HomeMy WebLinkAbout219 - Ordinances NOT APPROVED ORDINANCE NO. 219 AN ORDINANCE OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, ESTABLISHING AN ALTA LOMA SPECIAL STUDY AREA, IMPOSING A MORATORIUM ON THE FILLING OF CERTAIN SUBDIVISION MAPS AND DEVELOPMENT APPLICATIONS FOR PROPERTIES WITHIN THE MEDIUM RESIDENTIAL DISTRICT (M) AND THE MEDIUM-HIGH RESIDENTIAL DISTRICT (MI{) IN THE ALTA LOMA SPECIAL STUDY AREA FOR A PERIOD OF SIXTY (60) DAYS, AND DECLARING THE URGENCY THEREOF The City Council of the City of Rancho Cucamonga, California, does ordain as follows: SECTION 1: The City Council finds and determines that there is serious public concern that development to their full potential in density of those areas within the Alta Loma Special Study Area, described below, which are presently designated Medium Residential District (M) or Medium-High Residential District (MH) could have severe environmental effects including, but not limited to, flooding impaction, circulation impaction and school impaction. SECTION 2: Because of this public concern the City Council finds and determines that a special study should be conducted with respect to the area described below to see whether those adverse environmental impacts which are perceived do in fact exist, and that a period of sixty (60) days is a reasonable time to complete such a study. SECTION 3: The area bounded by Haven Avenue on the East, 19th Street on the South, Sapphire Street on the West, and the proposed Foothill Freeway (Route 30) corridor on the North, together with those parcels fronting on the South side of 19th Street between Haven Avenue and Sapphire Street, are hereby designated as the Alta Loma Special Study Area. SECTION 4: For a period of sixty (60) days after the effective date of this Ordinance, no tentative or parcel maps and no applications for a General Plan amendment, a Specific Plan, a change of base district, or a development design review shall be accepted for filing and processing with respect to any property in the Medium Residential District (M) or the Medium-High Residential District (MI{) within the Alta Loma Special Study Area. SECTION 5: Section 3 of this Ordinance shall not apply to any property situated or proposed to be situated in the Senior Housing Overlay District. SECTION 6: Nothing in this Ordinance shall effect the further processing of a tentative or parcel map or a development application, of the type described in Section 3 above, if said map or application was accepted for filing prior to the effective date of this Ordinance. SECTION 7: The City Council finds and determines that th )rdinance is necessary for the immediate preservation of the public peace, i~ealth and safety, and it shall take effect immediately upon its adoption. SECTION 8: The Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published within fifteen (15) days after its passage at least once in The Daily Report, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
