WHflREAS, the city has collec~ frc~ properties fronting Haven Avenue,
fees in lieu of construction, bc~ds for participation in construction and/or
lien agreements to participate in the construction of Haven Avenue Medians; and
WH~{EAS, the City of Rancho Cucamonga is constructing a landscaped
median within Haven Avenue frc~ south of L~on Avenue to north of Wilson Avenue;
WHerEAS, the City Council recognizes that it is necessary to establish
methods to equitably share said cost among those benefited by said improvements.
NOW, THEREFORE, the City Council of the City of l~anc~o Cucamorga does
hereby resolve as follows:
1. Ail fees collected in-lieu of construction for Haven
Avenue Medians be deposited in a cc~-truction account
or fund to be used for the pending Haven Avenue Median
2. All bends received frc~ developers ~ ,aranteeing
participating in the construction of Haven Avenue
Medians be called in or otherwise converted to a liquid
asset and deposited in a construction account or fund
to be used for the pending Haven Avenue Median
construction.
3. All lien agre~nents pertaining to the construction of
Haven Avenue Medians be amended to make payment to a
construction account or fund to be used for the pending
Haven Avenue Median construction ~r to reimburse the
City for the Construction thereof.
4. All remaining undeveloped properties fronting onto
Haven Avenue shall be required by Condition of
Development to reimburse the city for the oost for
their proportionate frontage of the Haven Avenue Median
construction. A contribution in lien of the
construction for said landscaped median shall be an
amount equal to $133.00 per linear foot of property
fronting on Haven Avenue. Corner property frontages
shall be measured to the ~rolongation of the ultimate
right-of-way of the side street.

Payment of said cc~trihution shall be made prior to
building permit issuance or recording of the Tract of
Parcel Map, whichever occurs first.
~7%e unit contritution amount shall autcmatically be
~ed c~ a fiscal year basis by the Prime Interest
Rate as determined at the beginning of each fiscal
year.
