(ii) On December 17, 1991, the Planning C~mu.d~sion conducted a duly noticed public hearing to reoeive written and oral testimony on the proposed Application. Said public hearing was continued to January 8, 1992. (iii) On January 8, 1992, the Planning C~m~/ssion received additional public testimony on said Application and continued said Application for an indefinite time period. (iv) On April 8, 1992, the Planning ~ion of the City of Rancho O~m~3a conducted a duly noticed public hearin~ on the Application and, following the ~lusion of said public hearing, ~ Resolution No. 92-62 there~ oonditiom~] ly ~ing said Application. (v) ~he decision re~ by said Planning (l~mdssion Resolution was t~ly appealed to this c~=~il. B. Resolution. NC~, ~REFORE, the City Council of the City of Rancho Cucamonga does hereby find, determine and resolve as folly: 1. ~ Oouncil hereby specifically fir~s that all of the facts set forth in the Recitals, Part "A," of this Resolution are true and correct. 2. ~ Council hereby finds and certifies that the project has Quality Act of 1970, and concurs with the issuance of the Negative Declaration issued on April 8, 1992. the abov~-ref~ May 20, 1992 hearing, ~cludir~ wri~ staff reports, the minutes of the above-ref~ Planning C~m~aission ~ting, and the contents of Planning (lamaission Resolution No. 92-62, this ~il hereby specifically finds as follows: Resolutic~ No. 92-169 p~2 (a) ~he applicatic~ applies to property located at the south- west corner of Base T,~ne Road ar~ Ruchester Avenue with a street frc~ of 250 feet along Base L/ne Road and 174 feet along t~m~%ester Averse. The parcel (b) ~ px~pexty to the north and east are zoned for and being developed with si. gle-family reside~es. ~ p~rty to ~e sash and west are zoned for multi-family units and are vacant; and (¢) The Application creates a single parcel of 1.31 acres; and (d) ~he rec/uir~s of Plannin~ C~.,,~-~ion Resolution Number 92--62, ~ to be important and necessary to the develc~ent of the property, excegt for the following modifications: (1) Engineering COndition Number 2 shall be rev/seal to re~e the construction of Rod%ester Avenue full width from Base T,{~e Road to T~-~-~ood Avenue with a transition as c~X~rmi~ed by the City ~ineer; and (2) t~gineering Condition Number 5 shall be deleted; and (3) A condition shall be added as Eng~in~ Oonditio~ Number 9 that the developer enter into an a~ and po~t securities to with the Terra Vista Implementation Policies within 2 years of oocupancy of the proposed develo~ or prior to the construction of the traffic signal at the intersection of I%0chester Avenue and Churc~ Street, whichever occurs first. (e) The develo~nt as s~ecified will not contradict the go~s or objectives of the General Plan or the Terra vista ~ty Plan am~ wou]d immediate vicinity of the subject site. during the above-ref~ public hearing, including written and o~=1 staff reports, this Council hereby finds ar~ concludes as follows: (a) The application is cc~istent with the General Plan and Terra Vista C~unity Plan of the City of Rancho ~; and (b) ~he design or i.~uv=ments of The Application is o0~sistent with the General Plan and the Terra Vista (k~,.,-~%ity Plan of the City of Rand%o (c) The px~posed project is not likely to cause substantial e~aH_~xm~fcal damage or avoidable injury to humans or wildlife or their habitat; and (d) The proposed project is not likely to cause serious health (e) The propoeed project is not likely to cause serious health problems. Based upon the findings and conclusions set forth in par-~3ra~hs 1, 2, 3 ~ 4 above, this Oouncil hereby apuroves the Tentative Parcel Map subject to all of the CU~z~itic~ set fc~ch in Planning (k~,td~sic~ Resolution No. 92-62 (a copy of which is attached hereto ar~ mark~d_ as Emhibit "A") with the specific e~ic~s as follows: (a) ~ineering C~ti~ ~ 2 to ~re~_~__: A~,~e necessary right of way and construct Rocb~ Avenue full width frc~ Base L{ne Road to Ironwood Street includ/ng a transitic~ of the public i~ as (b) Engin~ring C=Uition Numar 5 ~all be delete; and (c) A oo~d~tic~ shall be added as Number 9 and shall r~__d as follow~: An agreement with apuro~riate securities shall be executed to the satisfactic~ of the City Engineer and City Attorney, constructi~ of street anU storm drain improvements in accordance with the Terra vista O~m,~nity Impl~_ntation Policies within 2 years of occupancy of the proposed develo~ ~r prior to the construction of the traffic signals at the intexsection of Rochester Avenue and Church 6. ~ Council hereby provides notice to Lewis Development COmpany that the t/me within which judicial review of the decision re~ by this Resolutic~ ~ be sought is governed by the provisions of California Code of civil Procedure Sectic~ 1094.6. 7. The City Clerk of the City of Rancho Cucamonga is hereby d i~T~d to: (a) certify to the adoption of th/s Resolution; and (b) forthwith transmit a certified copy of th/s Resolution, by 8. ~he City Clerk shall certify to the adoption of this Resolution. CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING TENTATIVE PARCEL MAP NUMBER 13987, LOCATED AT THE SOUTh"WEST CORNER OF BASE LINE ROAD AND ROCHESTER AVENUE, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 227-151-17 WHEREAS, Tentative Parcel Map Number 13987, submitted by Lewis Development Company, applicant, for the purpose of subdividing into 1 parcel, the real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California, identified as APN(s) 227-151-17, located at the southwest corner of Base Line Road and Rochester Avenue; and WHEREAS, on December 11, and continued to December 17, 1991, January 8, 1992, and April 8, 1992, the Planning Commission held duly advertised public hearings for the a~ove-described map. NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVES AS FOLLOWS= SECTION %: That the following findings have been made: 1. That the map is consistent with the General Plan. 2. That the improvement of the proposed subdivision is consistent with the General Plan. 3.That the site is physically suitable for the proposed development. 4. That the proposed subdivision and improvements will not cause substantial environmental damage or public health problems or have adverse effects on abutting proper=les. SECTION ~ This Comission finds and cs~ifies ~hat the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970; and further, this Comission hereby issues a Negative Declaration. ~~__~ Tentative Parcel Map Number 13987 is hereby approved subject to the a~tached Standard Conditions and the following Special Conditions~ 1. Overhead Utilities a. Base Line Road - An in-lieu fee as a contribution to the previously undergrounded utilities (electrical and telecommunication) on the opposite side of Bale Line shall be paid to EXHIBIT "A" Resolution No. 92-169 Page6 · the city prior to issuance of building permits or final map approval, whichever occurs first. The fee shall be one-half the City adopted unit amount times the length from the center of Rochester Avenue to the west project boundary. b. Rochester Avenue - An in-lieu fee as contribution to the future undergrounding of existing overhead utilities (electrical and telecommunication, except for 66 K.V. electrical) on the opposite side of Rochester Avenue shall be paid to the City prior to issuance of a building permit or final map approval, whichever occurs first. The fee shall be one-half the City adopted unit amount times the length from the center of Base Line Road to the south project boundary. 2. Acquire necessary right-of-way and construct Rochester Avenue full width from Base Line Road to Church Street. Offsite sidewalk and street trees may be deferred until the development of the adjacent properties. .The developer may request a reimbursement agreement to recover the cost of constructing offsite street improvements from future - development as it occurs. 3. Remove and replace portion Of the curb and gutter on Base Line Road to construct a right turn lane for the project driveway. 4. Construct a combination bus bay and right turn lane on Rochester Avenue north of theproJect driveway. 5. Construct the portion of the Terra Vista Community Master Planned Storm Drain System 96 (lines 6 and 6-1) from this site to Day Creek Channel. If the project is to be constructed prior to the completion of the Day Creek Channel, provide a retention facility to the satisfaction of the City Engineer. 6. The Terra Vista Community entry monument, if construc=ed, shall be maintained by the developer. 7. Install the Base Line Road median landscaping from Milliken Avenue to Rochester Avenue. 8. Final Parcel Map lot lines shall conform to the approved site plan. Resolution No. 92-169 Page 7 APPROVED AND ADOPTED THIS 8TH DAY OF APRIL 1992.
