A RESOLUTION OF THE CITY COUNCIL OE THE CITY OF RANCHO
CUCAMONGA. CALIFORNIA, APPROVING THE APPLICATION OF THE
HOUSING AUTHORITY OF THE COUNTY OF SAN BERNARDINO FOR
PRELIMINARY LOAN FOR LOW-RENT PUBLIC HOUSING; APPROVING
THE DEVELOPMENT, CONSTRUCTION AND OWNERSHIP OF LOW-RENT
HOUSING PROJECTS OF NOT TO EXCEED 10 DWELLING UNITS; AND
APPROVING THE FOIY OF COOPERATION AGREEMENT BETWEEN THE
CITY OF RANCHO CUCAMONGA AND THE HOUSING AUTHORITY OF THE
COUNTY OF SAN BERNARDINO AND AUTHORIZING ITS EXECUTION.
WHEREAS, it is the policy of this local ity to eliminate
substandard and other inadequate housing to prevent the spread of
slums and blight, and to realize as soon as feasible the goal of a
decent itome and a suitable living environment for all of its citizens;
and
~¢HEREAS, under the provisions of the United States Housing
Act of 1937, as amended, (herein called the "Act") the Department
of Housing and Urban Development (herein called "HUD") is authorized
to provide financial assistance to local public housing agencies
(hereinafter called "Local Authority") for undertaking and carrying
out preliminary planning of low-rent housing projects that will assist
in meeting this goal; and
WHEREAS, the Act provides that there shall bc local dett~rmiuation
of need for low-rent housing to meet needs not being adequately met
by private enterprise and that HUD shall not mak~ any contrnct with a
local Authority for Preliminary Loans for s/~rv~vs and planni~g in
respect to any low-rent housing projects unless the governing body of
the locality involved has bv resolut~on approved rile appI[cntion or
the Local Authority for sucll Preliminary Loan; and
WHEREAS, the Housing Authoritv of thl~ (;ountv of San B~'rnardino
is a public housing agency and is applying to HUD for a Pr~!liminarv
Loan to cover the costs of surveys and planninR ill connection with
the development of low-rent housing; and
~.~rHEREAS, Section 34313 of the California Health and Safety
Code, as amended, provides that no low-rent bousi~lg project shall be
developed, constructed, or owned by tile Local Autiloritv ~lntil tile
governing body of the locality has by resolution apprnvcd such projects;
and
hUHEREAS, pursuant to Section 15 (7) (b) of tht, Act, as amended,
[s necessary that the local governing body enter into ~ Cooperation
Agreement with tile Local Authority providing for local cooperation in
connection with such low-rent housing project; and
WHEREAS, pursuant to Section 34515 of the Health and Safety
Code express authority is given for local governing bodies to enter in
agreements with housing authorities providing for local cooperation with
respect to low-rent housing projects; and
WHEREAS, pursuant to and in compliance with tile provisions of
Section 34518 of the California Health and Safety Code, this governing
body did on March 7. 7979, adopt a Resolution authorizing the publication
in a newspaper of general circulation on March 13, and March 21, 1979,
before this governing body for the purpose of giving all interested
persons an opportunity to be heard as to whether such Cooperation
Agreement should be entered into; and there has been made available one
copy of the proposed Cooperation Agreement for inspection by interested
persons prior to the mentioned public hearing; and
WHEREAS, the notices for a public hearing have been published
as above provided, and this governing body has held a public hearing
starting at the hour of 7 p.m. on the 21th day of March, giving proposed
Cooperation Agreement in the form hereinafter set forth should be entered
into, which said hearing has been concluded with all matters in connection
therewith having been fully considered by this body;
NOW, THEREFORE, BE IT RESOLVED by the Rancho Cucamonga City
Council as follows:
1. There exists in this locality a need for such low-rent
at rents wi thin thu means or low-inco~ne ramilies or persons.
2. The appl/cation of the Local Authority to HUD Lot a Pro] im~nary
Loan in an amount not to exceed (# of units x S500 = 5,000 for surveys
and planning connection with low-rent housing projects of not to exceed 10
dwelling units is hereby approved.
3. The Ranthe Cucamonga City Council does hereby approve the
duve]opment, construction and ownership by the Local Authority of the
project as defined in Paragraph 1 (a) of the Cooperation Agreement
set l~orth [n Paragraph 4 hereof.
4. The Ranthe Cucamon~a City CounciL, after having huld a public
hearing and giving all ingerested persons an opportunity to be heard,
ht, rebv determines, pnrsuant to the provisions of the CaliEorn/a Housing
Co~p~,rat[on I,aw (being Chapter 2 eL Part 2 of Division 24 of the California
Health and SaLetv Co<le), to enter into a G~operatiun Agreement in substantially
the form heroinafter set forth with the Local Anthoritv. q]~e Housing
Antbor[tv of the County of San Bernard/no is hereby authorized and
directed to exeente such Cooperation Agreement in the name and on behalf
~t ',:i~e City off Rc~ncho Cucamonga and tt~e City Clerk is hereby authorized
and directed ~o 3El'ix or impress the official seal of the City of Ranthe
Ctnramonga thereon and to attest to same. Such Coaperation Agreetaunt
shall be in substantially the Form oE the agreement attaehud
