HomeMy WebLinkAbout92-150 - Resolutions RESOI/3TIONNO. 92-150 A RESOI/3rIC~ OF THE CITY ~ OF THE CITY OF ~ ~ DISTRICTS NOS. 1, 2, 3, 4, 5, 6, 7 AND 8, THE FISCAL YEAR 1992/93 ~ TO q]{E IANDSCAP~ AND LIGHTING ACT OF 1972; AND OFF~RING A TIME AND PLACE FOR HEARING OBJ~iTION$ THERETO WHEREAS, the City Council of the City of Rancho Cucamonga, pursuant to the ~=ovisions of the Landscapir~ and Lighting Act of 1972, being Division 5 of the Streets and Highways Code of the State of California, does resolve as follc~s: Description of Work. S~fION 1: ~hat the public interest and convenienoe require and it is the intention of this City council to levy and collect assessments within Street Lighting Maintenance Districts Nos. 1, 2, 3, 4, 5, 6, 7 and 8 for the fiscal year 1992/93 for the ma/ntena~e and operation of those street light facilities thereon ~4_icat~d_ for c~,m~n right-of-way purposes by deed or r~__~ subdivision tract map within the ~~ies of said Districts. Said mintenance and operation includes the cost and supervision of street lighting maintenance (including repair, removal or replacement of all or any part of any improvement provi~ for illumination of the subject area) in connection with said districts. Location of Work. SSLTION 2: The foregoing described work is to be located within the roadway rights-of-way and ~-~nts enumera~ in the re~rt of the City Engineer and more particularly described on maps which are on file in the City Clerk's Office, entitled "Assessment Diagrams Street Lighting Maintenance Districts Nos. 1, 2, 3, 4, 5, 6, 7 and 8. Description of Assessment Districts. SECTION 3: That the contemplated work, in the opinion of said City Council, is of more than local or ordinary public benefit, and the said City Council hereby m~R~ the expense of the work d~rgeable upon the districts, which said districts, are assessed to pay the costs and expenses thereof, and which districts are described as follows: All that certain territory of the City of Rancho Cucamonga included within the exterior boundary lines shc~n upon that certain '~ap of Street Lighting Maintenance District No. 1", '94ap of Street Lighting Maintenance District No. 2", '9~ap of Street Lighting Maintena~e District No. 3", '~ap of Street Lighting Mainte~nce District No. 4", '~ap of Street Lighting Maintenance District No. 5". '5~ap of Street Lighting Maintenance District No. 6", '9~ap of Street Lighting Maintenance District No. 7", '9~ap of Street LSghting Maintenance District No. 8", indicating by said boundary lines the extent of the territory included within each assessment district an which maps are on file in the Office of the city Clerk of said City. Resolution No. 92-150 Page 2 SfL~ION 4: The City C~uncil of said City by Resolution No. 92-151 has approved the annual report of the City Engineer which re~ indicates the amount of the pr~ assessments, the district boundari~, assessment zones, and the method of assessment. ~%e re~ title "Annual Eng~'s Report" is on file in the Office of the City Clerk of said City. Reference to said report is hereby made for all particulars for the amount and extent of the assessments and for the extent of the wo~-k. Time and Place of Hearing. SECTION 5: Notice is hereby given that on the 17th day of June 1992, at the hour of 7:00 p.m. in the City C~ncil Cb~mbers in the City of Rancho Cucamonga, any and all persons my appear and show cause why said w~rk should not be done or carried out or why assessments should not be levied and collected for fiscal year 1992/93. Protests ~ be in writing and must contain a description of the property in which each signer thereof is inter~-t~d, sufficient to identify the same, and ~ be delivered to the City Clerk of said City prior to the time set for the hearing, and no other.' protests or objections will be considered. If the signer of any ~ is be accc~panied by written evidence that such signer is the ~ner of the Landscaping and Lighting Act of 1972. SECTION 6: Ail the w~rk herein pr~ shall be do~e and carried through in pursuance of an act of the legislature of the State of California designated as the Landscaping and Lighting Act of 1972, being Division 5 of the Streets and Highways Code of the State of Calif~nia. Publication of Resolution of Intention. Sf~fION 7: Published notice shall be made pursuant to Section 6961 of the Gov~rm~_nt Code. ~he May~r shall sign this Resolution and the City Clerk shall attest to the same, and the City Clerk shall cause the same to be published 10 days before the date set for the hearing, at least ~ in the Inland Valley Daily Bulletin, a newspaper of general circulation pub] ~_h~_ in the City of Ontario, California, and circulated in the City of Rancho PASSfI), ~, and ADO~ this 6th day of May, 1992.
