HomeMy WebLinkAbout88-700 - Resolutions RESOLUTION NO. 88-700 A RESOLUTION OF THE c±','f GOUNCIL OF THE CiTY OF RANCHO A. Recitals. (i) ~ne city Council of the City of Rancho Cucamonga adopted the General Plan and certified the Enviror~ental Impact Re~ort for the General Plan on April 6, 1981 by the approval of Resolution No. 81-040. (ii) ~nere has been presented to this Council in conjunction with this Council's consideration of the adoption of the General Plan Technical Update, a final Master f~vironmental Assessment and Environmental I~pact Report with a Planning c~Lutdssion reoa~m~ndation to certify the environmental findings. (iii) On September 28, 1988, the Planning O~m,dssion of the city of Rancho Cucamonga conducted duly noticed public hearings on a General Plan Report prepared for the General Plan Technical Update. (iv) ~ne final Master f~vironmental Assessment and Environmental Impact Repc~t referred to in this Resolution consists of that draft document dated July, 1988 entitled "City of Rancho Cucamorga Master Envirorm~ntal Assessment and General Plan Environmental Impact Report", written cu,u~nts on that draft report and written responses thereto sukmitted by the staff of the city of Rancho Cucamonga and testimony presented_ during the hearings on the rec~,m~-nded adoption of said General Plan Technical Update insofar that the mentioned documents will be referred to as "the final MEA/~u/~". ~ne entirety of the final MEA/~u{ hereby is incorporated in this Resolution by this reference. (v) All legal prerequisites prior to the adoption of this Resolution B. Resolution. NOW, THEREFORE, the city Council of the City of Rancho Cucamonga does hereby find, determ/ne and resolve as follows: 1. The City Council of the City of P~ncho Cucamonga does take the following actions with respect to the final MEA/.:, -: (a) Certifies that the final MEA/~u~ has been prepared on the General Plan Technical Update in accordance with the provisions of the California f~vironmental Quality Act, California Public Resolution No. 88-700 Page 2 Resources Code Sections 21000 et seq. and in accordance with the regulations promulgated thereunder. Further, that the O~uncil certifies that it considered the contents of t_he final MEA/~u~ in considering the adoption of the General Plan Technical Update: (b) Finds that the General Plan Tecb_nical Update project is the preparation, review, and adoption of t~cal amerzlments to the General Plan consisting of the update of statistical information and impl~uentation measures, inclusion of provisions of the Surfaoe Mining and Reclamation Act of 1975, and revisions to the CcaL.L~dlity design section of the Land Use and Development Element. (c) Finds that the final MEA/~ does identify physical environmental impacts inherent in the project and t_hat changes or alterations have been incorporae~ in the project which mitigate er avoid all significant enviromuental effects thereof other than a cumulative contribution to the de~dation of air quality; (d) Finds that notwithstanding the unmitigae~ adverse environmental impacts specified in para~z~ph b above, that specific economic and social considerations make unfeasible any project alternative specified in the final MEA/p:,~ and constitutes an overriding basis for Council approval of th~ project; and (e) As to those impacts identified in the final MEA/~II{ which cannot f~a~ibly be avoided by mitigation measures and project alternatives, adopts a statement of overriding considerations in substantial form to that set forth in Exhibit "A" hereto and incorporat~_ by this reference. Authelet, City Clerk Resolution No. 88-700 Page 4 EXHIBIT "A" ~ OF ~ING CONSIDERATIONS ~ne final Master ~viror~ental Assessment and General Plan f~viror~ental Assessment identifies certain impacts which cannot f~ibly be avoided by mitigation measures. Tnose impacts consist of a cumulative contribution to the degradation of air quality as a result of ~ population, c~Lm~-cial and industrial growth. Notwithstanding these impacts, the project was approved based upon the finding that specific economic and social considerations make infeasible any uroject alternatives specified in the final Master Environmental Assessment and Environmental Impact Report and, accordingly constitutes an overriding basis for project approval. Those considerations are that the General Plan Technical Update is itself a measure to mitigate potential adverse impacts of development on the existing c~L~,unity which would otherwise occur without a planned and c~:~rehensive approach to future development. The General Plan Technical Update includes ~rrent statistical information on the Oam~nity and reflects changes in development policies as well as established policies incorporated in the General Plan at its adoption in 1981. The General Plan provides appropriate guidance for the establishment of zoning and development regulations to mitigate growth induced impacts. Oonsequently, tb~ adoption of the General Plan Technical Update will result in potential environmental effects that are substantially less significant in scope than would occur without General Plan guidance, including each alternative analyzed in the Final Master f~viror~ental Assessment and ~virorm~ntal I~pact R~port.
