IN DEVELO~ (i) U.S. Hc~e Corporation has filed an application for Etiwanda Specific Plan ~-~nt No. 89-03 as described in the title of t_his Resolution. F~reinafter in this Resolution, the subject Etiwanda Specific (ii) On December 11, and continued to December 17, 1991, the Planning c~m~L~sion of the City of Rancho Cucamo~ga conducted duly r~tioed public hearings on the application. The Planning ~ion continued the application to January 8, 1992. (iii) On January 8, 1992, the Plannin~ CCemdssion of the City of Rancho O_~7~nga conducted a duly noticed public hearing on the application that a Resolution of Denial be prepared for the Ja~mry 22, 1992, meet/n~. At that meeting, the Planning O~mILdssion adopted its Resolution No. 92-07 thereby rec~~ to this City Council that said application be denied. (iv) ~be decision r~esenb~ by ~/U Pb~nin~ ~ion Resoluti~ was timely appealed to th/s Council. (v) On the 18th day of March 1992, the City Ooumcil of the City of Rancho ~ conducted a d~y noti~d ~ublic bearin~ and owcluded ~id (vi) ml l~ ~m~e~,~i~s prior to the ~__~ion of this NOW, ~%~E, the City Council of the City of ~ Cucamonga does hereby find, determine, and resolve as folly: 1. This Oouncil hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this P~solution are true and correct. the above-ref~ March 18, 1992 p~blic hearing, incl~ writte~ staff reports, the minutes of the. ~reference~ Planning ~ion meeting, and the contents of Plannir~ ~ion Resolution No. 92-07, this Oouncil hereby specifically fir~s as follows: Resolutic~ No. 92-070 Page2 (a) ~he application applies to all properties located within the Low Medium and Medium Residential Development Districts within the area governed by the Etiwanda Specific Plan; and (b) ~he Develc~ Code permits detaohed single family residences only utilizing the optional develo~ standards, as currently does the Etiwar~a Specific Plan; and (c) The amendment does conflict with the goals and policies of the EtiwaD~__a Specific Plan and General Plan for reasons as follc~s: 1) The amendment to allc~ single family residences in the Medium Residential zone _ur~e_~_-~ basic standards wield reduce the amount of policy for p~-oviding ample usable open space within the Specific Plan Area; 2) The amendment w~uld d/scourage the potential for project "clustering" for the purpose of preservation of open space; and 3) The ~ w~uld not suppo~ the Etiwa~ Specific Plan policy of creating a "country or rural armor" by integrat/ng natu~al areas with urban areas through a system of linear open spaces. (d) This ~ will reduce the incentive to utilize the size and thus allow higher densities for "conventi~" projects utilizir~ of the Etiwanda Specific Plan which contradicts the general intent of the plan for providing a generally more rsiral atmosphere and strer~the~Lr~ the sense of (e) The amendment does not take into om~ideration other interrelated develc~ standards (lot coverage, setbacks, etc.) which may d/rectly influence the character of projects and r~_~ the ability to meet the basic goals and objectives of the Etiwanda Specific Plan and the General Plan. reports, this Council hereby finds ar~ cc~cl~ as follows: (a) ~at the proposed application does not ~mote the gca~ and policies of the Etiwanda Specific Plan; and (b) That the px~posed ~ would have significant impacts (c) T~at the proposed amendment is not in conformance with the General Plan and Etiwanda Specific Plan. Resolutic~ No. 92-070 Page 3 4. Based upon the find~ and conclusions set forth in parag~ 1, 2, and 3, above, the City Oouncil hareby denies the application. 5. ~ Council hereby provides notice to U. S. H~me C0xporation that the time within which judicial revie~ of the decision re~ by t_his Resolution ~ be sought is governed by the provisions of California Code of Civil Procedure Section 1094.6. 6. ~he City Clerk of the City of Rancho Cucamonga is bm~.by directed to: (a) certify to the adoption of tb~ Resolution, and (b) forth transmit a certified copy of this ~esolution, by certified mail, return-receipt requested, to U.
