HomeMy WebLinkAbout92-128 - Resolutions RESOLUTION NO. 92-128 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCID ~, CALIFORNIA, D~ql~G DEVELOPM~ DISTRICT AM~qE~FC 92-01, SUBAREA E, TO AM~qD THE DEVELOPM~ DISTRICTS MAP FRC~ M~DIL~ RESID~_AL (8-14 DW~I.ING ~ PR ACRE) TO I329~M~DIL~ RESIDentIAL (4-8 E~F~I.TNG UNITS P~R AC~E) ~OR 12.14 AC~ES OF IAND ~ ON ~{E WEST SIDE OF VINEYARD AV~FOE, APPRO~Y 600 FEET SUPPOI~ ~OF - APN: 207-211-O6 AND 36 (i) On December 7, 1983, the City Council of the City of ~ Cucamonga approved the enactment of the DeveloF~ent COde thr~ the adoption of Ordinanoe No. 211. (ii) On November 15, 1991, the City of ~ Cucamo~ filed an application for Develc~mnent District Amendment No. 92-01, Subarea E, as described in the title of this Resolution. Hereinafter in tbi~ Resolution, the subject Develc~ District Amendment is referred to as "the application." (iii) On F~h~mry 26, 1992, the Planning Ct~md~sion of the City of Rancho Cucam~xfa conducted a duly notioed public hearing on the application and following the conclusion of said public hearing, ____adopted Resolution No. 92-40 rec~~ to the City Council that the application be denied. (iv) On April 15, 1992, the City (kmm~il of the City of Rancho Cucamonga conducted a duly notioed public hearing and concluded said hearing prior to the adoption of this Resolution. (v) All legal prerequisites prior to the adoption of the Resolution B. Resolution. NOW, ~REFORE, the City Council of the City of Rancho Cucamonga does hereby find, determine, and resolve as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. the above-referenced public hearing on April 15, 1992, including written and oral staff reports, together with public testimony, this C~uncil hereby specifically finds as follows: (a) ~he application applies to 12.14 acres of land located on the west side of Vineyard Avenue, approximately 600 feet south of Foothill Boulevard and is ur~-~lcped; said property is currently designated Medium Residential (8-14 dwelling units per acre); and Resolution No. 92-128 Page 2 (b) The properties to the north of the subject site are designated C~..~nity O~L~,ercial and are developed with single family Residential (8-14 dwelling units per acre) and is developed with single family Residential (8-14 dwelling units per acre) ar~ is developed with cor~'ums; Cucamonga Creek Flood Control ~hannel; and (c) This amendment conflicts with the T~nd Use Policies of the General Plan and will not provide for develo~ within the district in a manner consistent with the General Plan, Develc~ CDde, ar~ with related development; ~ (d) ~ amendment does not ~ the goals and objectives of (e) The properties located in Subarea E of this application are are not compatible with existing and adjacent land use designations as evidenced by the absence of single family zon/r~ designations in the vicinity (f) ~ amendment w~uld not have significant impacts on the and findings of the Er~ Assessment. 3. Based upon the findings and oonclusions set fox'ch in parag~ 1 and 2 above, this Oouncil hereby resolves to deny Development D/strict Amendment 92-01, Subarea E, to amend the Develo~ Districts Map from Medium Residential (8-14 dwelling units per acre) to Imw-~um ~%esidential (4-8 dwelling units per acre) for 12.14 acres of lar~ located on the w~st side of Vineyard Avenue, apprc~/mately 600 feet south of Foothill Boulevard as shown in Exhibit "A." 4. ~he City Clerk shall certify to the adoption of this Resolution.
