HomeMy WebLinkAbout92-152 - Resolutions RESOLUTION NO. 92-152 A RESOLUTIC~ OF THE CITY ODL~qCIL OF T~E CITY OF RAN~{O DISI~ICTS NOS. 1, 2, 3A, 3B, 4, 5, 6, 7, AND 8 F~R THE FISCAL YEAR 1992/1993 Pt~SUANT TO q~E LANDSCAPING AND LIGHTING ACT OF 1972; AND O~ A TIME AND PLACE FOR HEARING OBJ~UITONS THERETO ~{~S, the City Council of the City of Rancho Cu~, pur~]ant to the provisions of the Landscaping and Lighting Act of 1972, being Division 5 of the Streets and Highways Code of the State of California, does resolve as foll~s: Description of E~istinq and Prc~ Work. S~CTION 1: ~hat the public interest and conveni~ require and it is the intention of this City Council to levy and collect assessments within Landscape Maintenance Districts Nos. 1 through 8, inclusive, for the fiscal year 1992/1993 for the ~ and operation of (I) existing ar~ parks and facilities thereo~ dedicated for c~u~n greenbelt purposes by deed of record subdivision tract map within the boundaries of said districts and (II) proposed additional improv~ents which include West Beryl Park and East Beryl Park facilities, Milliken Park and the medians on Foothill Boulevard frc~ Haven Avenue to Rochester Avenue. "service" the improvements as those terms are def' _lr~d~__ in Secticms 22531 and 22538 of the Streets ar~ Highways Code. Said Costs shall also include the administration and supervision required to provide such mintenance and service. Location of Existin~ and Proposed Improvements. S~:TION 2: ~ e~cing improv~ to be maintained and serviced are located within the public right-of-way and landscaping easements delineat- ed in the report of the City Engineer and more particularly described on maps which are on file in the office of the City Clerk, entitled ";~m~m~Yc Diagrams Landscape ~ District Nos. 1 through 8, inclusive." The prop~ additi~al improv~te are l~ated within publicly ow~d_~__ lands delineated in the report of the City Engineer. Description of Assessment Districts. sECTION 3: That the contemplated w~rk, in the opinion of said City Council, is of more than local or ordinary public benefit, and the said City Council hereby makes the expense of the work chargeable upon tb~ districts, which which said districts are assessed to pay the costs ar~ expenses thereof, and which districts are described as follows: Resolution No. 92-152 Page 2 All that certain territory of the City of Ranmho Cuc~mnnga included within the exterior bour~m~ lines shown upon that certain '9%ap of ~ ~ District No. 1", '9~p of Tmr~.~cape Maintenance District No. 2", '~ap of Landscape Maintenance District No. 3A", '9~ap of Lan~ Mairfc~K~ District No. 3B", '94ap of Landscape Maintenance District NO. 4", 'T~p of Landscape Maintenanoe District NO. 5", '9~ap of Landscape Mainte~anoe District No. 6", '~3p of Landscape Maintenance District No. 7", '~ap of Landscape Maintenanoe District No. 8", indicating by said boundary lines the extent of the territory included within each assessment d/strict and which maps are on file in the office of the City Clerk of said City. Reports of Enqineer. SECTION 4: ~he City Oma~cil by Resolution NO. 92-153 has approved the annual repcx~ of the City Engineer which report corfcains the following. a. Plans and Specifications for the maintenance and services to b. An estimate of the oosts of providing the m~ntenance and c. Diagrams of the assessment districts, including any zc~es within any of the assessm~t districts; and d. An ~ of the estimated co,ts of provi~ the maintenance and service for the existing and proposed ~.t~uv=n~%ts, including the n~chod of assessment. The repart, entitled "Armual ~nginesr's Report", is on file in the office of the City Clerk. Reference is made to such repcxt for a full and detailed description of the existing and proposed ~ to be m~ and serviced, the boundaries of the assesa~ent d/strict and any zones therein, and the proposed assessments upon assessable lots and paroels of land within the various asses~nt d/strict. Time and Place of Hearing. 5qDCrION 5: Notice is hereby given that on the 17th day of June 1992, at the hour of 7:00 o'clock P.M. in the City Ommcil Champers of the City of be levied and collected for fiscal year 1992-1993. Protests must be in writing and ~ contain a description of the property in which each signer thereof is interested, sufficient to identify the same, and must be delivered to the City Clerk prior to the time set for the hearing and no other protests or objections will be considered. If the signer of the protest is not shown upon the last equalized asses~m~rfc roll as the owner of the [=~perty for which the protest has been filed, such protest must contain or be aooc~panied by written evidence that such singer is the owner of the property so described. S]~TI~ 6: All work herein proposed shall be done and carried thr~ in pursuanoe of an act of the legislature of the State of California designated as the Tm~.aping and Lighting Act of 1972, being Division 5 of the Streets and Highways Code of the State of California. Publication of Resolution of Intention. SHY2TI~ 7: Published notice shall be made pursuant to Section 6961 of the Gove~ Code. ~he Mayor shall sign this Resolution and the City Clerk shall attest to the same, and the City Clerk shall cause the same to be published 10 days before the date set f~r the hearing, at least c~ce in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the City of Ontario, Califcxnia, and circulated in the City of Rancho P~, ~, and ADOPI~D this 6th day of May, 1992.
