AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, APPROVING A DEVELOPMENT AGREEMENT
BETWEEN THE CITY OF RANCHO CUCAMONGA AND TAC DEVELOPMENT
CORPORATION
The City Council of the City of Rancho Cucamonga, California, does
ordain as follows:
SECTION 1: The City Council finds and determines as follows:
A. Government Code Section 65864 through 65869.5 authorizes the
City to enter into binding Development Agreements with persons having legal or
equitable interests in real property for the development of such property.
B. Three copies of the proposed Development Agreement between the
City and TAC Development Corporation are on file in the office of the City
Clerk, and the same are public records of the City.
C. The proposed Development Agreement pertain to real property
situated in the City and described as follows:
A portion of the east 1/2 of Lot 12, Block 11, Cucamonga
Homestead Association, as per plat recorded in Book 6 of
Maps, page 46, records of said County, described as
follows:
Commencing at a point 275 feet west and 330 feet north of
the southeast corner of said lot, thence north 66 feet;
thence east parallel with the south line of said lot, 275
feet to the east line of said lot; thence north along the
east line of said lot to the north line of said lot;
thence west along the north line of said lot to the west
line of the east 1/2 of said lot; thence south along the
west line of said east 1/2 of lot 12 to a point 330 feet
north of the south line of said lot; thence east parallel
with the south line of said lot to the point of
beginning.
D. The City Council has held a public hearing on the proosed
Development Agreement and notice of that public hearing has been given for the
time and in the manner prescribed by Government Code Section 65867.
E. The provisions of the proposed Development Agreement are
consistent with the General Plan, and there is no specific plan effecting the
property subject to the proposed Development Agreement.
SECTION 2: The proposed Development Agreement between the City and
TAC Development Corporation, referred to in Section 1 above, is hereby
approved. On the effective date of this Ordinance the Mayor shall sign as
many copies of said Development Agreement as are necessary for the use of the
parties, the City Clerk shall attest to the same and shall deliver one fully
signed copy to TAC Development Corporation.
SECTION 3: A Negative Declaration is hereby adopted for these
General Plan amendments, based upon the completion and findings of the Initial
Study.
SECTION 4: The Mayor shall sign this Ordinance and the City Clerk
shall cause the same to be published within fifteen (15) days after its
passage at least once in The Deily Report, a newspaper of general circulation
published in the City of Ontario, California, and circulated in the City of
Rancho Cucamonga, California.
