A RESOLUTION OF THE C±'lY COL~ci~ OF THE clTf OF RANCHO
CUCAMONGA, CALIFORNIA, ORDerING CERTAIN CMANGES AND
~DDIFICATIONS IN THE WORK, IN A SPEC/AL ASSESSM~I~T DImA~ICT
WHEREAS, the City Council of the city of Rancho Cuca~onga, California,
has adop~d_ a Resolution pursuant to the provisions of Chapter 4.5 of Division
12 of the Streets and Highways COde of the State of California, and specifically
Section 10353, (the '%~unicipal Impr~t Act of 1913"), declaring its
intention to order certain changes and modifications in the proceedings and the
works of improvement, and did, pursuant to law, set forth a time and place for
a public hearing on said proposed changes and modifications in a special
assessment district known and designated as ASSESS~T DI~r~ICT NO. 84-2 (ALTA
~ gi~RM DRAIN) (hereJ_nafter referred to as the "Assessment District"); and,
WHEREAS, at t-his time notice of the public hearing on the proposed
changes and modifications has been given in the manner and form as required by
law; and,
WHEREAS, this legislative body has heard the presentation and
~timony as it relates to the proposed changes and modifications, and this
legislative body is n~g ready to proceed~ _ to take action on said proposed changes
and modifications.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does
hereby resolve as follows:
SECTION 1: ~nat the above recitals are all true and correct.
SECTION 2: ~nat this legislative body hereby orders those changes and
modifications as set forth in a Resolution of Intention to order said changes
and modifications, said changes generally described as follows:
~ne construction and installation of additional storm drain
facilities and ap~ to serve all properties within
the boundaries of this Assessment District.
SECTION 3: ~nat the above referenced changes and modifications, as
ordered, do not cause any increase in any assessments as previously levied for
this Assessment District.
SECTION 4: ~nat the decisions and determinations of this legislative
body ordering the above-referenced changes and modifications shall be final and
conclusive upon all persons entitled to appeal thereon.
SECTION 5: That the Engineer's "Report", the Assessm~_nt Roll, and all
relat~d_ documentation, as herein modified, are for the best interest of th~
property owners within the Assessment District, and said modified "Report" shall
stand as the Engineer's "Report" for all subsequent proceedings relating to this
Assessment District.
