A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, ORDERING CERTAIN CHANGES AND
MODIFICATIONS TO THE RESOLUTION OF INTENTION AND
PROCEEDINGS RELATING TO THE FORMATION OF A COMMUNITY
FACILITIES DISTRICT
WHEREAS, the CITY COUNCIL of the CITY OF RANCHO CUCAMONGA,
CALIFORNIA, (hereinafter referred to as the "legislative body of the local
Agency"), has previously declared its intention and ordered the preparation of
a "Report" relating to the initiation of proceedings to create a Community
Facilities District pursuant to the terms and provisions of the "Mello-Roos
Community Facilities Act of 1982", being Chapter 2.5, Part 1, Division 2, Title
5 of the Government Code of the State of California. This Community Facilities
District shall hereinafter be referred to as COMMUNITY FACILITIES DISTRICT NO.
88-2 (hereinafter referred to as the "District"); and,
WHEREAS, notice of a public hearing relating to the establishment
of the District, the extent of the District, the furnishing of certain
facilities and services, and all other related matters has been given, and a
"Report", as ordered by this Agency, has been presented and considered, and at
this time it is hereby determined that certain changes and modifications in the
Resolution of Intention and proceedings should be ordered.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga
does hereby resolve as follows:
SECTION 1. That the above recitals are all true and correct.
SECTION 2. That it is in the best public interest and conveniences
to order certain changes and modifications to the proceedings and Resolution of
Intention, as they relate to the formation of the District, and said changes
and modifications are as set forth in the final "Report" submitted and herein
approved, entitled "COMMUNITY FACILITIES DISTRICT REPORT".
SECTION 3. That the proceedings, Resolution of Intention and
"Report" as now presented, shall stand for all future proceedings as the
Resolution of Intention, proceedings and "Report" for the District.
PASSED, APPROVED, and ADOPTED this 21st day of June, 1989.
