HomeMy WebLinkAbout85-269 - Resolutions RESOLUTION NO. 85-269 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, SUMMARILY ORDERING THE VACATION OF PORTION OF MADRONE AVENUE WHEREAS, by Chapter 4, Article 1, Section 8330, of the Streets and Highway Code, the City Council of the City of Raneho Cucamonga is authorized to summarily vacate a portion of the City Street heroinafter more particularly described; and WHEREAS, the City Council found all the evidence submitted that a portion of Madrone Avenue is unnecessary for present or prospective public street purposes because it has been superceded by relooation. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Raneho Cueamonga as follows: SECTION 1: That the City Council of the City of Raneho Cueamonga hereby makes its order vacating that portion of street on Map V-047 on file in the office of the City Clerk of the City of Rancho Cucamonga, which has been further described in a legal description which is attached hereto, marked Exhibit "A", and by reference made a part thereof. SECTION 2: That from and after the date the resolution is recorded, said portion of Madrone Avenue no longer constitutes a street or public utility easement. SECTION 3: That the City Clerk shall cause a certified copy of this resolution to be recorded in the office of the County Recorder of San Bernardlno County, California. Executed this 19th day of September, 1985 at Rancho Cucamonga, California. t k Beverly ~/Authele , City Cler Resolution No. 85-269 Page 2 EXHIBIT "A" DESCRIPTION OF VACATION OF A PORTION OF MAORONE AVE That portion of Lot 23, Section 9, Township 1 South, Range 7 West, in the City of Rancho Cucamonga, County of San Beznardlno, State of California shown on map of Cucamonga Lands, recolded in Book ~, Page 9, of Naps, in the Office of the Recorder of said County, described as follows: Commencing at the intersection of the centerline of Bakel Avenue with the centerline of Ninth Street as shown on map filed in Book 10, Page 90, of Records of Survey, in the Office of the Recorder of said County: Thence along said last mentioned centerline as shown on said last mentioned map, N89° 54'21"E 666.92 feet to its intersection with the Southerly prolongation of the course of "south 880.7 feet" in the centerline of that certain 60.00 foot wide strip of land, for Madtone Avenue, as described in deed recorded in Book 871, Page 177, of Oeeds, in the Office of the Recorder of said County: Thence along said Southerly prolongation NO° 02'll"W 60.00 feet to a point in the Northerly line of the Southerly 60.00 feet of said lot. Thence N89°54,21,,E along said Northerly line a distance of 25.00 feet to an angle point in the East line of Madtone Avenue, said point being the True Point of Beginning; Thence continuing N89°54,21.E a distance of 5.00 feet to an angle point in the East line of Mad:one Avenue. Thence SO=02'll"E along said East line a distance of 30.00 feet to the North line of 9th Street (60 feet wide) Thence S89°54,21.W along said North line a distance of 5.00 feet; Thence NO°O2,11-W parallel with said East line a distance of 30 feet to the True Point of Beginning.
