HomeMy WebLinkAbout02-213 - Resolutions RESOLUTION NO. 02-213 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, FORMING UTILITY UNDERGROUND DISTRICT NO. 2002-01 ALONG BASE LINE ROAD FROM THE CENTERLINE INTERSECTION OF VALENCIA AVENUE LOCATED WEST OF DEER CREEK CHANNEL EAST TO THE CENTERLINE INTERSECTION OF MILLIKEN AVENUE, USING RULE 20-A FUNDS WHEREAS, A PUBLIC HEARING was held on July 3, 2002 at the hour of 7:00 P.M. at the City Hall Council Chambers, 10500 Civic Center Drive, Rancho Cucamonga, California to determine whether the public necessity, health, safety or welfare requires the formation of an underground district along Base Line Road from the centerline intersection of Valencia Avenue located west of Deer Creek Channel east to the centerline intersection of Milliken Avenue in the City of Rancho Cucamonga, California; and WHEREAS, A NOTICE of such hearing has been given to all effected property owners as shown on the last equalized assessment roll and to all utilities concerned in the manner and for the time required by law; and WHEREAS, SUCH HEARING has been duly and regularly held and all persons interested have been given an opportunity to be heard. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rancho Cucamonga, California as follows: SECTION 1: It is hereby found and determined pursuant to Rancho Cucamonga Municipal Code Section 13.04 and the definitions contained herein that the public necessity, health, safety or welfare requires the formation of an underground utility district along Base Line Road from the centerline intersection of Valencia Avenue located west of Deer Creek Channel east to the centerline intersection of Milliken Avenue in order to remove excessive overhead utility wires and associated structures, and to underground utilities along said portion of Base Line Road. Base Line Road is a public street that is extensively used by the general public and carries heavy volumes of vehicular traffic. SECTION 2: An underground utility district to be known as Underground Utility District No. 2002-01, is hereby established in that area along Base Line Road in the City of Rancho Cucamonga, California, shown upon that certain map entitled "Underground Utility District No. 2002-01", which is on file in the office of the City Clerk of the City of Rancho Cucamonga, California, more particularly described as follows: The north half of Base Line Road, being 60 feet in width, from the centerline intersection of Valencia Avenue located west of Deer Creek Channel to the centerline intersection of Milliken Avenue, approximately 4300 feet in length. Resolution No. 02-213 Page 2 of 3 SECTION 3: The 12k,i electrical wires and associated overhead structures shall be removed from the existing underground improvements at Valencia Avenue to the 1" pole east of Milliken Avenue. SECTION 4: The 66kv electrical wires shall be removed from the 151 pole east of Deer Creek Channel to the 1" pole east of Milliken Avenue. SECTION 5: Underground installation by the utility companies shall be accomplished no later than July 31, 2004. SECTION 6: The City Clerk is hereby directed to mail a copy hereof and a copy of Municipal Code Section 13.04 to all affected property owners as shown on the last equalized assessment roll and to all affected utilities within ten days after adoption of this resolution.
