RECOMMENDATION:
1. Council approve the attached Resolution authorizing the Fiscal Year 1997-98 Budget.

Council approve the attached Resolution adopting the Article XIIIB Appropriations Limit
for Fiscal Year 1997-98.
BACKGROUND:
The City of Rancho Cucamonga has proposed a one year Program of Service with the
1997-98 Fiscal Year Budget. The attached resolution adopts that one year budget and
reflects any changes recommended and approved by Council at the publicly held budget
study sessions.

The State of California Constitution, Article XIIIB, requires that an appropriations limit
be established annually by the City Council. The factor used to develop the
appropriations limit is the C.P.I. change and the change in the City's population. The
additional attached resolution adopts the annual appropriation limit as required by Article
XIIIB of the State Constitution. Based on the factors of the Gann Limit (a C.P.I.

calculation of 4.7% and a population change of 0.24%), the City's fiscal year 1997-98
limit is $26,500,709. The City's fiscal year 1997-98 appropriations subject to this limit
total $20,621,430. It is anticipated that the City will be at 77.8% of its Gann Limit at
June 30, 1998.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA ADOPTING THE CITY'S FISCAL
YEAR 1997-98 BUDGET
WHEREAS, the Rancho Cucamonga City Council held workshops to review the
appropriation requests for the fiscal year 1997-98 on July 31 and August 7, 1997, and;
WHEREAS, the Rancho Cucamonga City Council held a public hearing on the General
City Budget, and;
WHEREAS, this public hearing was published in a newspaper of general circulation and
held on August 14,, 1997;
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga, California
does hereby resolve on this 14th day of August 1997 as follows:
SECTION 1: ADOPTION OF FISCAl, YEAR 1997-98 BUDGET. The City of
Rancho Cucamonga budget for the fiscal year 1997-98, on file in the office of the Finance
Officer, is hereby adopted in the amount of $68,768,380. This budget total includes
appropriations for both the general and other special purpose funds.
SECTION 2: TRANSFERS OF FUNDS BETWEEN AND / OR WITHIN
APPROPRIATIONS. The City Council of the City of Rancho Cucamonga may transfer
funds between funds or activities set forth in the budget. The City Manager may transfer
funds between appropriations within any fund as set forth in the budget and may transfer
appropriations between activities within any cost center in the same fund.
SECTION 3: TRANSFERS OF FUNDS BETW-EEN FUNDS. Transfers of funds
between funds as shown throughout the fund transfer sections of the budget shall be made
as expenditures warrant such transfers.
SECTION 4: DISBURSEMENTS. The City Manager and the Finance Officer, or the
duly designated representative, are hereby empowered and authorized to disburse funds
pursuant to appropriations provided for in the Fiscal Year 1997-98 Budget, and have the
responsibility to establish procedures and to administratively implement and control the
budget on all matters, except direct expenditures by Councilmembers which require
Council approval.

SECTION 5: ADDITIONAl, APPROPRIATIONS. The City Council may amend this
temporary budget to add or delete appropriations.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA,
CALIFORNIA ESTABLISHING AN APPROPRIATIONS LIMIT PURSUANT TO ARTICLE
XIIIB OF THE CALIFORNIA STATE CONSTITUTION FOR FISCAL YEAR 1997-98
wHEREAS, Article XIIIB of the State of California provides that the total annual
appropriations subject to limitation of the State and of each local government shall not exceed
the appropriations limit of such entity of government for the prior year adjusted for changes in
the cost of living and population except as otherwise provided in said Article XIIIB, and;
WHEREAS, pursuant to said Article XIIIB of the Constitution of the State of California,
the City Council of the City of Rancho Cucamonga deems it to be in the best interests of the City
of Rancho Cucamonga to establish an appropriations limit for the Fiscal Year 1997-98, and;
WHEREAS, the Finance Officer of the City of Rancho Cucamonga has determined that
said appropriations limit for the Fiscal Year 1997-98 be established in the amount of
$26,500,709.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby
resolve that an appropriation limit for the Fiscal Year 1997-98 pursuant to Article XIIIB of the
Constitution of the State of California be established in the amount of $26,500,709 and the same
is hereby established.
BE IT FURTHER RESOLVED that said appropriations limit herein established may be
changed as deemed necessary by resolution of the City Council.

SUBJECT: Community Concert at the Epicenter
This is to advise you that Mike Scafuto of Mt. High Entertainment has negotiated with the
following artists for an Epicenter Community Concert performance on Friday, October 10,
1997:
The Guess Who - They will be the main attraction. Some of their hits include
"American Woman," "These Eyes," "No Time" and many others.
John Cafferty, Mitch Ryder & Shadows of Night - These two artists and band will
be the back up attraction. John Cafferty sang the song from the movie "Eddie
& the Cruisers," Mitch Ryder is known for the "Devil with the Blue Dress &
Golly Miss Molly and Shadows of Night is known for "Gloria."
The approval for the agreement with Mt. High to negotiate the talent and assist with the
production of the concert will be on the August 20, 1997 City Council agenda.

RECOMMENDATION:
1. Council approve the attached Resolution authorizing the Fiscal Year 1997-98 Budget.

Council approve the attached Resolution adopting the Article XIIIB Appropriations Limit
for Fiscal Year 1997-98.
BACKGROUND:

The City of Rancho Cucarnonga has proposed a one year Program of Service with the
1997-98 Fiscal Year Budget. The attached resolution adopts that one year budget and
reflects any changes recommended and approved by Council at the publicly held budget
study sessions.

The State of California Constitution, Article XIIIB, requires that an appropriations limit
be established annually by the City Council. The factor used to develop the
appropriations limit is the C.P.I. change and the change in the City's population. The
additional attached resolution adopts the annual appropriation limit as required by Article
XIIIB of the State Constitution. Based on the factors of the Gann Limit (a C.P.I.

calculation of 4.7% and a population change of 0.24%), the City's fiscal year 1997-98
limit is $26,500,709. The City's fiscal year 1997-98 appropriations subject to this limit
total $20,621,430. It is anticipated that the City will be at 77.8% of its Gann Limit at
June 30, 1998.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA ADOPTING THE CITY'S FISCAL
YEAR 1997-98 BUDGET
WHEREAS, the Rancho Cucamonga City Council held workshops to review the
appropriation requests for the fiscal year 1997-98 on July 31 and August 7, 1997, and;
WHEREAS, the Rancho Cucamonga City Council held a public hearing on the General
City Budget, and;
WHEREAS, this public hearing was published in a newspaper of general circulation and
held on August 14, 1997;
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga, California
does hereby resolve on this 14th day of August 1997 as follows:
SECTION 1: ADOPTION OF FISCAL YEAR 1997-98 BUDGET. The City of
Rancho Cucamonga budget for the fiscal year 1997-98, on file in the office of the Finance
Officer, is hereby adopted in the amount of $68,768,380. This budget total includes
appropriations for both the general and other special purpose funds.
SECTION 2: TRANSFERS OF FUNDS BETWEEN AND / OR WITHIN
APPROPRIATIONS. The City Council of the City of Rancho Cucamonga may transfer
funds between funds or activities set forth in the budget. The City Manager may transfer
funds between appropriations within any fund as set forth in the budget and may transfer
appropriations between activities within any cost center in the same fund.
SECTION 3: TRANSFERS OF FUNDS i~ETWEEN FUNDS. Transfers of funds
between funds as shown throughout the fund transfer sections of the budget shall be made
as expenditures warrant such transfers.
SECTION 4: DISBURSEMENTS. The City Manager and the Finance Officer, or the
duly designated representative, are hereby empowered and authorized to disburse funds
pursuant to appropriations provided for in the Fiscal Year 1997-98 Budget, and have the
responsibility to establish procedures and to administratively implement and control the
budget on all matters, except direct expenditures by Councilmembers which require
Council approval.

SECTION 5: ADDITIONAL APPROPRIATIONS. The City Council may amend this
temporary budget to add or delete appropriations.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA,
CALIFORNIA ESTABLISHING AN APPROPRIATIONS LIMIT PURSUANT TO ARTICLE
XIIIB OF THE CALIFORNIA STATE CONSTITUTION FOR FISCAL YEAR 1997-98
WHEREAS, Article XIIIB of the State of California provides that the total annual
appropriations subject to limitation of the State and of each local government shall not exceed
the appropriations limit of such entity of government for the prior year adjusted for changes in
the cost of living and population except as otherwise provided in said Article XIIIB, and;
WHEREAS, pursuant to said Article XIIIB of the Constitution of the State of California,
the City Council of the City of Rancho Cucamonga deems it to be in the best interests of the City
of Rancho Cucamonga to establish an appropriations limit for the Fiscal Year 1997-98, and;
WHEREAS,. the Finance Officer of the City of Rancho Cucamonga has determined that
said appropriations limit for the Fiscal Year 1997-98 be established in the amount of
$26,500,709.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby
resolve that an appropriation limit for the Fiscal Year 1997-98 pursuant to Article XIIIB of the
Constitution of the State of California be established in the amount of $26,500,709 and the same
is hereby established.
BE IT FURTHER RESOLVED that said appropriations limit herein established may be
changed as deemed necessary by resolution of the City Council.

Municipal Code Pertaining to Utility User's Fees
Recommendation:
Staff recommends City Council approval of utility user fee reduction.
Backl, round:
In May, 1995 a formula system was adopted to phase out the utility tax beginning in FY 96/97. The
proposed reductions were discussed in the most recent budget workshops and adopted by Council
in the FY 97/98 budget with provisions for specific fee reductions. Staff recommends the following
reductions: reduce the utility tax rate from 4.21% to 3.91% which represents a reduction of 7%.
Also the reduction of the cap is recommended from $30,000 to $28,400 or a reduction of 5.3% for
industrial/business users with high utility usage.

AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA,
AMENDING CHAPTER 3.48 OF THE RANCHO CUCAMONGA
MUNICIPAL CODE PERTAINING TO UTILITY USER'S FEES.
The City Council of the City of Rancho Cucamonga does ordain as follows:
Section 1: Section 3.48.035A of the Rancho Cucamonga Municipal Code is
hereby amended to read, in words and figures, as follows:
"A. The maximum aggregate amount of the fees imposed by this chapter
upon any one service user for utilities during any calendar year shall not exceed
Twenty Eight Thousand Four Hundred Dollars ($28,400)."
Section 2: Section 3.48.040 of the Rancho Cucamonga Municipal Code is hereby
amended to read, in words and figures, as follows:
"A. There is imposed a fee on the amounts paid for any intrastate
telephone services by every person in the city using such services. The fee
imposed by this section shall be at the rate of 3.91 percent of the charges made for
such services, and shall be paid by the person paying for such services."
Section 3: Section 3.48.050A of the Rancho Cucamonga Municipal Code
is hereby amended to read, in words and figures, as follows:
"A. There is imposed a fee upon every person using electrical energy in
the city. The fee imposed by this section shall be at the rate of 3.91 percent of the
charges made for such energy by an electrical corporation providing service in the
City and shall be paid by the person using the energy. The fee applicable to
electrical energy provided by a non-utility supplier shall be determined by
applying the fee rate to the equivalent charge the service user would have incurred
if the energy used had been provided by the electrical corporation franchised by
the city. Non-utility suppliers shall install and maintain an appropriate utility-type
metering system which will enable compliance with this section. 'Charges,' as
used in this section, means charges made for: (1) metered energy and (2)
minimum charges for service, including customer charges, service charges,
demand charges, standby charges, and all other annual and monthly charges, fuel
or other cost adjustments authorized by the California Public Utilities
Commission or the Federal Energy Regulatory Commission."
Section 4: Section 3.48.060A1 of the Rancho Cucamonga Municipal
Code is hereby amended to read, in words and figures, as follows:
"A.I. There is imposed a fee upon every person in the city, other than a
gas corporation or electrical corporation, using gas in the city which is transported
through mains or pipes or by mobile transport. The fee imposed by this section
shall be at the rate 3.91 percent of the charges made for the gas and shall be
paid by the person using the gas. The fee applicable to gas or gas transportation
provided by non-utility suppliers shall be determined by applying the fee rate to
the equivalent charges the service user would have incurred if the gas or gas
transportation had been provided by the gas corporation fi'anchised by the city."
Section 5: Section 3.48.070A of the Rancho Cucamonga Municipal Code
is hereby amended to read, in words and figures, as follows:
"A. There is imposed a fee upon every person in the city using water
which is delivered through mains or pipes. The fee imposed by this section shall
be at the rate of 3.91 percent of the charges made for such water and shall be paid
by the person paying for such water."
Section 6: Section 3.48.140 of the Rancho Cucamonga Municipal Code is
hereby amended to read, in words and figures, as follows:
"A. Whenever the calculation of the amount of any fee due and owing
under this chapter is alleged to have resulted in_ an overpayment or a payment
more than once, it may be refunded by the Finance Director as provided in
subsections (B) and (C) of this section, provided a claim in writing therefor, stating under
penalty of perjury the specific grounds upon which the claim is
founded, is filed with the Finance Director within one year of the date of the
claimed overpayment. The claim shall be on forms furnished by the Finance
Director."
"B. A service supplier may claim a refund or take as credit against fees
collected and remitted an amount overpaid or paid more than once when it is
established that the person from whom the fee has been collected did not owe the
fee."
"C. Any service user may obtain a refund of fees overpaid or paid more
than once by filing a claim in the manner provided in subsection (A) of this
section, but only when the service user having paid the fee to the service supplier
establishes to the satisfaction of the Finance Director that the service user has
been unable to obtain a refund from the service supplier who collected the fee."
"D. Notwithstanding other provisions of this section, whenever a service
supplier, pursuant to an order of the California Public Utilities Commission or a
court of competent jurisdiction, makes a refund to service users of charges for past
utility services, the fees paid pursuant to this chapter on the amount of such
refunded charges shall also be entitled to claim a credit for such refunded fees
against the amount of fee which is due upon the next monthly returns. In the
event this chapter is repealed, the amounts of any refundable fees will be borne by
the city."
Section 7: This ordinance shall be deemed effective on
Section 8: If any section, subsection, subdivision, paragraph, sentence, clause or
phrase of this Ordinance or any part thereof, is for any reason held to be unconstitutional or
preempted by subsequent legislation, such decision or legislation shall not effect the validity of the
remaining portions of this Ordinance or any part thereof. The City Council hereby declares that it
would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase
thereof, irrespective of the fact that any one or more sections, subsections, subdivisions,
paragraphs, sentences, clauses or phrases are declared unconstitutional or preempted.
Section 9: The City Clerk shall certify to the adoption of this Ordinance and shall
cause the same to be published in the manner prescribed by law.
