HomeMy WebLinkAbout89-116 - Resolutions RESOLUTION NO~ 89-116 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, DENYING ·TENTATIVE PARCEL MAP NO. 11780, A REQUEST.TO SUBDIVIDE 1.01 ACRES OF LAND I·NTO TWO LOTS IN THE VERY LOW RESIDENTIAL DISTRICT (LESS THAN 2 DWELLING UNITS PER ACRE), LOCATED AT THE NORTHEAST CORNER OF ALMOND STREET AND MAI STREET, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 201-071-55 A. Recitals. (i) MelVin Kornblatt has filed an application for the issuance of the Tentative Parcel Map 11780 as described in the title of thi. s Resolution. Hereinafter,in this Resolution, the·subjec~ Tentative Parcel Map.is referred to as ."the application". (ii) On February 8, 1989, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed·public hearing bn the application. After considering all public testimony, the Planning Commission denied said application due to "no action". (iii) On March 15, 1989, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing to hear an appeal on the application and concluded said hearing on that date. (iv) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, the City Council of the City of Rancho.Cucamonga does hereby find, determine and resolve as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced public hearinO on March 15, 1989 including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follows: (a) The application applies to property located at the northeast corner of Almond and Mai Streets with a street frontage of 220 feet along Almond Street and 200 feet along Mai Street. The property is currently developed with one single family residence; and (b) The properties to the north, east, and west of the subject site are presently designated for residential uses and are currently developed with single family dwellings. These properties range in size from 0.6 to 3.2 acres in size. Therefore, these properties could not be further subdivided because they would exceed the General Plan Very Low Residential density. The property to the south of the subject site is designated for residential uses and is currently vacant; and Resolution No. 89-116 Page 2 (c) The application contemplates a subdivision of the property into two lots; Parcel i being 23,908.1 square feet in area and Parcel 2 being 20,000.3 square feet in area .which is an. average lot area of 21,952 square feet. Therefore, the.subdivision, as proposed, does not meet the average lot size requirement of 22,500 square feet as specified in Section 17.08.040 of the Rancho Cucamonga Development Code for lots, with Very ~Low Residential District. Hence, the applicant, fileda-related Variance request. (d) The placement of the house on-parcel,1 was located in such a way to give the impression that no future lot splits were anticipated. As a result, the proposed property line is skewed at unusual angles in order to achieve the necessary square footage to meet the minimum lot size-requirement, which is not conducive to the subdivision of the property. · 3. Based upon the substantial evidence presented to .this .Council during the above-referenced publ.ic, hearing and.-upon the speci, fic findings of facts set forth in paragraphs 1 and 2 above, this'Council.hereby finds and concludes as follows: (a) That the map is not consistent with the General Plan. (b) That the site is not physically suitable for.the-proposed density or development. 4. Based upon .the findings and conclusions set forth in paragraphs 1, 2, and 3 above, this Council hereby denies the application.
