HomeMy WebLinkAbout36 - Ordinances ORDINANCE NO. 36 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, ESTABLISHING A MORATORIUM BASED UPON SUB-DIVISIONS, LAND DIVISION, ZONE CHANGES, PARCEL MAPS, TRACT MAPS AND BUILDING PERMITS, ~ND DECLARING THE URGENCY THEREOF. The City Council of the City of Rancho Cucamonga, California, does ordain as follows: SECTION 1: Whereas, the City Council hereby finds that prior to, and since, incorporation on November 22, 1977, the City has ex- perienced rapid residential growth which has placed, and is placing, pressure upon various public services, including, but not limited to, sewage treatment, traffic circulation and schools; SECTION 2: And, whereas, the City, by reason of the lack of adequate personnel, and by reason of the lack of finances to hire addi- tional personnel, is unable to adequately process the current backlog of pending residential development; SECTION 3: And, whereas, further, the City is now developing its initial General Plan. SECTION 4: The City Council further finds that it is in the best interest of the City in order to protect the health, safety and general welfare of the citizens of the City to restrict the filing and processing of applications for sub-divisions, land divisions, zone changes, building permits, parcel maps or tract maps. SECTION 5: Therefore, the City shall not accept for filing any application for a residential sub-division, residential land division or residential zone change except as provided in the following Section 7. SECTION 6: The City shall not issue residential building permits nor further process or approve any parcel map or tract map except as provided in the following Paragraph 7. SECTION 7: The following shall be exempt from the provisions of this Ordinance: (a) Any residential sub-division, residential land division or residential zone change in connection with any tract or parcel map approved by the City Council as part of the voluntary growth restriction at its meeting of Februarv 1, 1978. (b) Any building permit for an addition ~o or improve- ment of an existing residential dwelling. (c) A residential sub-division, residential land division, parcel map or building permit where only one new residential dwelling can result. This exemption shall be on a one-time basis only. This exemption shall be subject to the approval of the Community Develop- ment Director prior to the issuance of any building permit. SECTION 8: This moratorium shall expire on December 31, 1978. SECTION 9: The City Council hereby declares that it would have adopted this Ordinance and each section, sub-section, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, sub-sections, clauses, phrases, or portions thereof be declared invalid or unconstitutional. If for any reason any portion of this Ordinance shall be declared invalid or unconstitutional, then all other provisions thereof shall remain valid and enforceable. Ordinance No. 36 Page 2 SECTION 10: This Ordinance is hereby declared an urgency measure necessary for the immediate protection and preservation of the public peace, health, safety, and welfare for the reasons stated in Sections 1, 2 and 3 hereof and shall take effect immediately upon its adoption.
