HomeMy WebLinkAbout92-125 - Resolutions RESOLUTION NO. 92-125 A RESOLUTION OF THE CITY (XDUNCIL OF THE CITY OF RANCID ~, CALIFO~rIA, D~Tf/I~G G~2~ERAL PLAN ~ 92-02, SUBAREA G, TO AM~qD ~ G~gERAL PIAN LAND USE MAP FBC~ M~Di-~4 RESID~fIAL (8-14 DWR~.LING L~TS P~ AC~E) TO ~1I~ RESID~FITAL (4-8 E~m~I,ING ~ p~ Af~E) FOR 19.07 ACRES OF IAND ~ ON THE WEST SIDE OF f~AMONGA C~, ~ OF ARROW ROUTE, APP~0XIMATELY 600 FEET SOU~H ~HER~OF - APN: 207-211-01 AND 31 (i) On April 6, 1981, the City of Rancho ~ approved the enactment of the General Plan through the adoption of Resolution No. 81-40. (ii) On Nov~Hr~er 15, 1991, the City of Rancho Cucamonga filed an application for General Plan Amendment No. 92-02, Subarea G, as described in the title of this Resolution. Hereinafter in this Resolution, the subject General Plan Amendment is referred to as "the application." (iii) On F~-hruary 26, 1992, the Plannir~ C~mmission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and following the conclusion of said public hearing, adopted Resolution No. 92-27 rec~,.,~nding to the City Council that the application be denied. (iv) On April 15, 1992, the City Council of the City of Rancho CUcamonga oonducted a duly noticed public hearing and concluded said hearing prior to the adoption of this Resolution. (v) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, ~{~REFORE, the City Council of the City of Rancho Cucamonga does hereby find, determine, and resolve as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substant~ evid~ce presented to th/s Council during the above-referenced public hearing on April 15, 1992, including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follows: (a) The application applies to 19.07 acres of land located on t_he ~est side of (~ Creek, noxth of Arrow Route, approximately 600 feet south of Foothill Boulevard and is undeveloped; said property is currently designated Medium Residential (8-14 dwelling units per acre); and Resolution No. 92-125 Page2 (b) The property to the north of the subject site is designated Medium Residential (8-14 dwelling unite per acre) and is undeveloped; the property to the south is designated Medium Residential (8-14 d~elling units designated Flood Control/Utility Oorridor and is developed with the Cucamonga Residential (8-14 dwelling units per acre) and are developed with a market and (c) ~Tds amendment conflicts with the Land Use Policies of the General Plan and will not provide for develo~ within the district in a manner consistent with the General Plan and with related develop; and (d) This amendment does not ~ the goals and objectives of the Land Use Element; and (e) The properties located in Subarea G of this application are not suitable for the uses permi~ in the proposed land use designation and evidenced by the linear oonfiguration of the subject p~operties which may be difficult to develop to the Lcd-Medium Residential development standards; and (f) This amendment would not have significant impacts on the and findings of the I~viro~erfcal As~ent. 3. Based upon the findings and oonclusio~s set forth in paragr~ 1 and 2 above, this Council hereby resolves to deny General Plan Amendment 92-02, S~barea G, to a~end the General Plan Ia~d Use Map fro~ Medium Residential (8-14 dwelling units per acre) to Low-Medium Residential (4-8 d~elling units per acre) for 19.07 acres of land located on the w~st side of the Cucamonga Creek, north of Arrow Route, approximately 600 feet south of Foothill Boulevard as shown in Exhibit "A." 4.
