The City Council of the City of Rancho Cucamonga, pursuant to the provisions of the Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the State of California, does resolve as follows: Description of Work SECTION 1: That the public interest and convenience require and it is the intention of this City Council to levy and collect assessments within Landscape Maintenance District No. 1 for the fiscal year 1983-84 for the maintenance and operation of those parkways and facilities thereon dedicated for common greenbelt purposes by deed or recorded subdivision tract map within the boundaries of said District. Said maintenance and operation includes the cost and supervision of any sprinkler system, trees, grass, plantings, landscaping, ornamental lighting, structures and walls in connection with said parkways. Location of Work SECTION 2: The foregoing described work is to be located within roadway right-of-way and landscaping easements enumerated in the report of the City Engineer and more particularly described on maps which are on file in the City Clerk's Office, entitled "Assessment Diagrams Landscape Maintenance District No. 1". Description of Assessment District SECTION 3: That the contemplated work, in the opinion of said City Council, is of more than local or ordinary public benefit, and the said City Council hereby makes the expense of the said work chargeable upon a district, which said district is assessed to pay the costs and expenses thereof, and which district is described as follows: All that certain territory of the City of Rancho Cucamonga included within the exterior boundary lines shown upon that certain "Map of Landscape Maintenance District No. 1", indicating by said boundary line the extent of the territory included within the proposed assessment district and which map is on file in the Office of the City Clerk of said City. Reference is hereby made to said map for further, full and more particular description of said assessment district, and the said map so on file shall govern for all details as to the extent of said assessment district. Report of Engineer SECTION 4: The City Council of said City by Resolution No. 83-67 has approved the annual report of the City Engineer which report indicates the amount of the proposed assessment, the district boundary, assessment zones, and the method of assessment. The report titled "Annual Engineer's Report, Landscape Maintenance District No. 1" is on file in the office of the City Clerk of said City. Reference to said report is hereby made for all particulars for the amount and extent of the assessments and for the extent of the work. Resolution No. 83-68 Page 2 Time and Place of Hearing SECTION 5: Notice is hereby given that on the 3rd day of August, 1983, at the hour of 7:30 p.m. in the City Council Chambers in the City of Rancho Cueamonga, any and all persons may appear and show cause why said work should not be done or carried out or why assessments should not be levied and collected for fiscal year 1983-84. Protests must be in writing and must contain a description of the property in which each signer thereof is interested, sufficient to identify the same, and must be delivered to the City Clerk of said City prior to the time set for the Hearing, and no other protests or objections will be considered. If the signer of any protest is not shown upon the last equalized assessment roll of such protest must contain or be accompanied by written evidence that such signer is the owner of the property so described. Landscaping and Lighting Act of 1972 SECTION 6: All the work herein proposed shall be done and carried through in pursuance of an act of the legislature of the State of California designated the Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the State of California. Publication of Resolution of Intention SECTION 7: Published notice shall be made pursuant to Section 6961 of the Government Code. The Mayor shall sign this Resolution and the City Clerk shall attest to the same, and the City Clerk shall cause the same to be published 10 days before the date set for the hearing, at least once in The Daily Report, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cueamonga, California.
