AND ORDf~LING ~ TO THE c±T~ OF RANC~IO ~ ~Y IDCA~'~u AT THE SOUTHWEST CO1RNf~ OF ..'I'iWANDA AVflNVJE AND 25TH STPm~'~', AND A. Recitals. (i) Pursuant to the Cortese/Knox Local Gov~ Reorganization A~t (Government Code Sectic~ 5600), the City of Rancho Cucamonga is conducting annexation ~roceedings. (ii) ~ne Local Agency Formation C~Lmdssion of San Bernardino County has reviewed the proposed annexation and on December 21, 1988 adopted Resolution No. 2178 approving the above-described annexation and authorizing the City to order to the same. (iii) ~ne territory described in the title of this Resolution is loca*~ within and consistent with the established Sphere of Influence of the City of Rancho Cucamonga, and is contiguous to current City limits. (iv) The annexation of said territory r~presents a logical extension of the City's boundaries and urban services. (v) The City Council has determined that the annexation of the property to the city would be beneficial to tb~ public proposes of the city, in that the property will provide for development, within the District, in a manner consistent with the City's General Plan and with related develoiaL~_~t. (vi) R~gular County assessment roles are to be used for tax purposes. (vii) Subject property will be taxed for existing general bonded indebtedness of the City of Rancho Cucamonga. (viii) The subject 54 acres is legally uninhabited. (ix) The Local Agency Formation O~mL,~ssion has authorized this Council to approve this annexation without notice and hearing and without an election. (x) Ail legal prerequisites to the adoption of this Resolution have B. Resolution. NOW, THEREFORE, the City Council of the city of Rancho Cucamonga does hereby find, determine and resolve as follows: Resolution No. 89-034 Page 2 1. ~1%is Ommcil specifically finds that all of the facts set forth in the R~citals, Part A, of this Resolution ~ne terms and conditions of annexation as approved by the I~cal A~ency Formation C~Lu~dssion are as follows: Condition No. 1: ~ne oor~ucting authority for this proceeding shall be the City Council of the city of Rancho Cucamonga. Condition No. 2: ~ne boundaries are apuroved as set forth in Exhibit "A" attached. Condition No. 3: The following distinctive short form designation shall be used throughout this proceeding: LAFCO 2178. Condition No. 4: Approval is hereby ~L~ted to proceed without notice, b~mring or election with 100 percent larzlowner consent. Condition No. 5: Included in the city's resolution shall be the detachment of County Service Area (CSA) 70 without split of assets or liabilities. ODndition No. 6: The date of issuanoe of the Certificate of Cc~pletion shall be the effective date of this annexation. Based upon the finclings and conclusions set forth in this Resolution this Council hereby resolves that the territory described in Exhibit "A" annexed, and directs the City Clerk to transmit three certified and one non- certified copies of the Resolution to the executive officer of the Local Agency Fczcmation C~u~ssion of the County of San Bernardino.
