HomeMy WebLinkAbout99-074 - Resolutions RESOLUTION NO. 99-074 A RESOLUTION OF THE RANCHO CUCAMONGA CITY COUNCIL APPROVING A DISPOSITION AND DEVELOPMENT AGREEMENT BETWEEN THE RANCHO CUCAMONGA REDEVELOPMENT AGENCY AND LAMCO HOUSING, INC., A CALIFORNIA CORPORATION WHEREAS, in order to effectuate the provisions of the Redevelopment Plan for the Rancho Redevelopment Project Area (the "Project Area"), the Rancho Cucamonga Redevelopment Agency ("Agency") proposes to enter into a Disposition and Development Agreement ("DDA") with Lamco Housing, Inc., a California Corporation ("Developer"); and WHEREAS, pursuant to the DDA, the Agency will convey to the Developer fee simple title to that certain property located in the Project Area (the "Site"), described in Attachment No. 1 ("Legal Description") and depicted on the map on Attachment No. 2 ("Site Map") to the DDA; and WHEREAS, Developer proposes to develop the Site with approximately 95 first class single family detached units as depicted on Attachment No. 3 ("Scope of Development") to the DDA, pursuant to the terms and conditions set forth in the DDA; and WHEREAS, Section 33433 of the California Health and Safety Code requires that the DDA be approved by the Agency and this City Council, that certain findings be made, and that a Summary Report and a copy of the DDA be made available for public inspection; and WHEREAS, the Summary Report and a copy of the DDA with attachments, and other related exhibits, has been made available for public inspection in the manner required by Section 33433; and WHEREAS, notice of this public hearing has been given in the manner required by law; NOW, THEREFORE, based on the evidence presented to the Council, including the written staff report and oral testimony on this matter, and the Summa~ Report prepared pursuant to Section 33433 of the California Health and Safety Code, the City Council of the City of Rancho Cucamonga does hereby find, determine and resolve as follows: 1. The development of Site is consistent with the Rancho Cucamonga General Plan and the Rancho Cucamonga Redevelopment Plan. 2. The sale of the Site is consistent with the Implementation Plan adopted pursuant to Health and Safety Code Section 33490. 3. The proposed development is the highest and best use of the Site in accordance with the Redevelopment Plan. 4. The consideration to be received by the Agency for the conveyance of the Site is higher than the fair reuse value, at the use and with the covenants, conditions and development costs authorized by the DDA. Resolution No. 99-074 Page 2 of 2 5. The sale and development of the Site will assist in the elimination of blight in the Project Area. The new homes will be developed on property that was previously occupied by blighted structures and uses. 6. The sale and d.evelopment of the Site is necessary to insure the successful development of the property to its highest and best use. RESOLVED FURTHER, that the City Council does hereby approve the Disposition and Development Agreement between the Rancho Cucamonga Redevelopment Agency and Lamco Housing, Inc. RESOLVED FURTHER, that a copy of this resolution shall be filed with the Secretary of the Rancho Cueamonga Redevelopment Agency. PASSED, APPROVED, AND ADOPTED this 7th day of April 1999.
