CONSIDERATION OF AIR QUALITY AGREEMENT WITH THE SAN MANUEL INDIANS C. COMMUNICATIONS FROM THE PUBLIC This is the time and place for the general public to address the City Council and Planning Commission. State law prohibits the Council and Commission from addressing any issue not previously included on the agenda. The Council and Commission may receive testimony and set the matter for a subsequent meeting. Comments are to be limited to five minutes per individual. D. Baker, Assistant to the Oi~ MariaOct DA~: July ~0, 200~ 8U~EGT: AOREEMENT WITH SAN MANUEL BAND OF MIggION INDIAN8 FOR SIGNAL COORDINATION 6gNT RECOMMENDATION It is recommended that the City Council approve the attached agreement with the San Manuel Band of Mission Indians granting the City $100,000 for traffic signal coordination. BACKGROUND The San Manuel Band of Mission Indians has developed atribal Air Quality Plan. Part of this plan recognizes the importance of cooperation with surrounding government agencies to affect improved air quality. To this end the Tribe has granted funds to various cities in the regionfor use on traffic signal coordination and other projects to help improve air quality. Rancho Cucamonga will receive $100,000 from the Tribe for traffic signal coordination purposes. The projects to be selected are at the City's solediscretion. Prior to expending any of these funds, the City Engineer will prepare a list of projects and forward that list to the Tribe. Once the Tribe has accepted this list, the City Engineer will proceed with the work. After the projects are completed, the City will provide the Tribe a letter accounting for the expenditure of these funds. This agreement is an example of regional cooperation on a mutual goal. Improved air quality is a regional issue. The use of this grant on signal coordination projects in Rancho Cucamonga will directly benefit our residents and help improve air quality for the region. Towards that end, staff recommends approval of this agreement. Respectfully submitted, Assistant to the City Manager AIR QUALITY CONTROL AGREEMENT This Agreement is made and entered into at the San Manuel Indian Reservation, California, by and between the San Manuel Band of Mission Indians, a federally recognized Indian tribe having an address at 26524 Indian Service Read, Highland, California ("Tribe") and the City of Rancho Cucamonga, having an address at 10500 Civic Center Drive, Rancho Cucamonga, California 91730, ("City"), effective as of July 1, 2001. RECITALS WHEREAS, Tribe is a federally recognized Indian tribe with lands near the boundaries of City over which it exercises governmental jurisdiction ("Tribal land"); and WHEREAS, the Tribe's General Council has determined that it is in the best interest of the tribal government, for the purpose of assisting in funding certain · operations of local government agencies, as well as furthering the Tribe's development of a tribal Air Quality Plan under its General Assistance Plan, that the Tribe enter into this Agreement; and WHEREAS, it is the intent of the parties that to further government to government cooperation on issues of mutual concern, in this instance air quality improvement, Tribe shah fund certain city agency operations, on the terma and conditions contained herein_ NOW, THEREFORE, IT IS AGREED AS FOLLOWS: 1. Tribe shall provide[ One Hundred Thousand Dollars ($100,000.00) to assist City in ~rling the traffic signal coordination efforts of the applicable Ci~agsncy "Air Quality Fund/in an effort to reduce smog congestion and i~nprove the quality of air in the San Bernardlno Valley. 2. City agrees to use the Air Quality Funds at its discretion within twelve (12) months of receipt of said funds ("Project Period") for the sole purpose of implementing traffic coordination efforts intended to reduce smog congestion in the surrounding community. 3. City agrees to provide to Tribe within One Hundred Twenty (120) days of the conclusion of the Project Period a detailed written accounting of the expenditure of the Air Quality Funds. City may seek an approval of an extension of time to perform under this Agreement upon a showing of good cause, which approval from Tribe shall not be unreasonably withheld. 4. Tribe shall use its best efforts to disburse Air Quality Funds to City within thirty (30) days of execution of this Agreement. 5. This Agreement shall become effective as of the date set forth above and continue in effect for a term of 18 months, unless extended by written mutual agreement of the parties. 6. The City agrees to indemnify, defend and hold harmless Tribe and its officers, employees, agents, and members, from any and all claims, actions, losses, damages or liability arising out of the City's performance or other obligations under this Agreement. 7. Any and all notices required or otherwise provided for under this Agreement shall be served by certified mail, return receipt requested, or by overnight mail delivery for which a signature is required and shall be addressed as follows: A.
