HomeMy WebLinkAbout92-035 - Resolutions RESOI33I~ONNO. 92-035 A RESOU31~ON OF THE CITY COUNCIL OF THE CITY OF RANCHO ~, CALIFORNIA, ~OFSANBERNARDINO, STATE OF CALIFORNIA, ORDERING TO BE VACAT]~APORFION OF AN~rLk"Y ~ SOUTH OF~ S~REETFRC~VINMARTO SIERRA MADRE AVENUES WHEREAS, by Resolution No. 92-011, passed on January 2, 1992, the Council of the City of Rancho Cucamonga declared its intention to v~cate a portion of a City alley hereinafter more particularly described, and set the hour of 7:00 o'clock P.M. on Feb~]mry 5, 1992, in the City Council Chambers, located at 10500 Civic Center Drive, Rancho Cucamonga, California, as the time and place for hearing all persons objecting to the proposed vacation; and WHEREAS, such public hearing has been held at said time and place, and there were no protests, oral or written, to such vacation. NOW, THEREFOr, the City Council of the City of Rancho Cucamonga does hereby resolve as follows: S~2TION 1: The Council hereby finds all the evidence submi~ that portion of an alley located south of Ninth Street from Vinmar to Sierra Madre Avenues is unnecessary for present or prospective public street purposes. The City Council hereby makes its order vacating that portion of said City street as shown on Map No. V-l17 on file in the office of the City Clerk of the City of Rancho Cucamonga, which bm~ been further described in a legal description which is attached hereto, marked Exhibit "A", and by reference made a part thereof. S~CTION 2: The subject vacation shall be subject to the reservations and exceptions, if any, for existing utilities on record. The south 10 feet of the alley as described in Exhibits "A" and "B", legal description and map, shall be retained as an easement for utility purposes for Southern California Edison and the General Telephone Company. S~CION 3: The subject vacation shall be retained as an easement for drainage and related purposes. S~'TION 4: The installation of a fire hydrant, waterline, and water meters on Ninth Street, including abandonment of water facilities in the alley are necessary to meet the City's fire safety and C.C.W.D. standards. Said improvements shall be installed by the city prior to the vacation. The Clerk shall cause a certified copy of this resolution to be recorded in the office of the County Recorder of San Bernardino County, California upon the installa- tion of said improvements. SECTION 5: The Clerk shall certify to the passage and adoption of this resolution, and it shall thereupon take effect and be in force. PASS~D, AP~, and ADOPI~D this 5th day of February, 1992.
