AND 13022
WHEREAS, the City Council of the City of Rancho Cucamonsa did on the
3rd day of September, 1986, adopt its Resolution of Intention No. 86-261 to
order the Charsin described work in connection with Annexation No. 2 to Street
Lighting Maintenance District No. 3, which Resolution of Intention No. 86-261
was duly and legally published in the time, form and manner as required by law,
shown by the Affidavit of Publication of said Resolution of Intention on file
in the office of the City Clerk; and
WHEREAS, after the adoption thereof, notice of the passage of said
Resolution of Intention, headed '~qotice of Improvement", was duly and legally
posted in the time, form, manner, location, and number as required by law, as
appears from the Affidavit of Posting said notices, on file in the office of
the City Clerk; and
WHEREAS, after Che adoption thereof, notices of the adoption of the
Resolution of Intention were duly mailed Co all persons owning real property
proposed Co be assessed for the improvements described in said Resolution of
Intention leo. 86-261, according Co the names and addresses of such owners as
the same appears on Ebe last mailing or as known Co the Ci~y Clerk of the City
of Rencbo Cucasonga, which said copies were duly mailed in the time, form, and
manner as required by law, as appears from Cbe Affidavit of Mailing on file in
Cbe office of the City Clerk; and
WHEREAS, said City Council having duly received considered evidence,
oral and documentary, concerning the jurisdiction facts in this proceeding and
concerning the necessiL7 for the contemplated work end Cbe benefice Co be
derived therefrom end said City Council haviq now acquired jurisdiction to
order the proposed work,

annexation to Cbe District and the ordering of the work, and said City Council
hereby orders Chat the york, as set forth and described in said Resolution of
Intention No. 86-261 be done and made; and

approved; and
SECTIrm 3: The assessments and method of assessment in the
Engineer's Report are hereby approved,
SEtTIm 6: The assessments shall not begin until after 60 percent
of said tracts have been occupied.

SECTION 1. Authority for Report
This report ts in compliance with the requirements of Article 4, Chapter
1, Division 15 of the Streets and Highways Code, State of California
(Landscaping and Lighting Act of 1972).
SECTION 2. General Description
This City Counctl has elected to annex the tracts enumerated in Exhibit
"A' into Street Lighting Natntenance District No. 3. The City Council has
determined that the street lights to be maintained will have an effect upon
all lots within said tracts as well as on the lots directly abutting the
street lights.
Work to be provided for with the assessments established by the district
are:
The furnishing of services and materials for the ordinary and usual
maintenance, operating and servicing of street light improvements on
arterial and certain collector streets. Improvement maintenance is
considered of general benefit to all areas in the District and cost
shall be divided on a per lot basis. In the case of condomtntums
with airspace ownership only, and apartments, a dwelltng unit shall
be considered to benefit the same as a lot.
SECTION 3. Plans and Specifications
The plans and specifications for street ltghttng have been prepared by the
developers. The plans and street lights are as stipulated in the conditions
of approval for the development and as approved by the City Engineering
Division. Reference is hereby made to the subject tract map or development
plan and the assessment diagram for the exact location of the street lighting
areas. Th~ plans and specifications for street lighting improvement on the
individual development is hereby made a part of this report to the same extent
as if said plans and specifics were attached hereto.
Detailed maintenance activities on the street lighting district
include: the repair, removal or replacement of all or any part of
any improvement, providing for the illumination of the subject area.
SECTION 4. Estimated Costs
No costs will be incurred for street lighting improvement construction.
All improvements will be constructed by developers. Based on available data,
it is estimated that maintenance costs for assessment purposes will be as
indicated below. These costs are estimated only, actual assessments will be
based on actual cost data.
The estimated total cost for Lighting Maintenance District No. 3
(including Annexation No. 2 camprtsed of 1277 units and 6 95001. street lights
and 504 5800L lights) is shown below:

SECTION 6. Assessment
Improveeent for the OtstrIct are found to be of general benefit to all
dwelltrig untts wtthtn the Otstrtct and that assessment shall be equal for each
unit. Where there ts more than one delltng unit per lot or parcel of
assessable land, the assessment for each lot or parcel shall be proportional
to the huebet of dve111ng units per lot or parcel.
Zt ts proposed that all future developeent shall be annexed to the
DIstrict.

Order of Events
Ctty Counct1 adopts resolution Instituting proceedings.
City Council adopts Resolutlon of Preliminary Approval of Cfty En~tneer's
Report.
CIty Council adopts Resolution of Intention to annex to Otstrtct and sets
public hearing date.
Ctty Council conducts public heartng, considers all testimony and
determines to form a DIstrict or abandon the proceedings.
Every year tn Nay, the Ctty Engineer files a report wtth the City Council.
Every year tn June, the Ctty Council conducts a public heartrig and
approves, or modtfles and approves the Individual assessments.
