HomeMy WebLinkAbout86-191 - ResolutionsRESOLUTIOIq NO. 86 -1 91 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA ORDERIlqG THE HORK IN CONNECTIOta HITR ANNEXATION NO. 3 TO STREET LIGHTING MAINT!~ANCE DISTRICT NO. 4 TERRA VISTA PLANNED CONleNITY) AND ACCEPTIIqG THE FINAL ~GINEER'S REPORT PaR TRACT NOn. 12673, 12802, 12802-1 TRRU -6 WHEREAS, the City Council of the City of Raucho Cucamonga did on the 21st day of May, 1986, adopt its Resolution of Intention No. 8~-158 to order the therein described work in connection with Annexation No. 3 to Street Lighting Maintenance District No. 4, which Resolution of latention No. 86-158 was duly and legally published in the time, form and manner as required by law, shown by the Affidavit of Publication of said Resolution of Intention on file in the office of the City Clerk; and WREREAS, after the adoption thereof, notice of the passage of said Resolution of Intention, beaded "Notice of Improvement", was duly and legally posted in the tins, form, manner, location, and number as required by Taw, as appears from the Affidavit of Posting said notices, on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notices of the adoption of the Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention No. 86-158, according to the names and addresses of such owners as the same appears on the last mailing or as known to the City Clerk of the City of Itshobo Cucamoqa, which said copies were duly mailed in the time, form, and manner as required by lay, as appears from the Affidavit of Mailing on file in the office of the City Clerk; and WHEREAS, said City Council having duly received considered evidence, oral and documentary, concerning the jurisdiction facts in this proceeding and concerning the necessity for the contemplated work and the benefits to be derived therefrom and said City Council baring nov acquired jurisdiction to order the proposed work. SECTIm 1: It is hereby resolved by the City Council of the City of Rancho Cucamoxqa that the public interest and convenience requires the annexation to the District and the ordering of the work, and said City Council hereby orders that the work, as set forth and described in said Resolution of Intention No. 86-158, be done and made; and SECTION 2: The Report filed by the Engineer is hereby finally approved; and SECTIres 3: The assessments sad method of assessRent in the Eugineer's Report are hereby approved. SECTION 4: The assessments shall not begin until after 60 percent of said tracts have been occupied. PASSE, APPROVED, and ADOPTED this 18th day of June, 1986. Authority for Report This report is prepared in compliance with the requirements of Article 4, Chapter I, Division 15 of the Streets and Highways Code, State of California (Landscaping and Lighting Act of 1982). SECTION 2. General Description Street Lighting Maintenance District No. 4 (the "District") provides for operation, servicing, and maintenance of street lights on local and collector streets and secondary artertals {except Church Street) in the Terra Vista Planned Conmunity. All residential developments in Terra Vista are to be annexed to the District pursuant to Ordinance No. 190; areas to be maintained which lie outside residential developments are also to be annexed for mainte- nance purposes. This Annexation No. 3 annexes to the District the following areas: e Tract No. 12673 {393 multifamily dwellings) a Westside Park (Parcel Map No. 9829) a ~ract Nee. 12802-1, 12802-2, 12802-3, 12802-4 and 12802-5 (total 149 single family dwellings) ' m Elm Avenue right-of-way (north half) from Spruce Avenue to eastern boundary of Tract 12673. m Street right-of-way in Tract Nee. 12802-6 and 12802. SECTION 3. Plans and SPecifications The plans and sPecifications for street lighting have been prepared by the developers, The plans and specifications are as stipulated in the con- ditions of approval for the develoPment and as approved by the City Engineering Division. Reference is hereby made to the subject tract maps or development plans and the assessment diagrams for the exact location of the street lighting areas. The plans and specifications for street lighting improvements are hereby made a part of this report to the same extent as if said plans and specifications were attached hereto. SECTION 4. Estimated Costs NO costs will be incurred for street lighting construction. All improvements will be constructed by developers. Based on available data, it is estimated that maintenance costs for assessment purposes will be as set forth below. SECTION 5. Assessment Diagram A copy of the proposed assessment diagram is attached to this report and by this reference is hereby incorporated within the text of this report. Assessment Maintenance costs for the entire District are found to be of specific benefit to all developed residential property within the District in accordance with the following relationship: Land Use Assessment Units Single family residential dwelling I unit Multifamily residential dwelling .5 unit The City Council will hold a public hearing in June 1986, to determine the actual assessments based upon the actual costs incurred by the City during the 1985/86 fiscal year. SECTION 7. Order of Events 1. City Council adopts resolution instituting proceedings. 2. City Council adopts Resolution of Preliminary Approval of City Engineer's Report. 3. City Council adopts Resolution of Intention to Annex to District and sets public hearing dates. 4. City Council conducts public hearing, considers all testimony and determines to annex to the District or abandon the proceedings. 5. Every year in May, the City Engineer files a report with the City Council. 6.
