A RESOLUTION OF THE CITY CO~]NCIL OF ~RE CIT~ OF RANCHO

WHEREAS, the City Council of the City of Rancho Cucemonga did on the
15th day of June, 1988, adopt its Resolution of Intention No. 88-388 to order
the therein described work in connection with Annexation No. 8 to Landscape
Maintenance District No. 4, which Resolution of Intention No. 88-388 was duly
and legally published in the time, form and manner as required by law, shown by
the Affidavit of Publication of said Resolution of Intention on f//e in the
office of the City Clerk; and
~HEREAS, i" 'after '~he adoption thereof, notice of the passage of said
Resolution of Inten~ion, headed ."Notice of Improvement", was duly and legally
posted in the time, 'form, manner, location, and nmaber as required by law, as
appears from the Affidavit of Posting said notices, on file in the office of
the City Clerk; and
~IEREAS, after the adoption thereof, notices of the adoption of the
Resolution of Intention were duly mailed to all persons owning real property
proposed to. be assessed for the improvements described in said Resolution of
Intention No. 88-388, according to the names and addresses of such owners as
the same appears on the last mailing or as known to the City Clerk of the City
of Rancho Cucamonga, which said copies were duly mailed in the time, form, and
manner as required by law, as appears from tbs Affidavit of Mailing on file in
tbs office of the City Clerk; and
WHEREAS. said City Council having duly received considered evidence,
oral and documentary, concerning the jurisdiction facts in this proceeding and
concerning the necessity for the contemplated work and the benefits to be
derived therefro~ and said City Council having now acquired jurisdiction to
order the proposed work.
SECTION 1~ It is hereby resolved by the City Council of the City of
Rancho Cucamonga that the public interest and convenience requires the
annexation to tbs District and tbs ordering of tbs work. and said City Council
hereby orders that the work. as set forth and described in said Resolution of
Intention No. 88-388, be done and made; and
SECTION 2: Be it further resolved that the report filed by the
Engineer is hereby finally approved; and

SECTION 3: Be it further resolved that the assessments and method of
assessment in the Engineer~s Report are hereby approved.
SECTION 4: Be it flnally resolved that said assessments shall not
begin until after 60 percent of said tracts have been occupied.

Landscape Maintenance District No. 4
Annexation No. 8 for
Parcel Map 9504
SECTION 1. Authority for Report
This report ia in compllance with the requirements of Article 4, Chapter I,
Division 15 of the Streets and Highways Code, State of California (Landscaping
and Lighting Act of 1972).
SECTION 2. ~eneral Description
This City Council has elected to annex all ney subdivisions into Landscape
Maintenance District No. 4. The City Council has detenained that the areas to
be maintained will have an effect upon all lots within Parcel Map 9504 as well
as on the Iota directly abutting the landscaped areas..Ali' lgndscaped areas to
be maintained in the annexed tracts are shown on the recorded Map as roadway
right-of-way or easements to be granted to the City of Rancho Cucamonga.
SECTION 3. Plans and Specifications
The plans and landscaping are as stipulated in the conditions of approval
for the developeent and as approved by the City Engineering Division. Reference
is hereby made to the subject tract map or development plan and the assesment
dlagrem for the exact location of the landscaped areas. The plans and
specifications for landscaped improvement on the individual develot~ent is
hereby made a part of this report to the me extent as if said plans and
specifications were attached hereto.
SECTION 4. Estimated Costs
~lo costs will be Inctrrred for parkway improvement construction. All
improvements will be constructed by developers. Based on historical data,
contract analysis and developed work standards, it is estimated that
maintenance costs for aasesment purposes will equal thirty ($,30) cents per
square foot per year. These costs are estimated only, actual asses~ent will
be based on actual coat data.
Landscape Maintenance District No. 4 is comprised of landscaplng of work
p)an areas for all residential and non-residential (including vacant land)
· projects throughout the Terra Vista Planned Community.
The estimated total cost for Landscape Maintenance District No. 4 including

Assessment shall apply to each lot as enumerated in Section 6 and the
attached assessment diagram. Where the develo~aent covered by this annexation
involves frontage along arterial or collector streets, which are designated for
inclusion in the maintenance district but will be maintained by an active
homeowners association, the~e assessments shall be reduced.
SECTION 5. Assessment Diagram
A copy of the proposed assessment diagram is attached to this report and
labeled "Exhibit A', by this reference the diagram is hereby incorporated
within the text of this report.
S~CTION 6. Assessment
Improvements for the District are found to be of specific benefit to all
properties (residential and nom-residential) vlthtn the District in accordance
with the following relationship:
Single-family residential projects: 1 dwelling unit = 1 assessment unit
Nulti-family residential projects: 1 dwellins unit = 0.5 assessment unit
Non-residential projects: 1.0 acre = 2.0 assessment units
The City Council will ho)d a public hearing in June, to detemalne the
actual assessments based upon the actual costs incurred by the City durin$ the
previous fiscal year which are to be recovered through assessments as required
by the Landscape and Lighting Act of 1972..
S~.CTION ?. Order of Events
1. City Council adopts Resolution of Preliminary Approval of City Engineer's
Report.
2. City Council adopts Resolution of Intention to Annex to District and sets
public hearing date.
3. City Council conducts public hearing, considers all testimony and
determines to Annex to the District or abandon the proceedings.
4. Every year in May, the City Engineer files a report with the City Council.
5. Every year in June, the City Council conducts a public hearing and
approves, or modifies and approve8 the individual assessments.
