HomeMy WebLinkAbout92-126 - Resolutions RESOI/3TION NO. 92-126 A RESOLUI~ON OF THE CITY ~ OF ~HE (IITY OF RANCHO CUCA~INC4%, CALIFO~F/A, Df~PfING DEVELO~ DIST~tICT AM~qfP~D~ 92-01, SUBAREA D, TO AM~qD THE DEVELO~ DISTRICTS MAP FRf~ M~Di-t~ RESIDf]qlTAL (8-14 E~n~.LTNG ~ PER AC~E) TO LOW-MfDIL~ RESIDf~ITAL (4-8 E~n~$.TNG UNITS PER ACRE) FOR 19.07 ACRES OF LAND LOCATf~ C~ THE WEST SIDE OF ~ C~K, NORIH OF ARROW ROUTE, APP~0~Y 600 FEEt SOUTH OF FOOIHILL BOULEVARD, AND MAKING FIlqD~ IN SUPPOR~ TH~fDF - APN: 207-211-01 AND 31 (i) On December 7, 1983, the City Council of the City of Rand%o Cucamonga approved the enactment of the Develo~ Code through the adoption of Or~ No. 211. (ii) On November 15, 1991, the City of P~r~ho Cucamonga filed an application for Develc~ment District Amendment No. 92-01, Subarea D, as described in. the title of this Resolution. Hereinafter in this Resolution, application." (iii) On F~_b~_ ~ary 26, 1992, the Planning C~.,,dssion of the City of Rancho Cucamorga oonducted a duly noticed public hearing on the application and following the conclusion of said public hearing, adopted Resolution No. 92-28 rec~mmendirg to the City Oouncil that the application be denied. (iv) On April 15, 1992, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing and concluded said hearing prior to the adoption of this Resolution. (v) All legal prerequisites prior to the adoption of this Resolution B. Resolution. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby find, determ/ne, and resolve as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced public hearing on April 15, 1992, including written and' oral staff reports, together with public testimony, this Council hereby specifically finds as follows: (a) The application applies to 19.07 acres of land located on the west side of (~ Creek, north of Arrow Route, approximately 600 feet south of Foothill Boulevard and is undeveloped; said property is currently designated Medium Residential (8-14 dwelling units per acre); and Resolution No. 92-126 Page2 (b) The property to the n~rth of the subject site is designated Medium Residential (8-14 dwelling units per acre) and is undeveloped; the prope~ to the south is designate~_ Medium Residential (8-14 d~elling units designated Flood (kxfcrol and is developed with the O~mnnga Creek Flood (8-14 dwelling units per acre) and are developed with a market and motel, mobile home park, and vacant land; and (c) This amendment conflicts with the Land Use Policies of the General Plan and will not provide for develc~ment within the district in a manner consistent with the General Plan, Develc~ COde, and with related develo~; and (d) This amendment does not prc~Dte the goals and objectives of (e) The properties located in Subarea D of this applicatic~ are not suitable for the uses permitted in the proposed lar~ use designation and are not oompat/ble with existing and adjacent land use designatic~s as evidenced by the linear co~figuratic~ of the subject px~perties which may be (f) This amendment would not have significant impacts on the and findings of the Envir~m~_ntal Assessment. 3. Based upon the findings and conclusions set forth in parac3r~ 1 ~ 92-01, Subarea D, to amend the Develo~ Districts Map frc~ Medium Residential (8-14 dwelling units per acre) to Low-Medium Residential (4-8 dwelling units per acre) for 19.07 acres of land located on the w~st side of the Cucamonga Creek, north of Arrow Route, approximately 60O feet south of Foothill Boulevard as shown in Exhibit "A." 4. ~he City Clerk shall oertify to the adoption of this Resolution.
