A RESOLUTION OF THE ClT~ ~OUNCIL OF THE CIT~ OF RANCHO
CUCAMDNGA, CALIFORNIA, DEOLARIN~ ITS INTENTION TO ORDER
THE ANNEXATION TO LANDSCAPE MAINTENANCE DISTRICT NO. 1, AN
ASSESS~NT DISTRICT: DESIGNATING SAID ANNEXATION AS
ANNEXATION NO. 48 TO LANDSCAPE MAINTENANCE DISTRICT NO. 1:
PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 AND
OFPERING A TI~ AND PLACE FOR HEARING OBJECTIONS THERETO
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Rancho CucamonEa. pursuant to the provisions of the Landscaping and Lighting
Act of 1972, being Division 15 of the Streets and Highways Code of the State of
California, as follows:
SECTION 1. Description of Work: That the public interest and
convenience require and it is the intention of this Cit~ Council to form a
maintenance district in the City of Rancho Cucamonga for the maintenance and
operation of those parkways and facilities thereon dedicated for common
greenbelt purposes b~ deed or recorded subdivision tract map within the
boundaries of the proposed maintenance district described in Section 2 hereof.
Said maintenance and operation includes the cost and supervision of any
sprinkler sTstem, trees, grass, plantings, landscaping, ornamental lighting,
structures, and walls in connection with said parkways.
SECTION 2. Location of Work: The foregoing described work is to be
located within roadway right-of-way and landscaping easements of Landscape
Maintenance District No. 1 en~erated in the report of the City Engineer and
more particularly described on maps which are on file in the office of the City
Clerk, entitled "Annexation No. 48 to Landscape Maintenance District No.
SECTION 3. Description of Assessment District: That the contemplated
work, in the opinion of said City Council, is of more than local or ordinar~
public benefit, and the said Cit~ Council hereby makes the expense of the said
work chargeable upon a district, which said district is assessed to pay the
costs and expenses thereof, and which district is described as follows:
All that certain territory of the City of Rancho Cucamonga
included within the exterior boundary lines shown upon
that certain "Map of Annexation No. 48 to Landscape
Maintenance District No. 1" heretofore approved by the
City Council of said City by Resolution No. 88-359,
indicating by said boundary lines the extent of the
territor~ included within the proposed assessment district
and which map is on file in the office of the City Clerk
of said City,

SECTION 4. Report of Engineer: The City Council of said City by
Resolution No. 88-359 has approved the report of the en$ineer of work which
report indicates the amount of the proposed assessment, the district boundary,
assessment zones, titled "Engineer' s Report, Annexation No. 48, Landscape
Maintenance District No. 1" is on file in the office of the City Clerk of said
City. Reference to said report is hereby made for all particulars for the
amount and extent of the assessments and for the extent of the work.
SECTION 5. Collection of Assessments: ~he assessment shall be
collected at the same time and in the same manner as County taxes are
collected. The City Engineer sba1! f~_le a report annnally with the City
Council of said City and said Council will annually conduct a hearing upon said
report at their first regular meeting in June, at which time assessments for
the next fiscal year will be determined.
SECTION 6. Time and Place of Hearing: Notice is hereby given that on
July 6, 1988, at the hour of 7:30 p.m. in the City Council Chambers at 9161
Base Line, in the City of Rancho Cucamonga, any and all persons having any
objections to the work or extent of the assessment district, may appear and
show cause why said work should not be done or carried out or why said district
should not be formed in accordance with this Resolution of Intention. Protests
must be in writing and must contain a description of the property in which each
signer thereof is interested, sufficient to identify the same, and must be
delivered to the City Clerk of said City prior to the time set for the hearing,
and no other protests or objections will be considered. If the signer of any
protest is not shown upon the last equalized assessment roll of San Bernardino
County as the owner of the property described in the protests, then such
protest must contain or be accompanied by written evidence that such signer is
the owner of the property so described.
SECTION 7. Landscaping and Lighting Act of 1972: All the work herein
proposed shall be done and carried through in pursuance of an act of the
legislature of the State of California designated the Landscaping and Lighting
Act of 1972, being Division 15 of the Streets and Highways Code of the State of
Cml ifornla.
SECTION 8. Publication of Resolution of Intention: Published notice
shall be made pursuant to Section 61961 of the Government Code. The Mayor
shall sign this Resolution and the City Clerk shall attest to the same, and the
City Clerk shall cause the same to be published 10 days before the date set for
the hearing, at least once in The Daily Report, a newspaper of general
circulation published in the City of Ontario, Callfornla, and circulated in the
City of Rancho Cucamonga, California.
