A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA ORDERING THE WORK IN CONNECTION WITH ANNEXATION
NO. 1 TO STREET LIGHTING MAINTENANCE DISTRICT NO. 4
(TERRA VISTA PLANNED COMMUNITY) AND ACCEPTING THE FINAL
ENGINEER'S REPORT FOR TRACT NOS. 12365 AND 12590-1 THRU 6
WHEREAS, the City Council of the City of Rancho Cueamonga did on the
15th day of June, 1985, adopt its Resolution of Intention No. 85-145 to order
the therein described work in connection with Annexation No. 1 to Street
Lighting Maintenance District No. 4, which Resolution of Intention No. 84-145
was duly and legally published in the time, form and manner as required by
law, shown by the Affidavit of Publication of said Resolution of Intention on
file in the office of the City Clerk; and
WHEREAS, after the adoption thereof, notice of the passage of said
Resolution of Intention, headed "Notice of Improvement", was duly and legally
posted in the time, form, manner, location, and number as required by law, as
appears from the Affidavit of Posting said notices, on file in the office of
the City Clerk; and
WHEREAS, after the adoption thereof, notices of the adoption of the
Resolution of Intention were duly mailed to all persons owning real property
proposed to be assessed for the improvements described in said Resolution of
Intention No. 84-145 according to the names and addresses of such owners as
the same appears on the last mailing or as known to the City Clerk of the City
of Rancho Cucamonga, which said copies were duly mailed in the time, form, and
manner as required by law, as appears from the Affidavit of Mailing on file in
the office of the City Clerk~ and
WHEREAS, said City Council having duly received considered evidence,
oral and documentary, concerning the Jurisdiction facts in this proceeding and
concerning the necessity for the contemplated work and the benefits to be
derived therefrom and said City Council having now acquired Jurisdiction to
order the proposed work.
SECTION 1: It is hereby resolved by the City Council of the City of
Rancho Cucamonga that the public interest and convenience requires the
annexation to the District and the ordering of the work, and said City Council
hereby orders that the work, as set forth and described in said Resolution of
Intention No. 84-145 be done and made; and
SECTION 2: The Report filed by the Engineer is hereby finally
approved; and
SECTION 3: The assessments and method of assessment in the
Engineer's Report are hereby approved.
SECTION 4: The assessments shall not begin until after 60 percent
of said tracts have been occupied.
PASSED, APPROVED, and ADOPTED this 5th day of June, 1985.

Tract 12365, Tracts 12590-1, -2, -3, -4, -5, -6, park, and street right-of-way
SECTION 1. Authority for qeport
This report is prepared in compliance with the requirements of Article 4,
Chapter 1, Division 15 of the Streets and Highways Code, State of California
(Landscaping and Lighting Act of I982).
SECTION 2. General Description
Street Lighting Maintenance District No. 4 (the "District") provides for
operation, servicing, and maintenance of street lights on local and collector
streets and secondary arterials (except Church Street) in the Tetra Vista
Planned Community. All residential developments in Terra Vista are to be
annexed to the District Pursuant to Ordinance No. 190; areas to be maintained
which lie outside residential developments are also to be annexed for mainte-
nance purposes. This Annexation No. i annexes to the District the following
areas:
Tract No. 12365 {270 multifamily dwellings)
Tract Nos. 12590-1, 12590-2, 12590-3, 12590-4, 12590-5 and 12590-6
(total 180 single family dwellings) '
Northwest ~eighborhood park (Lot 1, Parcel Map No. 8842) and trail
Tetra Vista Parkway right-of-way (south half} from Spruce Avenue to
Church Street
SECTION 3. Plans and SPecifications
The plans and specifications for street lighting have been prepared by
the developers. The plans and specifications are as stipulated in the con-
ditions of approval for the development and as approved by the City
Engineering Division.
Reference is hereby made to the subject tract maps or development plans
and the assessment diagrams for the exact location of the street lighting
areas. The plans and specifications for street lighting improvements are
hereby made a part of this report to the same extent as if said plans and
specifications were attached hereto.

SECTION a. Estimated Costs
No costs will be incurred for street lighting constructinn. All improve-
ments will be constructed by developers. Based on available data, it is
estimated that maintenance costs for assessment Purposes will be as set forth
below. These costs are estimated only; actual assessments will be based on
actual cost data.
The estimated annual maintenance cost for Annexation No. I is as follows
based on high pressure sodium vapor lamps:

;ECTION 6. Assessment
Maintenance costs for the entire District are found to be of specific
~enefit to all developed residential Property within the District in accor-
lance with the ~ollowing relationship:

The City Council will hold a public hearing in June 1985, to determine
the actual assessments based upon the actual costs incurred by the City during
the 1984/85 fiscal year.
SECTION 7. Order of Events
1. City Council adopts resolution instituting Proceedings.
2. City Council adopts Resolution of Preliminary Approval of City Engineer's
Report.
3. City Council adopts Resolution of Intention to Annex to District and sets
public hearing dates.
4. City Council conducts public hearing, considers all testimony and date'r-
mines to annex to the District or abandon the Proceedings.
5. Every year in -May, the City Engineer files ~-re~ort with the City
Council.
6. Every year in June, the City Council conducts a public hearing and
approves, or modifies and approves the individual assessments.
