Home My WebLink About88-446 - Resolutions RESOLUTION NO. 88-446 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO COCAMqN~A, CALIFORNIA, OF PRELIMINARY APPROVAL OF CITY ENGINEER' S REPORT FOR ANNEXATION NO. 22 TO LANDSCAPE MAINTENANCH DISTRICT NO. 3 WHEREAS, on July 6, 1988, the City Council of the City of Rancho Cucmmonga directed the City Engineer to make and file with the City Clerk of said City a report in writing as required by the Landscaping and Lighting Act of 1972; and WHEREA~, the City Engineer has made and filed with the City Clerk of said City a report in writing as called for pursuant to said Act, which report has been presented to this Council for consideration; and WHEREAS, said City Council has duly considered said repor.t and each and every part thereof, and finds that each and every part of said report is sufficient, and that said report, nor any part thereof, requires or should be modified in any respect. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rancho Cucamonga as follows~ SECTION 1: That the Engineer's Estimate of the itemized costs and expenses of said work and of the incidental expenses in connection therewith. contained in said report be, and each of them are hereby, preliminarily approved and confirmed. SECTION 2: That the diagram showing the Assessment District referred to and described in said report, the boundaries of the subdivisions of land within said Assessment District are hereby preliminarily approved and confirmed. SECTION 3: That the proposed assessment upon the subdivisions of land in said Assessment District in proportion to the estimated benefit to be received by said subdivision, respectively, from said work and of the incidental expenses thereof, as contained in said report is hereby preliminarily approved and confirmed. SECTION 4: That said report shall stand as the City Engineer's Report for the purposes of all subsequent proceedings, and pursuant to the proposed district. Beverly A/Authelet, City Clsrk Resolutlon No. 88-446 Page 3 CITY OF RANCHO CUCAMgNDA Engineer's Report for Landscape Maintenance District No. 3 Annexation No. 22 for PM 10941, DR 86-08, DR 87-52 and CUP 87-19 SECTION 1. Authority for Report This report is in compllance with the requlre~ents of Article 4, Chapter 1. Division 15 of the Streets and Highways Code, State of California (Landscaping and Lighting Act of 1972). SECTION 2. General Description This City Council has elected to annex all new developments into Landscape Maintenance District No. 3. The City Council has detenained the areas to be maintained will have an effect upon all the developments as mentioned above. All landscaped areas to be maintained in the annexed developments are shown on the recorded Map as roadway right-of-way or easements to be granted to the City of Rancho Cucamonga. SECTION 3. Plans and Specifications The plans and landscaping are as stipulated in the conditions of approval for the development and as approved by tbs City Engineering Division. Reference is hereby made to the subject development plan and the assessment diagram for tbs exact location of tbs landscaped areas. The plans and specifications for landscaped improvement on tbs individual development is-hereby:made a part of this report to the same extent as if said plans and specifications were attached hereto. SECTION 4. Estimated Costs No costs will be incurred by the District for parkway and median improvement construction. All improvements will be constructed by developers and or/by the City. Based on historical data, contract analysis and developed work standards, it is estimated that maintenance costs for assessment purposes will equal thirty ($.30) cents per square foot per year. These costs are estimated only, actual assessment will be based on actual cost data. Landscape Maintenance District No. 3 has been demarcated into two zones. Zone ! is comprised of Parcel Map 7349, comprised of 8 parcels, totaling 6,057 square feet. The district was formed in October 5, 1983, for the maintenance of landscaping a detention basin and storm drain within the project. This zone will be assessed on per lot basis for the maintenance costs within the project boundary only as stipulated in the Engineer's Report for the formation of the District. Resolution No. 88-446 Page 4 Zone 2 is comprised of all other projects that are being annexed or will be annexed to this District. All lots or parcels within Zone 2 will be assessed on net acre basis for the maintenance of landscaped median islands on Haven Avenue from 4th Street to Deer Creek Channel, Foothill Boulevard and 4th Street fro~ west to east City limit, Milliken Avenue and Rochester Avenue, Street to Foothill Boulevard, 6th Street frcaa H~ven Avenue to Rochester Avenue and median islands on other major divided highways and so~e partaeays within the Industrial Specific Plan Area and Foothill Boulevard overlay area. The estlzated cost for Landscape Haintenance District No. 3 including Annexation No. 22 is as follows. SECTION 5. Assessment Diagram A copy of the proposed assessment diairsm is attached to this report and labeled "Exhibit A", by this reference the diagram is hereby, incorporated within the text of this report. SECTION. 6. Assessment Improvements for the District are found to be of general benefit to all lots within the District and that assessment shall be equal for each parcel for Zone 1 and shall be equal to the next acreage for each lot or parcel in Zone 2. ResoIation No. 88-446 Page 5 The City Council viii hold a public hearing in June, to detemine the actual assessments based upon the actual costs incurred by the City during the previous fiscal year vhlch are to be recovered through assessments as required by the Landscape and Lighting Act of 1972. SECTION 7. Order of Events 1. City Council adopts Resolution of Preliminary Approval of City Engineer's Report. 2. City Council adopts Resolution of Intention to Annex to District and sets public hearing date. 3. City Council conducts public hearing, considers all testimony and determines to Annex to the District or abandon the proceedings. 4. Every year in Nay, the City Engineer files a report vith the City Council. 5. Every year in June, the City Council conducts a public hearing and approves, or modifies and approves the individual assessments.
