State law prohibits the Council form addressing any issue not previously included on the agenda. The Council may receive testimony and set the matter for a subsequent meeting. Approval of a Resolution to adopt a Memorandum of Understanding (CO 03- 051) for all City employee groups. RESOLUTION NO. 03-166 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, AUTHORIZING ENTRY INTO MEMORANDA OF UNDERSTANDING WITH THE CITY'S GENERAL EMPLOYEE, MAINTENANCE EMPLOYEE, AND THE SUPERVISORY/PROFESSIONAL EMPLOYEE MEET AND CONFER GROUPS FOR FISCAL YEAR 2003~2004 D. Temple, Administrative Services Director SUBJECT: Approval of Resolution No. To Adopt a Memorandum of Understanding for all City Employee Groups Recommendation: It is recommended that the City Council adopt Resolution No. which will enact a Memorandum of Understanding for all City employee bargaining groups for a one- year contract effective July 1, 2003 through June 30, 2004. Background: Staff and the City's three employee bargaining groups - General, Maintenance and Supervisory/Professional - have met and conferred and negotiated a one-year labor contract. The attached Memorandum of Understanding have been executed by the representatives of the employee bargaining groups and are provided here for enactment under the Resolution. Respectfully submitted, Lawrence Administrative Services Director Attachment RESOLUTION NO. 03- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA AUTHORIZING ENTRY INTO MEMORANDA OF UNDERSTANDING WITH THE CITY'S GENERAL EMPLOYEES, MAINTENANCE EMPLOYEES, AND THE SUPERVISORY/PROFESSIONAL EMPLOYEES, MEET AND CONFER GROUPS FOR FISCAL YEAR 200312004. WHEREAS, the City of Rancho Cucamonga ( the "City" ) has met and conferred with the three bargaining groups, namely, the General Employees, Maintenance Employees, and the Supervisory/Professional Employees Meet and Confer Group, over wages, hours and working conditions; and WHEREAS, the City has reached agreement with the three above mentioned meet and confer groups; and WHEREAS, Memorandum of Understanding for Fiscal Year 2003~2004 outlining the agreement between the City and each of the three meet and confer groups are attached hereto and incorporated herein by reference to this Resolution; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Rancho Cucamonga does hereby approve entry into Memorandum of Understanding for Fiscal Year 2003~2004 with the City's three meet and confer groups, General Employees, Maintenance Employees, and Supervisory/Professional Employees. Adams, CMC,'City Clerk Resolution 03- Page 3 of 4 MEMORANDUM OF UNDERSTANDING WHEREAS, representatives of the City of Rancho Cucamonga ("the City") have met and conferred with representatives of the General Employees, Maintenance Employees, and Supervisory/Professional Employees ("Bargaining Groups") regarding wages, hours and other terms and conditions of employment, and; WHEREAS, the City and the Bargaining Groups have reached agreement on items within the scope of Meet and Confer, and; WHEREAS, the City and the Bargaining Groups wish to enter into a Memorandum of Understanding regarding the agreements of the Meet and Confer process; NOW, THEREFORE, the Bargaining Group representing the General Employees, Maintenance Employees and Supervisory/Professional employees and the City of Rancho Cucamonga do hereby agree as follows: 1. Term of Contract The term of this agreement is July 1, 2003, through June 30, 2004. 2. Cost of Living Adiustment During the term of this MOU, there shall be no cost of living adjustment (COLA). 3. La,yoffs During the term of this MOU, there shall be no layoffs of any full-time employees covered by this contract. 4. Medical Insurance The City shall provide fully paid employee and family health insurance for all existing full-time continuous salaried employees within the bargaining groups, subject to the limitation that no such monthly funding by the City shall exceed $795.60 per month. Said limitation shall become effective July 1, 2003. Effective July 1, 2003, the City shall fund a maximum amount of $500.00 per month for medical premium contributions on behalf of all full-time continuous employees within the bargaining groups who have been hired on or after July 1, 1994. Ever teen A reement Except as specifically modified in this Memorandum of Understanding, all terms and conditions of employment currently in effect as of the time of adoption of this MOU, shall remain in effect through the term of this contract. 6. Negotiations of Successor MOU The parties agree that negotiation of a successor to this MOU shall commence not later than six (6) months prior to the MOU expiration date. It is further agreed that in order to facilitate the parties' goal of expeditiously completing the meet and confer process on or before June 30, 2004, the parties shall exchange written meet and confer proposals not later than December 1, 2003· Signed this 5m day of June 2003.
