HomeMy WebLinkAbout92-160 - Resolutions RESOLIYI~ONNO. 92-160 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ~ SIGNING OF PROGRAM SUPP~]~qT NO. 018 TO LOCAL AG~NCY - STATE AG~~ NO. 08-5420 FOR ~ (]ON~ON I~HASE R~tAB~,TTATION AND WID~qING OF HAV~ AV~qUE ~ 4~ WHEREAS, the City Council of the City of Rancho Cucamonga (herein- after referred to as "Local A~'), has f~r its consideration and execution, the Program Supplement No. 018 to Local Acjency - State A~reement No. 08-5420 for the construction phase including AdvertS, Award and Administration of the Re~klbilitation and Widening of Haven Avenue fr~m 4th Street to Foothill Boulevard; and ~tEREAS, the State of California, De~ of Transportation, District Office 8 (hereinafter referred to as "State") processes and monitors Federally funded projects; and WHEREAS, as a corzlition to payment of Fed~ral funds for said No. 018. NC~, TH~%EFORE, the City Council of the City of Rancho Cucamonga does hereby resolve as follows: 1. Authorize the Execution of Supplement No. 018 to Local Agency - State ~ No. 08-5420 for the construction pba~e including Advertisement, Award and Admin/stration of the P~3~hilitation and Widening of Haven Avenue frc~ 4th Street to Foothill Boulevard in the City of Rancho Cucamonga, San Bernardino 2. To authorize the Mayor to sign said Supplement and direct the City Clerk to attach a certified copy of this Resolution, as w~ll as type in the Resolutio~ number and date in the blank of the third block of said supplement and for the return of the original copies of said supplement to the State of California Depa~-~ of Transportation along with the certified copy of NOW, THEREFORE, BE IT Ft~THER RESOLVED that the Local A~3ency shall also cc~ply with the "special Covenants or P~marks" attached to said operation of the im/~rovements, referred to in Article VI Ma~ of the aforementioned Master Agreement will be perfcxm~d by the Local Agency at regular intervals or as required for efficient operation of the completed improvements. Resolution No. 92-160 Page 2 2. ~he Local Ageaucy will advertise, award, and administer this uroject and will obtain the State's cc~c%~x~nce uri~r to either award or rejection of the C~ntract. 3. The Local Agency agrees the payment of Federal funds will be %on in the Federal-Aid Project Agreement (PR-2)/Detail iMate, or its modification (PR-2A) or the F~M-76, and accepts Bid Letter or its modification as prepared by the Division of hereby reaffirms the '~kxzliscrimination As~L~-~e~" cc~fcained in the afox~m~nti~ Master Agreement for Federal-Aid Program. 5. Whenever the local agency uses a comsultant on a cost plus basis, the local agency is required to submit a post audit report covering the allowability of cost payments for each individual consultant or subcontractor incurrir~ over $25,000 on the project. ~he audit re~ mm~t state the applicable cost principles utilized by the auditor in det~mining allowable costs as referenced in CFR 49, part 18, Subpart C-22, Allowable Costs.
