HomeMy WebLinkAbout02-246 - Resolutions - (Continued) ITEM CONTINUED TO FUTURE MEETING RESOLUTION NO. 02-246 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA SUPPORTING AND AUTHORIZING THE CITY OF UPLAND AS LEAD AGENCY FOR AN APPLICATION TO THE LOCAL AGENCY FORMATION COMMISSION FOR A SPHERE OF INFLUENCE AMENDMENT AND THE REORGANIZATION OF TERRITORY TO SAID CITY AS MORE SPECIFICALLY DESCRIBED BELOW WHEREAS, the City Council of the City of Upland desires to initiate proceedings pursuant to the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000 (commencing with Section 56,000 et seq. of the California Government Code)for: 1. Sphere of Influence amendments for the City of Upland (expansion) and the City of Rancho Cucamonga (reduction). 2. An annexation to the City of Upland and detachment from the City of Rancho Cucamonga. WHEREAS, the adjustment to the boundary between the two Cities includes an approximately 2.5 acre area generally bounded by the existing boundary of the City of Rancho Cucamonga on the west, 20th Street on the north, the westerly edge of the service road on the west side of the Cucamonga Creek Channel, and by 19th Street on the south; and WHEREAS, the proposed boundary adjustment, including both public and private property, to be included in this application to the Local Agency Formation Commission of the County of San Bernardino (LAFCO), is uninhabited and a map of the boundaries of the territory is set forth in Exhibit "A" (dated April 4, 2001) attached hereto and by this reference incorporated herein; and WHEREAS, the proposed reorganization will not conflict with any Sphere of Influence and the proposed change includes amendments to the Spheres of Influence for the Cities of Upland and Rancho Cucamonga; and WHEREAS, it is desired that the proposed reorganization be subject to the following terms and conditions: 1. Both the City Councils of the City of Upland and the City of Rancho Cucamonga must approve of the proposed Sphere of Influence and Annexation/Detachment application and final decision of LAFCO. 2. The City of Upland shall process an amendment to its General Plan and pre- zone the territory, respectively. The amendment and pre-zone shall be completed within 60 days of an application being submitted to LAFCO. 3. The City of Upland shall be solely responsible for all filing and processing fees. The City of Upland shall be responsible for providing all exhibits that may be necessary by LAFCO to complete the application, providing that such exhibits shall be first reviewed and approved by the City of Rancho Cucamonga. 5. The City Councils of the City of Upland and the City of Rancho Cucamonga shall both accept all standard conditions as required by LAFCO. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby resolve, determine, and order as follows: SECTION 1: The City Council hereby approves the filing of the appropriate application to the Local Agency Formation Commission of the County of San Bernardino to adjust the boundary between the City of Upland and the City of Rancho Cucamonga, pursuant to Government Code Section 56000 et. seq., the Cortese-Knox- Hertzberg Local Reorganization Act of 2000, and the procedures of the Local Agency Formation Commission of the County of San Bernardino, for a Sphere of Influence amendment and detachment of territory for that portion of the City described on Exhibit "A" to this Resolution, and authorizes the City of Upland as lead agency for said application. SECTION 2: The City Clerk shall certify as to the adoption of this Resolution.
