A. Recitals i (i) James E. Carter has fi/ed an application for the General Plan Amendmen~ No. 88-01A as described in the title of this Resolution. Hereinafter in this ~esol~ rich. the subject General Plan Amendment request is referred to as The A~plic~ rich. ga conducted a duly noticed public hearing on The Application, olution No. 88-24 recommending to this City C~uncil that said denied. On February 17, 1988, the City Council of Rancho Cucamonga conduct~ a ~uly noticed public hearing on the application and concluded said hearin8 n th~ t date. (iv) All legal prerequisites to the adoption of this Resolution have occurre~ B. Res ~uti( n. i NOW, IHEREFORE, IT IS HEREBY FOUND, DETERMINED AND RESOLVED by the City C~u~cil cf the City of Rancho Cucamonga as follows: in 1. This Council hereby specifically finds that all of the facts set forth the Recitals, Part A, of this Resolution are true and correct. J; Based upon substantial evidence presented to this Council during the ahoy eferenced public hearing on February 17, 1988, including written and oral st~ff reports, toEether with public testimony, this Council hereby specific~lly finds as follows: (a) The Application applies to a 3.45 acre parcel of land basicall'~ rectangular in confiEuration, located on the southwest corner of Base Line Roa'] and ~ellman Avenue. Said property is currently designated as Office on the Lmd Us~ Map of the General Plan and is substantially vacant land except for an e:~isting access easement that bisects the property in a north-south directio'~ over which a two way drive~ay with central median ia developed; and Resolutlon No. 88-093 Page 2 (b) The property to the north of the subject site is designated Low Residential (2-4 du/ac) on the Land Use Map of General Map and consists of a church site and surrounding Single Family Residential, the property to the south of the subject site is designated Medium Residential (8-14 du/ac) on the Land Use Map of the General Plan and consists of a multifamily apartment complex, the property to the east is designated Office on the Land Use Map of the General Plan and consists of a Set-vice Station and Office buildings, and the property to the west Is designated Gi¥ic/Gommunity and Park on the Land Use Map of the General Plan and consists of the public library and Lions Park: and (c) The Application requests the Amendment of the Land Use Map of the General Plan from Office to Neighborhood Commercial for the 3.45 acre parcels and (d) The Application would not be consistent with the Land Use Element of the General Plan, could potentially result in significant adverse ~npacts to Persons and property in the ~nmediate vicinity of the subject site, and would not be in the best interests of the health, ~afety and welfare of the citizens of the City of Rancho Cucamonga as follows: (i) S~vere site constraints l~nit the dewelo~nent potential of this site. Specifically, this site must share access to peripheral streets with an adjacent apartment complex. This shared access requirement l~nits the site' s potential to be buffered from the adjacent apartment complex. The Application would permit land uses of greater intensity than under current General Plan designation, Therefore, this Application has the potential to increase land use incompatibility of this site with the adjacent residential use, and this is contrary to the objectives of the Land Use Element of the General Plan. (ii) With the approval of this application, the project site would be subjected to land uses of greater intensity that would expose adjacent residents to greater amounts of noise, objectionable odors, light/ glare, truck traffic, litter and other nuisance factors. These conditions have the potential to result in si~nificant adverse impacts to the people and property in the ~nmediate vicinity of the project site, and therefore, would not be in the beat interest of the health, safety, and welfare of the citizens of the City of Rancho Cuc-,nonga. 3. Based upon the substantial evidence presented to this Council during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs ! and 2 abowe, this Council hereby finds and concludes that the application would not be consistent with the objecttwes of the Land Use Element of the General Plan to organize land uses to avoid creating nuisances among adjacent land uses and would not protect the health, safety, and welfare of the citizens of Rancho Cucamonga, California. 4. In conjunction with The Application, an Initial Study/Prel~ninary Environmental Assesament, in conformity, with the requirements with the California Environmental Quality Act, has Been prepared: however, Council has determined that this project could have a significant adverse effect on the Resolution No. 88-093 Page 3 enviror~ent, lnd hereby declines to make a finding of no significant impact and to certify a .qegative Declaration. 5. Based upon the findings and conclusions set forth in paragraphs 1. 2 and 3 a~ove, this Council hereby resolves that pursuant to Section 65350 to 65362 of the California Government Code, that the City Council of the City of Rancho Cuc~monga hereby denies on the 17th day of February, 1988.
