HomeMy WebLinkAbout92-117 - Resolutions RESOLUTION NO. 92-117 A RESOLUTION OF THE CITY ODUNCIL OF THE CITY OF RANCHO C/3CAMONGA, CALTFORNIA, APPROVING G~bq~%L PLAN ~ 92-02, SUBAREA C, AM~ING THE G~N~%L PLAN LAND USE MAP FRf~ M~Di-t~ RESID~ITAL (8-14 DW~.LTNG UNITS PER ACRE) TO ~/t~ RESIDing/AL (4-8 D~.LTNG UNITS PER AC~E) FOR 13.12 ACRES OF LAND ~ ON q~E WEST SIDE OF HE~DSA AV~FOE, SOUTH OF ~I. BOULEVARD, AND MAKING FINDINGS IN SUPPORT THER~DF - APN: PORTION OF 208-321-24 (i) On April 6, 1981, the City of Rancho ~ approved the enauh~ent of the General Plan through the adoption of Resolution No. 81-40. (ii) On Nov~nber 15, 1991, the City of Rancho Cucamor~a filed an application for General Plan Amendment No. 92-02, S~3rea C, as descr~ in the title of this Resolution. Hereinafter in th~ Resolution, the subject General Plan Amendment is referred to as "the application." (iii) On February 26, 1992, the Planning C~,..~,~ssion of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and following the conclusion of said public hearing, adopted Resolution No. 92-31 re~,m~h~g to the City Council that the application be approved. (iv) On April 15, 1992, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing and concluded said hearing prior to the adoption of th/s Resolution. (v) Ail legal prerequisites prior to the adoption of th/s Resolution B. P~solution. NOW, THeREFOr, the City Council of the City of Rancho Cucamonga does hereby find, determ/ne, and resolve as follc~s: 1. ~ Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true ar~ correct. 2. Based upon substantial evidence presented to this Council during the above-referenced public hearing on April 15, 1992, including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follows: (a) The application applies to 13.12 acres of land located on the west side of Hermosa Avenue, south of Foothill Boulevard and is undeveloped; said property is currently designated Med__ium Resid_ential (8-14 dwellin~ units per acre); and Resolution No. 92-117 Page 2 (b) The property to the north of the subject site is designated O~L,,~cial and is vacant; the ~ies to the south are designated Medium Residential (8-14 dwelling units per acre) and are developed with the properties to the east are designated Low Residential (2-4 dwelling units per acre) and are developed with single family residences; the p~ to the west is designated Medium Residential (8-14 dwelling units per acre) and is developed with a mobile hc~e park; and (c) This amendment does not conflict with the ~a~d Use Policies of the Gene~. 1 Plan and will ~rovide for development within the district in a (d) ~ amendment promotes the goals and objectives of the Land Use Element; and (e) ~ne properties located in Subarea C of this application are suitable for the uses permitted in the proposed land use designatic~ and are compatible with existing and adjacent land use designations as evidenced by Medium Residential could act as a transition; and (f) This amendment would not have significant impacts cn the and findings of the Env~l Assessment. 3. ~ Council hereby finds that the project has been reviewed and oonsidered in compliance with the California Environmental Quality Act of 1970 and, further, this Council hereby issues a Negative Declaration. 4. Based upon the findings and conclusions set f~x~_h in 1, 2, and 3 above, this Oouncil hereby resolves to approve General Plan Amendment 92-02, Subarea C, amending the General Plan land Use Map fz-c~ Medium Residential (8-14 dwelling units per acre) to L~w-Med___ium Residential (4-8 dwelling units per acre) for 13.12 acres of land located on the ~est side of Hermosa Avenue, south of Foothill Boulevard as shown in Exhibit "A." 5.
