HomeMy WebLinkAbout88-059 - Resolutions RESOLUTION NO. 88-059 A RE~OLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCA)DNGA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE NNEXATION TO LANDSCAPE MAINTENANCE DISTRICT NO. 3, AN ASSE SMENT DISTRICT: DESIGNATING SAID ANNEXATION AS ANNE ATION NO. 14 TO LANDSCAPE MAINTENANCE DISTRICT NO. 3: PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 AND OFFERING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rancho Cucamcnga, pursuant to the provisions of the Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the State of California, as follows: SECTION 1. Description of Work: That the public interest and convenience require and it is the intention of this City Council to form a maintenance district in the City of Rancho Cucamonga for the maintenance and operation of those parkways and faciliites thereon dedicated for common greenbelt purpDses by deed or recorded subdivision tract map within the boundaries of the proposed maintenance district described in Section 2 hereof. Said ma%ntena.sce and operation includes the cost and supervision of any sprinkle~ system, trees, grass, plantings, landscaping, ornamental lighting, structures, an walls in connection with said parkways. SECTI N 2. Location of Work: The foregoing described work is to be located withi~ roadway right-of-way and landscaping easements of Landscape Maintenance District No. 3 enumerated in the report of the City Engineer and more particularly described on maps which are on file in the office of the City Clerk, entitle "Annexation No. 14 to Landscape Maintenance District No. 3". SECTI~ N 3. Description of Assessment District: That the contemplated work, in the opinion of said City Council, is of more than local or ordinary public benefit, and the said City Council hereby makes the expense of the said work cha~geabli.~ upon a district, which said district is assessed to pay the costs and expe=~ses thereof, and which district is described as follows: All t]~at certain territory of the City of Rancho Cucamonga inclu, ted within the exterior boundary lines shown upon that certain "Map of Annexation No. 14 to Landscape Maint,.~nance District No. 3" heretofore approved by the City ~uncil of said City by Resolution No. 88-058, indic~ting by said boundary lines the extent of the terril~ory included within the proposed assessment district and w]~ich map is on file in the office of the City Clerk of sa:.d City. No./ 88-058 has approved the report of the engineer of work which report ind~cate~ the amount of the proposed assessment, the district boundary, assessment zongs, titled "Engineer' s Report, Annexation No. 14, Landscape MaintenancD District No. 3" is on file in the office of the City Clerk of said City. Reference to said report is hereby made for all particulars for the amount andi exter.t of the assessments and for the extent of the work. S~CTIO~ 5. Collection of Assessments: The assessment shall be collected at the same time and in the same manner as County taxes are collected,i The City Engineer shall file a report annually with the City Council ofl said City and said Council will annually conduct a hearing upon said report at i thei~ first regular meeting in June, at which time assessments for the next f~scal .ear will be determined. SECTIO~ 6. Time and Place of HearinK: Notice is hereby given that on March 2, 1988, t the hour of 7:30 pm in the City Council Chambers at 9161 Base Line, in ~ the City of Rancho Cucamonga, any and all persons having any objections to tle work or extent of the assessment district, may appear and show cause why said work should not be done or carried out or why said district should not be fcrmed in accordance with this Resolution of Intention. Protests must be in writing and must contain a description of the property in which each signer thereof s interested, sufficient to identify the same, and must be delivered to th City Clerk of said City prior to the time set for the hearing, and no oth~r protests or objections will be considered. If the signer of any protest iS not shown upon the last equalized assessment roll of San Bernardino County as the owner of the property described in the protests, then such protest must contain or be accompanied by written evidence that such signer is the owner of the property so described. SgCTION 7. Landscapin~ and Li~htin~ Act of 1972: All the work herein proposed shall be done and carried through in pursuance of an act of the legislature of the State of California designated the Landscaping and Lighting Act of 1975, beimg Division 15 of the Streets and Highways Code of the State of Cal iforniai SECTION 8. Publication of Resolution of Intention: Published notice shall be !made pursuant to Section 61961 of the Government Code. The Mayor shall sign this Resolution and the City Clerk shall attest .to the same, and the City Clerk shall cause the same to be published 10 days before the date set for the hearing, at least once in The Dail~ Report, a newspaper of general circulation published in the City of Ontario, california, and circulated in the City of Rancho Cucamonga, california.
