HomeMy WebLinkAbout92-096 - Resolutions RESOLUTION NO. 92-096 A RESOLUI~ON OF THE CITY COUNCIL OF THE CITY OF RANCFK) CUCAMONGA, CALIFORNIA, APPROVING IMPT.FMt~TATION OF ANTI- GRAFFITI PRDGRAM REFERRSD TO AS RANCHO CUCAMONGA ADOI~f-A- ~I~T .L PROGRAM WHEREAS, the City Council of the City of Rancho Cucamonga finds and determines that graffiti is obnoxious and a public nuisance, and unless it is removed from properties, the graffiti tends to remain. Other properties then become the target of graffiti with the result that entire neighborhoods are affected and the entire community depreciates in value and becomes a less desirable place in which to live; and WHERFAS, graffiti on property is a blighting factor which not only depreciates the value of the property which bas been the target of such vandalism, but also depreciates the value of the adjacent and surrounding properties; and in so doing has a negative intoact upon the entire City; and WHEREAS, graffiti also has been found to be a means of identification utilized by gangs; and furthermore, its presence may encourage further gang related activities; and WHEREAS, City Council reaffirms its co, m~,~tment to continue the war on graffiti by implementing Rancho Cucamonga's Adopt-A-Wall Program; and WHEREAS, all legal requirements necessary to adopt this Resolution have been performed. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby resolve as follows: SECTION 1: That the above recitals are all true and correct. SECTION 2: That the City Manager's office Public Works and Police Departments will work together with the Adopt-A-Wall co~u,~unity volunteers in implementing this program. SECITON 3: That a wall site be assigned to each volunteer group by the City for a specific period of time. Each group will have the option of renewing the right to the assigned site upon expiration of such time period. SECTION 4: That graffiti must be removed from assigned site within a 24 hour time period from the application thereof. If the c~,,~unity Adopt-A- Wall volunteers are unable to remove graffiti within 24 hours, they must notify the City of such inability. SECTION 5: That any Ax~opt-A-Wall team which fails to remove graffiti on a timely basis more than two consecutive times may lose their assigned site at the sole determination of the City. Resolution No. 92-096 Page 2 S~2TION 6: That participants must sign a damage waiver and release claim form. This waiver must be submitted to Risk Management prior to anyone being permitted to remove graffiti from any area with a public right-of-way. S~CTION 7: That this pilot program is for graffiti removals in public right-of-way and not for or upon private properties. S~CITON 8: That participants must receive graffiti removal training from applicable City departments prior to undertaking any removal activities. S~CTION 9: That a written log accompanied by a photograph of the graffiti before its removal must be maintained to reflect graffiti removed and the same provided to the City upon its request. SECTION 10: That any and all funds, donations and contributions will be placed in a trust fund account with the City of Rancho Cucamonga. Funds will only be expended on program related items. SECTION 11: That the attached policy will provide direction to participants of the Rancho Cucamonga Adopt-A-Wall program. PASS~D, APPROVED, and ADOPTED this 1st day of April, 1992. Executed this 2nd day of April, 1992, at Rancho Cucamonga, California. r :ra a. city clerk Resolution No. 92-096 Page 3 RANCHO CUCAMONGA'S ADOPT-A-WALL PROGRAM ANTI-GRAFFITI This policy has been developed to establish a framework for an Anti-Graffiti Adopt-A-Wall Program for the City of Rancho Cucamonga and residents who will be participating in the program. Also, it will provide policy and direction for participants to follow which will insure maximization of resources for an efficient and effective program. I. PURPOSE The Adopt-A-Wall Program is designed to allow residents who wish to volunteer their time to assist thc City with removing graffiti off of public right-of-ways. II. POLICY A. The City of Rancho Cucamonga Public Works and Police Departments will assign all adopted sites prior to graffiti being removed by the participants. The assigned time period will be determined at the time the site is assigned, it can range from three months to one year. B. The participants are required to remove graffiti from the adopted wall within a 24- hour period of the happening, ff assigned group or backup team is unavailable to comply with the 24-hour time limit because of special circumstances, then they must notify the City for City crews to remove graffiti. C. If the Adopt-A-Wall team continually fails to remove graffiti within the 24-hour period, that location will be reassigned. D. All program participants must sign a damage waiver and release of claims form. This waiver form must be submitted to Risk Management prior to anyone being permitted to remove graffiti from public right-of-ways. E. This program is for graffiti removal in public right-of-ways, and not applicable to private properties. F. Participant(s) will be trained by Public Works and the Police Departments. The training program will show the proper methods to remove graffiti. G. Prior to any graffiti removal, a log must be developed and maintained, and pictures must be taken prior to removal. This information must be provided to Public Works on a weekly basis. H. Any funds, donations and/or contributions will be placed in a trust fund account with the City of Rancho Cucamonga. Funds will only be expended on program related items. I. Graffiti removal supplies, paint and brushes will be provided by the City. The trust fund can also be used to fund the above costs.
