HomeMy WebLinkAboutPC Minutes Jan-Jun 1985 CITY OF RANCHO CUCAMON A PLANNING COMMISSION 1N TES Regular Meeting June 12, 1985 Chairman Dennis Stout called the Regular Meeting of the City of Rancho Cucamonga Planning Commission to order at 7:00 p.m The meeting was held at Lions Park Community Center, 9161 Base Line Road, Rancho Cucamonga, California. Chairman Stout then led in the ;pledge of allegiance. ROLL CALL COMMISSIONERS: PRESENT; David Barker, Suzanne Chitiea, Larry McNiel, Merman Rempel, Dennis Stout ABSENT: None` STAFF PRESENT: Andrew Arc ynski, Assistant ; City Attorney; Dan Coleman, Senior Planner; Howard 'Fields, Assistant Planner; Nancy Fong, Assistant Planner; Rick Comet, City Planner; Jerry Grant, Building Official; Barrye, Hanson, Senior Civil Engineer, Lloyd Hobbs, City Engineer; Curt. Johnston, Associate Planner; Barbara Krall , Assistant Civil Engineer; Otto Kroutil, Senior Planner; Dino Putrino, Assistant Planner; Janice Reynolds, Secretary APPROVAL OF MINUTES Motion: Moved by Rempel, seconded by McNiel , carried, to approve the Minutes of the April 24, 1985 Planning Commission meeting. Commissioner Chitiea abstained as she was not in attendance at that meeting. Commissioner Chitiea requested the addition of the following statement to paragraph three, page g of the May 9, '1985 Planning Commission Minutes: "She prefers that all vacant land falling into the medium and high density ranges e considered in a'manner similar to that of the 19th Street Corridor Study.$, Commissioner Rempel stated that the vote had been omitted from page 3 and page S pertaining to Tentative Tract 12914 and CUP 85-07, . respectively. Additionally, Commissioner Darker was =absent from that meeting, but appeared as voting on page 7 Chairman Stout stated that the motion regarding CUP 850 , California Retirement Villas, on page 3 of the May Dth Minutes should reflect that the sound items are to be addressed through a sound study prior to the issuance of Building' Permits. Additionally, Commissioner Chitiea"s comment in paragraph eight, page 6, regarding Parcel Map 984, Forecast, should reflect'that` she { had looked at option 3 of the EIR and compared it With this project Additionally, in his final statement prior; to voting he talked about the EIR and felt that although the Master Plan was one issue he felt that he could not make the findings that this project was in conformance on environmental issues because there was no tract reap to compare with the EIR, therefore voted to deny the project. Motion: Moved by Chitiea, seconded by McNiel, carried, to approve the Minutes of May 8, 1985, with the above amendments Commissioner Barker abstained as he was not in attendance at that meetings CONSENT CALENDAR A. ENVIRONMENTAL ASSESSMENT AND DEVELOPMENT REVIEW 5-07 EAR AK1AN -; The -d—evelopment of 88 apartment unity oo C. acres of lan in the Medium Residential District located at the south side of San Bernardino Road, 700 t feet east of Hellman ; APN U -1 -35 and 38. Nancy Fong, Assistant Planner, reviewed the staff report Chairman Stout opened the public hearing. Pete Pitssi 9375 Archibald, Rancho Cucamonga, representing the applicant, agreed with staff's recommendation to prepare interim policies for Foothill Boulevard Planning Commission Minutes , -2- dune 12 1985' Chairman Stout explained that this project was not before the Planning Commission for approval or denial at this time, but only to receive direction from the Commission regarding the Foothill Corridor Study. The following addressed the Commission opposing the apartment project based on concerns regarding traffic, declining; propery values, increased crime, and impacts on schools: Elaine Polar, 995 San Bernardino Road, Rancho Cucamonga Linda Ward, 7990 Amethyst, Rancho Cucamonga Mark Burger, 7865 Amethyst, Rancho Cucamonga Kay Tucker 799 Amethyst, Rancho Cucamonga Fred Rowe, Rancho Cucamonga resident Dan Westley, 7525 Amethyst, Rancho Cucamonga Shirley Meyer, 7915 Layton, Rancho Cucamonga Steward Shirk, 7740 Amethyst, Rancho Cucamonga Ralph Gareau, 9450 San Bernardino Road, Rancho Cucamonga Those speaking in favor of the project were: Sanford Bloom, Adjacent> property owner Harold Lovgren, Property owner Nelda Logren Property owner Chairman an Stow asked Mr. Pitassi .if he would consent to a continuance of this hearing, should the Commission determine the need for further study. r. Commissioner Barker asked for the study boundaries. Rick Gomez, City planner, replied that the boundary would be west of Maven to the westerly City Limits at Grove: Commissioner pempel stated that the ra i-ficotions of a tonal moratorium would e entirely unfair. He advised that this project would need further study before it cores back to the Planning Commission in order to address the concerns of those appearing before the Commission at this meeting. He suggested that the criteria for the Foothill Corridor Study should not only consider traffic on Foothill , but the north/south streets which abut Foothill . Commissioner Chitiea agreed that the study is essential . Further, that the interim policies should be developed to enable the Commission to review projects on a case-by-case basis Commissioner McNiel agreed that a moratorium should not be imposed and that staff should be directed to prepare interim policies. Planning Commission Minutes : -3- ,tune 12, 1985 Commissioner Barker agreed and stated that the developer should greet with the adjacent neighborhood in an atte t to mitigate their concerns prior to the next public hearing Chairman Stoat stated that there are obvious problems on Foothill . Further, that the study should look at traffic, density transitions and land uses. He encouraged the developer to meet with people in the neighborhood and advised that the City requires these meetings in an effort to involve the community in the early stages of a project"s review& He additionally advised that the City relies on the school districts to determine if they can accept additional students; generated from projects in the City, and a project cannot go forward until they have a letter from the affected school district. Motion: Moved by Stout, seconded by McNiel, unanimously carried, to direct staff to develop interior policies for 'Foothill Boulevard. Development Review 5- 7 will be readvertised and renoticed for Planning Commission 'review at the time these policies are adopted. Commissioner Ch t ea asked if there would be any problems for future owners on the one-half acre panels to develop and greet the parking and landscaping requirements Planning Commission Minutes - @ Jane 12, 1985 Dan Coleman, Senior Planner, replied that this development would be consistent with that which exists behind -Mart and that staff did not anticipate problems Chairman Stout opened the public hearing. Doug Mayes, L.D. King Engineering, addressed the Commission on behalf of the applicant and concurred with the Resolution :and conditions.; There were no further comments, therefore the public hearing was closed. Jerry Grant, Building Official , advised that development of the site as proposed with sump drainage was not recommended by staff. Mr. Grant proposed four conditions to be added to the Resolution for the Commission's, consideration. Chairman Stout opened the public hearing. Bruce Jordan, applicant, advised that no changes were bung proposed to the building height or setback, Mr. Jordan gave a brier' history of the project and its 'review before the various City,committees. He advised that the center area shown as the drive aisle on the site plan would be the only area which would drain through a pipe unto Helms, and would be approximately R of the total site drainage. Regarding Mr. Grants concern in the ability to pump waver through the sump due to maintenance and pump failure, he advised that the use of sumps is a very common practice. Further, that ;the applicant would also agree to raise the buildings 2 1/2 feet to allow the entire site to be gravity drained. Planning' Commission Minutes 7 dune 121, 198 Commissioner Repel asked for the street grade at the southwest corner of the project Mr. Jordan replied that the top of the curb is 84' " which is slightly less I than 2 feet from the finished floor level to the top of the curb. Commissioner Rempel asked hoer far the pipe would' have to go down Helms before , it would daylight Gary Sanderson, project engineer, replied that the pipe would daylight 300 feet south Mike Malone, 8219 Amethyst, addressed the Commission in support of the project ' and suggested that the applicant be alloyed to rase the buildings as suggested. Chuck Nelson, 8218 Amethyst, addressed the Commission in support of the project There were no further comments, therefore the public hearing was closed. , Commissioner Barker asked staff's reponse to the proposal to raise the buildings 2 12 feet-0 Jerry Grant, Building Official, replied that the if the buildings were raised in total' it would put the lower floor level above the lowest street grade adjacent to the site and could be totally gravity fed. Commissioner Barker asked if this would then mitigate s aff's concerns. r Grant replied that it would Commissioner Rempel stated that the drainage issue was not that big of a problem and could be worked out. Further, that the best solution would be to raise the buildings 2 12 feet arrye Hanson, Senior Civil Engineer, stated that he would prefer to take a _ closer look at this proposal and would be hesitant to say that 2 12 feet would be enough to mitigate the drainage problem. r Grant stated that presuming the grading plan is somewhat correct in that the curb elevation at Helms and the southeast corner of the property is approximately 85 feet and the building elevation is 821 511, the buildings should not have to be raised' more than 3 feet Commissioner McHiel stated that he agreed with Commissioner Rempel that this issue could be worked out and should not hold up the project Planning Commission Minutes - - June 12 19 _ Commissioner Chitiea disagreed and stated that drains do get blocked up and would not like to see something built with a potential to cause flooding problems for adjacent property owners. Further, that if there were no objections from adjacent propet,y owners, raising the building pad level would be prefer^rable if it mitigated the drainage problem satisfactorily. Commissioner Barker stated that if staff feels comfortable with this proposal, he would prefer gravity drainage to refiring on pumps. Further, that it would be preferTMrable to ;give 'staff guidelines and direction and have then work out the details with the developer rather than trying to design the project in a public forum. Chairman Stout agreed and stated that these types of techincal problems should have been addressed before the project got to the Planning Commission level . ' He asked Mr. Grant if he would need more time to review this proposal . Mr. Grant replied that if the entire interior parking area was raised three feet it could' drain by ;gravity to the street. Further, that if the applicant chose to raise the floor levels, the entire site could gravity drain. Motion: Moved by Rempel , seconded by McNiel, to adopt the Resolution with the condition that the building pads be raised so that drainage would gravity flow from the site. Additionally, the building heights are to be consistent with the height requirements for the district in which the site is located, and not exceed 25 feet. Commissioner Rem el stated that he appreciated the applicant's cooperativeness on the design of the project. Curt Johnston, Associate Planner, reviewed the staff report. Mr. Johnston advised that the applicant had requested an amendment to Design Review condition 2 of the Resolution by adding "willing to participate" to the requirement that the developer obtain written consent from adjoining homeowners to reprove existing walls or fences. He further stated that staff would recommend this amendment. Andrew Arc yns i Assistant City Attorney, recommended an amendment to Tentative Tract condition 2 which would state that if the developer is unable_ to acquire the right-of-way as shown on the approved plans within 18 months, the project shall be deemed denied Chairman Stout opened the public hearing Albert Velasque , Dwight French, Inc. , representing' the applicant, advised that every effort had been made on the part of the applicant to over come` problems. Farther, that the applicant had been in contact with the adjacent property owner, who indicated a willingness to cooperate on the right-of-way. James Hill , 6234 Valinda, Rancho Cucamonga, stated support for this project; however, expressed concerns with impacts on schools as a result of the adjacent` apartment complex. He asked if there were plans to widen Haven Avenue Bar°rare Hanson, Senior Civil Engineer, replied that Haven Avenue would be widened to its full width as a result of the development of this project and the apartment project. ' Further, that the full width of Haven would be 94 'feet with curb separation and a right-hand turn on Haven Planning Commission Minutes; -1 - June 12, 1985 Erma Welsh addressed the Commission on behalf of Ehaffeyf College and stated that the College was committed to the land dedication, as long as all of the conditions were met Chairman Stout asked if there was-a pending action by the Board of Trustees, Ms. Welsh replied that the Board of Trustees had authorized a letter recognizing their commitment. Further, that a resolution would be pending find approval in duly. Don King, 9375 Archibald, Rancho 'Cucamonga, supported the ,project and stated that the applicant had come up with a design which makes a smooth transition with the project to the south. There were no further comments, therefore the public hearing was closed. Commissioner Chitiea commended the applicant on the development of the trail along the northern portion of the project Motion: Moved by McNiel, seconded by Barker, to issue a Negative Declaration and adopt the Resolution approving Tentative Tract 12873 with amendments to Design Review condition 2 to add "willing to participate" and Tentative Tract condition 2 to reflect that if right-of-way for Banyan has not been acquired within 1 -months the project shad be deemed denied Motion carried by the following vote AYES: COMMISSIONERS: MENIEt, BARKER, CHITIEA, RE PEL, STOUT NOES: COMMISSIONERS: NONE ABSENT. DESIGN REVIEW FOR TRACT 12040 - ANNEN GROUP - Reapplication for design review of new architectura d eva°tions an changes to the site plan for 328 condominium units on 25> acres of land in the :Medium Residential District ; 3-14 du/ac located at the northeast corner of Turner Avenue and Arrow Highway - APN 20 ® 41-11. Nagar Fong, Assistant Planner, reviewed the staff report. Planning' Commission Minutes _11- dune 12 1985 Chairman Stout stated that during Design Review it had; been discussed: that the two inner and two ' outer doors would be alternated and that there would be a slight variation between the two outer and inner doors; however, the conditions did not reflect that requirement. Chairman Stout opened the public hearing. Don King, 9375 Archibald, Rancho Cucamonga gave an overview of the project. He advised that he recalled the discussion regarding the garage doors and would not object to this condition. He additionally stated concurrence with the Resolution and conditions of approval There were no further comments, therefore the public hearing was closed. Chairman Stout stated that the open space renderings were very helpful in the review of this project and suggested that they be a project submittal requirement Commissioner Barker agreed that it was helpful , but not necessarily that the renderings should be required of all projects. Commissioner 'Rempel agreed that renderings of this mature are useful and ; should include the ratio between number of units and the mount of open spice. t see ;a method to mitigate the h would like cr g that e Commissioner Barker stated streetscape of garages, as they were of particular concern to him. Commissioner Chitiea stated that the architecture was a su bstantial improvement over the prior submittal . She further requested an amendment to condition 4 requiring the upgrading of rood patio fences, and suggested that the fences should be stained or painted. Motion: Moved by Chitiea, seconded by McNiel, to issue a Negative Declaration and adopt. the Resolution approving Design Review for Tentative Tract 12040 with an amendment to the conditions to require a variation in garage doors along with alternating the two inner and two outer doors, and the painting or shining of the wood patio fences. Motion carried by the following vote: AYES: COMMISSIONERS: CH TIER MC IEL, BARKER, REMPEL, 'STOUT NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: NONE -carried Chairman Stout advised that the following items were related and would be heard concurrently. Planning Commission Minutes -12- Dune 12, 1985 AMENDMENT TO CONDITIONAL USE PERMIT 3-07 CHRISTESON - Amendment to include a fast food restuarant in the concept plan the Virginia Dare Center, a business park consisting of office, commercial , restaurant and theater use on approximately 13.1 acres of land in the General Commercial District located at the northwest corner of Foothill and Maven Avenue - _ AN 1077- 4-01 and Cie C. ENVIRONMENTAL ASSESSMENT AND DEVELOPMENT REVIEW OS-Og - DEL TACO _ The develo ment of a * ft� fast food restaurant located on the west side of Haven, north of Foothill on .12 acres (Virginia Dare Center) in the General Commercial (CC) District - APN 1077-401-027. Can Coleman, Senior Planner, reviewed the staff report and advised that two actions would be necessary by the Commission; one to delete condition S from the original Resolution approving CUP 83-07 thus verifying that a fast food use would be acceptable at that location and the other` action to approve Development Review8' 5-U a Commissioner Barker asked how the continuation of the existence of the hedges would be enforced and if a condition should e added to the Resolution. Mr. Coleman advised that one of the Standard :Conditions requires that the landscaping be maintained in a healthy, thriving condition and be neatly trimmed, which would be monitored: through the normal enforcement procedure. Chairman Stow asked what the harm would be in adding a condition that states that the hedges are to be maintained in such a manner that provides proper 1 screening Rick Gomez, City Planner, replied that there would be no harm in that condition; however, if there was a problem, enforcement would be pursued under the property maintenance section of the Development Code because' under a Resolution ,you cannot prosecute for criminal' violations. Andrew Arczynki, Assistant City Attorney, agreed and further advised that the Conditional Use Permit could be brought back to the Commission at any time for possible revocation Chairman Stow opened the public hearing* Don Chri teson, Christe on Corporation, presented renderings of the project to the Commission Stan Westfall, Del Taco Corporation, advised that Del Taco had worked with the developer and City staff to develop a project that he felt was appropriate for Rancho Cucamonga and the center. Regarding the hedge, he stated that he was trying to find something other than a wall which could be more visually attractive and could guarantee that the developer would assure the landscaping could be properly maintained. Further, the design of the building was the first of its kind and was now being recommended for other areas Planning Commission Minutes -1 dine 12, 1985 Commissioner Chiti a asked if there would be place for people to eat outside. Don Christeson replied that there would not be places at Del Taco for outside eating; however, the center section would be designed as food center and would contain central eating patios Commissioner Chiti a asked if there would be any pedestrian access from the Del Taco to the center, r. Christeson replied that pedestrians would be walking through the cuter itself. Dan Richards, representing the property owner to the north, stated that he was in favor of the use and felt it was appropriate. He was concerned with the trash enclosures adjacent to the southern property line and suggested that it e enclosed In a block' wall , possibly with landscaping to act as a buffer. Regarding future access with the property owner to north, he advised that , there are no easements in existence at this time. Commissioner Chitiea asked if easements would be; considered at time o development. r. Richards replied that the property owner would be pilling to entertain the idea; however, wanted to bring to the Commission's attention that the easements do not currently exist. Chairman Stout stated that he thought that reciprocal access easements were a requirement of Parcel Map 8303. Rick Core , City Planner, replied that the raster plan contained access between the two sites to facilitate better circulation and minimize the amount of curb cuts on Haven Commissioner Rempel advised that a condition had been placed on ,the parcel map asking that access be provided to the future property to the north. r. Christeson stated he did not recall a condition, if the northern property were developed with a compatible type of project he had no objection to sharing access Dan Coleman stated one of the reasons this had been required was because traffic from the Virginia Dare Center that needed to go left onto Haven would have to go through the northerly property to get to the signalized intersection and median break on Haven. r. Christeson stated that it would be the benefit of both property owners to work together on traffic circulation. Planning Commission Minutes - dune 12, 1985 Paul Rougeau, Traffic Engineer, verified that a condition existed on the Parcel Map requiring reciprocal access easements to the northerly property. There were no further comments, therefore the public hearing was closed. Commissioner Barker asked staff to address the concern of Mr. Richards regarding the trash enclosure. Mr. Coleman replied that there would be five feet of landscaping on the Virgina Dare site and the project to the north would also be required to provide landscaping. Further, he advised that there is condition to provide an additional trash enclosure for the restaurant because of the distance involved to other trash enclosures. Chairman Stout asked if the architectural details of the trash enclosures would be submitted for review by the Planning Department. Mr. Gomez replied that it could be reviewed for consistency with the center's architecture as part of the landscape plans. Chairman Stout stated that he originally was not in favor of having a fast food located on Haven, due in part to the stylized architecture that most fast foods have. Further, that he had been told time after time by major chains that this is their character and it wouldn't be their restaurant without that stylized design. He additionally stated that he appreciated Del Taco's cooperativeness in changing their design, which is going to be an example to other chains that architectural designs can successfully be changed for compatibility. Commissioner Barker stated that the Planning Commission Resolution, as read by Mr. Sylvester, was exactly what was adopted at that time; however, was adopted after the Commission's decision that the institution of this particular kind of project at that location` might have a numbers of environmental impacts was overturned by the City Council . Furthermore, he resented that idea that everything is alright with this project, because he did not believe that to be true. He was not comfortable with 40 acres of apartments and would 'prefer to see the density range closer to 1.4 dwelling units to the acre than 4; however, that was not the issue before the Commission at this time. He advised that the language in the ordinance requiring various housing types means that there should be as wide a range of various housing types as possible, not just facades Planning Commission Minutes - C- dune 12, 19 Commissioner Chit ea stated that to say the Commission was basically happy with the project is not correct; they simply 'did not have the grounds to determine that the project could not be approved sine it met the City Council 's requirements. Further, that she would like to see a variety o housing types and a different approach to the depth of transition, and still felt the density was too high Commissioner McNiel agreed and further stated that the Commission did a goo job on this raster plan, given the parameters of ghat they had to work with. Chairman Stout stated that he had problems with the project from the very beginning and was instrumental in the Commission's requirement for an environmental impact report to determine if these major concerns could' be addressed. However, the City Council determined that the density was appropriate, that they were satisfied with the General Plash in that area, and that the environnmental impact report` for the General Plan was adequate to cover the issues. The Council did, however,; request that a traffic consultant look at the traffic issue and it was the consultant's recommendation that the traffic concern could be mititaged through certain design features, which were incorporated into the master plan. Regarding the issue of conformance of this master plan with Ordinance 259, he stated that it does not exactly conform with the ordinance requirements and requested staff to examine the large amount of a certain type :of product in one area. Further, that some modification to the master plan is necessary to get different product types within the density range, along with the depth of transition and how it relates to other areas. Additionally, Staff should be directed to look at the possibility of different product types so that the end result is not 40 acres of the same product, then look at the transition` issue: because it will have to transition with Phase I;. Commissioner Chitiea stated that she would agree because the children who accompany their mothers to the exercise class could be disruptive to businesses. Commissioner McNiel agreed; however, stated that if the applicant could work out a solution, he should have the advantage to do so. Planning Commission Minutes -3- May 22, 1985 -------------- Commissioner Rerpel agreed that solutions such as designating and policing parking areas and sound proofing the walls might mitigate the concern so that the exercise class could continue during the morning hours. He stated that the number of people involved in the exercise class is too large for off hens time. Chairman Stout replied that this has been a topic of discussion for several years, but that the applicant now indicates that the establishment is a restaurant. Mr. Kolb asked for information regarding parking restrictions. Nancy Fong, Assistant Planner, replied that 1 space per 100 square feet is required and that this use has 2700 square feet, therefore requires 27 parking spaces. John Mannerino, attorney representing the shopping center owners, stated concern with the major change in manner of operations which he felt significantly increased the load of the parking lot during peak hours. He further stated that the reduction in the number of employees was a concern because there would not be adequate staffing to report inappropriate behavior of customers. Mr. Mannerino suggested that the Commission require a meeting between staff, tenants, and the shopping center to discuss the parking issue. Doug Gorgen, co-owner of the shopping center, stated that the center does not have adequate parking to support the daytime restaurant use of the Boars Head. He requested that the restaurant use be scaled down. Donna Kolb, D & L Deli, stated concern with competing menus and parking. John Shrinkweilder, representing Radio Shack, stated concern with parking. Planning Commission Minutes -6- May 22, 1985 Mel Futrell, '6Topaz,623 stated that his main objection to the Hoary Head had been the late hours of operation. Further, that since reopening the establishment nine days ago the hours seemed more compatible, but was concerned that Mr. Arcinage did' not want the hours modified to allow an earlier closing time. Roberta Futrell, 6623 Topaz, stated that it had been heavenly chile the Roars Head was closed and that she was happy to have C & L Deli as pant of the shopping center. Doug Hone, co-owner of the shopping enter*, suggested that staff analyze the parking as originally established because the previous approval had been as an off-hours use. He further suggested that the City consider employee assigned parking and that consideration be, given to opening up the parking spaces which had been chained off in a previous condition of approval . Larry Arcinage, Boars Head, rebutted the comments made during the public hearing. He stated that he is now being admonished for complying with the City's conditions to serve lunch and dinner,. There were no further comments, therefore the public hearing was closed. Rick Comet, City Planner, advised that the purpose of this hearing is to receive direction from the Commission based on testimony received and not to I make a decision at this time. He stated that the alternatives would be to determine that the use is being conducted per the conditions of approval' and _ should be allowed to continue, or to direct shaff to prepare a resolution and findings to modify conditions of approval Commissioner McNiel stated that he didn't think the Commission had the responsibility to mediate a disagreement between tenants and landlords as to their agreements; however, the Commission does have to protect people based on parking restrictions and recommended that that issue be further studied. Commissioner Barker outlined the issues before the Commission. He stated that parking during daytime hours is a new issue. Further, that competition between like businesses is unfortunate, but questioned whether it is within the Commision's ability to make a decision on that issue. He additionally, stated that the hours of operation have always been an issue, and was still of the opinion that the late night hours are not compatible with the surrounding neighborhood. He advised that he would have a problem making findings of whether or not the establishment is being conducted appropriately when it has only been open for nine days. Commissioner Barker asked the City Attorney to respond to the request that staff, tenants, and shopping center owners be required to meet on the parking issue Chairman Stout stated that, at the time the Commission had determined that 1100 pm. was an appropriate closing time, Mr. Arcinage based an appeal of that decision economic hardship to the City Council . The Council 's decision was to allow the establishment to remain open until 2:00 a.m. However, based on Mr. rcinage's testimonoy, it does not seem that an economic hardship could Planning Commission Mmutes -7- May 22, 1985 be imposed if the Commission were to modify the hours of operation at this time. Chairman Stout asked the City Attorney for direction on that issue. Jim Markman, City Attorney, advised that regarding a meeting between the tenants and shopping center owners, the Commission could not require but could suggest such a meeting to discuss the parking issue. He additionally advised that the Planning? Commission gust have substantial evidence to modify the conditions of a Conditional Use Permit. Further, that the parking issue would be appropriate to study for further modification because no one tenant has a vested right to create a nuisance to other tenants. He also stated that the Commission could also consider modifications to operating hours because by the applicant's own testimony evidence had been given that the business operations were altered Commissioner Rey el stated that it appears that the business is finally, opening with the original intent in 1978. Regarding the parking problems, he stated that the site is more than adequately ;parked and advised that the owners and the tenants should work out an amiable agreement; however, if further study indicates that the Boars Head is getting too many spaces, the Commission should take a look at the seating capacity. Commissioner Chiti`ea stated agreement that staff should research the center's parking and pass the information on to the owner, who should try to work` out the problems with the tenants. She added that the City should not have to solve the problem for the shopping center owner, but should give direction as to what is appropriate for each establishment. She additionally agreed that the hours of operation 'should be further studied for possible modification. Mr. Vernaci explained that it takes from 3 to 4 years from time ;of propagation to have a marketable item and that the need would be to generate ;an income until that time Chairman Stout stated that during Design Review, the applicant advised that the ultimate intention is to obtain a retail outlet site and then to use this site as wholesale only and for growing purposes. He asked what that time frame would be Mr* Vernaci replied that he would prefer to have this CUP request reviewed in two years to see where his business is at that time. He advised that he would first start working as a wholesale to generate the income to obtain retail space. Commissioner Barker stated that the Commission had previously discussed the issue of retail sales and that a concern had been allowing people to compete in a business market and giving one unfair advantages over another by rewiring one to function under all the rules and regulations of a neighborhood center. He asked Mr. Vernaci to respond to that concern. There were. n a p g Commissioner Rempel stated that this request is the same as the policy issue which was previously discussed in that the applicant wants to operate a retail business without being in a retail /commercial area.. He 'further stated that without the retail sales he could still raise plants and sell` then to other nurseries and if the applicant couldn't make a living at that, this site is the gong place Commissioner McNiel stated that this issue will come before the Commission on several others sites within the City. further, that a policy decision had been made by the Commission that it was unfair to people opening businesses in retail areas and being required to put in all the amenities, and that the Commission should stand by that decision. As a compromising situation, the fact should be understood that it is difficult for these people to support two separate sites at one time and the fact that Victoria has not =come adjacent to this site yet; therefore, should be allowed to sell retail for a brief period of time to establish a retail market with a condition that they close this retail site and relocate the retail to a more appropriate commercial area. He added that the ;City would then have the benefit of a substantial portion of the corridor landscaped. Commissioner Rempel stated that there, are quite a feet places along 1-10 into Los Angeles and the 210 through La Canada where there are nurseries that plant without retail . Further, that if this site is ;permitted to have retail, the same consideration would have to be given to everyone in the Edison corridors, therefore the Commission should stand by its previous policy decision. Dwayne Butler, MEA Group, project architect and engineer, questioned Planing Division Condition g and asked when construction of the wall would be required Mr. Johnston replied that installation of the permanent wall would not be required until construction of phase two David Conan, project acoustical engineer, encouraged that the sound barrier not be required because the buildings most benefited by the barrier would be better served' by increasing the patio wall height i Commissioner Dhitiea asked if a wall or clear panels were being proposed. 'II Mr. Konan advised that any material could be used if it were heavy duty and approximately 31 pounds per square foot. Ted. Siebert, project architect, stated that glazing in the balconies would cause a greenhouse effect which would heat up the interior of the units. He further stated that the wall along the frontage of Arrow 'would reflect sound from the parking lot and create alleys between the buildings and the back of the wall and could cause surveillance problems. He additionally requested ;, that a teflon coated nylon fabric be used for the trash enclosures. Chairman Stout asked what effect the Fire District' s requirement for 26 foot' wide streets had on the site l an'. r Siebert replied that the increased street width caused a redistribution of the open spade to provide continuity. Jeff Sceranka, Rancho Cucamonga resident, stated a concern with maximizing the density of the project which necessitated placing the units so close to Arrow Route with the amount of sound generated from that street. He stated further concerns with one access for the project on Arrows Route and the impact of the units on the office use to the east. Jinn Barton, 8409 Utica, Rancho` Cucamonga, stated that the density is too high. He stated concern with the amount of landscaping and open 'space for recreational use by the residents. Mr. Barton suggested that the signaliation of 'Civic Center Drive and Haven be researched, and that Civic Center Drive be constructed at the established width. r Feeham stated that access on Arrow Route was extensively discussed and worked on in conjunction with the City Engineering Division. He advised that another access has been provided on Civic Center Drive at the northern project boundary. Regarding the setback` from Haven, Mr. Feeham advised that the lot' line is on a recorded parcel map. In referrence to the recreational open space, he stated that the plan had been examined at staff level and provides a little over that which is required. Commissioner Rempel was concerned that the recreation areas were inadequate for this many units. He further stated that the project density is a concern because 'there is .no ray to get an adequate amount of open space in this project. Additionally, the proximity of the trucking facility to the proposed units, and the location of the project to the street were concerns. He stated that the project was not compatible with what is envisioned for Maven Avenue. Commissioner Barker stated that his first reaction was that the project had an insufficient amount of usable open space and that the functional use of common open space had not been given a very high priority. Further, that there must be a better solution to noise problems than to necessitate people sitting down to be able to enjoy their balconies. He additionally 'stated concerns with the traffic impacts and questioned if it would be possible to develop at that high density and address the concerns of noise and functional open space. Commissioner McNiel stated that the possible mitigation of problems seem to have been approached with 24 dwelling units per acre in grind. He stated that reducing the building height along Arrow and the increasing the setbacks aright mitigate some problems. Further, that access, on Arrow Route Mould be a nightmare and asked Traffic Engineer Paul Rougeau to address the possibility of Civic Center Drive going through r. Rougeau replied that it is conceivable that Civic Center drive could go through, however it was found to be a problem due to differences between the industrial use and this use. Commissioner Chitiea stated that she was not comfortable with the architecture in that it did not compliment the high-tech, urban thrust envisioned for that area. She stated further concerns with the :traffic and stated that the trucking yard situation has not been adequately addressed. Chairman Stoat stated that he was surprised at the open space on this site plan because it was remarkably different when seen at Design Review and the effect of loosing ripen space and moving buildings around had a definite effect on the open space. He suggested that a thorough traffic analysis be conducted which would consider if a " traffic signal is warranted at the entrance on Arrow, the traffic impacts on Arrow, and examine the adequacy of the width on Civic Center Drive to the north. Commissioner Barker stated that due to the high grinds the City experiences, the parallel placement of the buildings should be examined to see if a wind tunnel effect exists Planning Commission Minutes - - May 22, 1985 Chairman Stout asked that an open space rendering be provided which did not depict buildings so that what exactly is proposed can be easily seen. He also requested the rendering show where the amenities are located and also contain a diagram of pedestrian access. Commissioner Chitiea stated that pictures have been provided of the fronts and sides of buildings but nothing which gives the feeling of how it might be to stand in a project and look dowry a street. She advised: that this would be helpful Commissioner Parker advised that the project should have; different kinds of usable open space including some active types of functional open space. He additionally stated that a -acre parcel is large enough to handle any of the street configuration alternatives; previously presented to the Commission. Mr. Hopson referred to the condition requiring bonds for improvements that eight be ultimately constructed and requested that a lien agreement be required instead. He stated that it is the concern of all property owners in the area that they have ultimate usable access to develop their property. r. Hanson replied that if the Commission so desired, Engineering condition B-1 could be delete and E checked with an additional statement requiring paved access to parcel one and the remainder parcel. James Markman, City Attorney, advised that are instrument would have to be drafted for a blanket easement which would describe the length; and width, and type of standards to be used for the roads. He recommended that the condition regarding the lien agreement should stag that it applies to the present alignment on panels south of parcel one. Additionally, it should also be understood that if a subdivision agreement is entered into requiring security for the improvement of those streets within a certain' amount of time, that the City doesn't have; to implement the lien agreement. Ken Linville, Civil Engineer, addressed the Commission requesting approval of the parcel m Art Bridge, 8715 Banyan, Rancho Cucamonga, was concerned with drainage and the approval of a circulation system for this parcel which might prove to be detrimental to development of the entire acreage. He requested denial of the parcel reap until such time as all concerns in the EIR are addressed. Planning Commission Minutes -6- May 8, 1985 Jeff King, 7337 Pasito, Rancho Cucamonga, suggested that if the Commission deems it necessary to have an irrevocable offer of dedication over parcel one, it would be necessary to have the, sane offer to what is depicted as the County; area on the reap since without it that land would be totally landlocked. There were no further comments, therefore the public hearing was closed. Commissioner Chitiea was concerned with the street layout. She advised that because of the jogs in the circulation system, it would seem to preclude development of the design most preferred by the Commission in their review of the Environmental Impact Report. ; Commissioner Rempel stated that the roads presently shown on the parcel map are in theory only and could be changed at the time of development. Further, that it didn't necessarily seem that the street design could not meet the constraints of what the Commission expected at the time of tentative map submittal . Chairman Stout stated that while he was sympathetic of the applicant's dilemma, the City must base decisions on how a project relates to the City and what is in the best interest of the community. Further, ; that from the beginning the Commission has reviewed this property as one parcel and to now begin parceling off sections would be piecemeal development. He additionally stated that it has always been past policy of the City to require a-tract map ` in situations where development problems exist; therefore, without mowing what the development is going to look like, could not make the findings;. necessary to approve the parcel map. Additionally, although the master plan was one issue, he felt that he could not make the findings that this project is in conformance on environmental issues because there is no tract map to compare with the EIR; therefore, would recommend denial of the Parcel Map. Mrs Markman stated that at the Commission's direction he could suggest language for the Resolution to reflect denial . LAND USE ANALYSIS Otto Kroutil, Senior Planner, reviewed the staff report Chairman .Stout invited public comment. Michael Payne, expressed concerns with the Proposal on behalf of the. Building Industry Association IA) . He advised that land use amendments such as those proposed by the Advisory Commission would cause serious impacts and that the BIA would consider litigation procedures should the City approve the proposed land use reductions. Planning Commission Minutes -8- May N, 1985 Jeff Sceran a, 6211 Phillips Way, Rancho Cucamonga, stated that the Citizens Advisory Committee recommendations were an insult to those who worked on the, various City documents which make Rancho Cucamonga one; of the finest and fastest growing cities in Southern California. Further, that he didn't have a problem with any resident trying to combat incompatibility in their own area, but to recommend changes to city-wide documents which took eight ,years of planning, public hearings, and research was absurd. He advised that the City needs to stand by their plans and consider change on a case-by-case basis. Jim Bailey, expressed concerns with the proposed land use reductions on behalf; of the William Lyon Company, and urged approval of the no change alternative. Chairman Stout felt that the Citizens Advisory Commission is basically putting the cant before the horse. Further,, that the could not agree that the City should simpler take the Development Code and other planning documents, thrown them out and start all over. He stated that he could agree with looking at particular sites in the City on -a case-by-case basis, but reducing densities throughout the entire City would be the wrong approach. In response to the CA 's concern regarding the `high density ranges, Commission Stout advised that most of the high density sites are already built-out and there very few remaining. further that it has not been the policy of this Commission to: raise densities. He advised that his preference would be to recommend to the City Council the selection of the alternative which could alloy consideration' on a case-by-case basis, and for the Council to advise the Commission regarding which areas are to be further studied. Commissioner Pempel advised that not only the General Plan and Development Code would be affected,, but also the Specific Plans and Planned Communities. e stated that he 'wouldn't have a problem with looking at a site when it comes up, but didn't think the City needed to go looking for them. Further, that the City looked at the needs of the community during the adoption of each of the plans and that they are documents of which the City and its citizens can be proud, therefore, would recommend the no change alternative. Commissioner C itea stated that sites should be looked at before a developer spends a lot of time and money into development, and would agree with consideration on a site-by-site; basis. She prefers that all vacant land ' falling into the medium and high density ranges be considered in a manner similar to that of the 19th Street Corridor Study. Commissioner McNi l stated that his interpretation was that the alternative was either a reduction or no change in densities. He further stated that his concern was with - the word "reduction" and would prefer "reconsideration". That being the case, he would opt for the no change alternative. Planning Commission Minutes' -3- April 24, 1985 Annette Sanchez, representing the consulting firm of Sanchez, Talarico Environmental Consultants, responded to`'written comments received on the R. Chairman Stout opened the public hearing. Tracy Tibbals, 6286 Moonstone, Rancho Cucamonga, attorney representing the applicant, complimented the consultant for the data contained within the FIR, however, questioned the conclusions regarding land use and aesthetic elements. He stated that the project enhances the City's policies, provides affordable housing and eliminates the need for long commutes. Nacho Gracia, 10364 Humbolt, opposed the project based on its high density and incompatibility with the surrounding area. There were no further comments, therefore the public hearing was closed. James Markman, City Attorney, advised that the Planning Commission would simply be acknowledging the consideration of data contained in the EIR and making a recommendation to the City Council for final decision. Otto Kroutil , Senior Planner, clarified that if the Commission wished to approve the General Plan Amendment, it would only recommend approval to the City Council . Commissioner Barker stated that over and over again groups of various sizes have come before the Commission requesting a continuance of stated policy that transitions in density be provided to guarantee compatibility. Further, that he would recommend to the other Commissioners and the City Council that the same standards be applied to this project in this location as to any other project in any other location of the City. Further, that what this applicant is requesting is to increase the density from 2-4 dwelling units per acre to 14 to 24 dwelling units per acre and placing it in the middle of an existing neighborhood. He stated that this proposal would have an immediate effect on the community and is incompatible. Commissioner Rempel advised that the City is more than adequately meeting housing needs in a broad band across the City. Further, as supported by the EIR, this is not the right place for this project. Commissioner 1c4iel agreed that land use is a problem and stated that this is not the place for 23 units to the acre. Chairman Stout stated that the City has reviewed a number of General Plan Amendment requests and that transition of density has been a major factor in each of those reviews. He advised that this project should be given the same consideration regarding the transition of density as any of the previous requests. Further, that he would recommend that the Commission make the findings that they have considered the EIR and based on that review and additional input, deny the General Plan Amendment request. Planning Commission Minutes - April 10, IS i Jim Barton, 8409 Utica, Rancho Cucamonga, expressed concern with placing traffic generated by the hospital on Orchard, which is not 'a through street. Jack Corrigan, Dann Corporation, Newport Beach, expressed concern with the proposed residential inns placed in proximity to a hospital with emergency facilities. There were no further comments, therefore the public hearing was closed. Commissioner Re pel stated that the conditions of approval for the other sites in Terra Vista need to be reassessed if the hospital does not go in. Pick Gomez, City Planner, advised that the Planning Commission can make an amendment to the specific plan any time it feels necessary as a result of any changes Commissioner Darer stated that he did not like the idea of increasing densities per acre and was concerned with the loss of the auto plaza designation. He additionally stated that he would like to see some sort o contingency plan if the hospital isn't developed. Commissioner ; hitiea agreed that the auto plaza designation was necessary as it 'would be an important tax base to the City and was concerned with moving the density to the perimeter and suggested that It be left the ways it is. Commissioner Stout stated the auto plea is one feature of the plan which he j considered beneficial to the City and did not want to see it removed. Further, that because of the increase in amount of land devoted to the hoital ' use, there was no need to transfer density somewhere else. He also stated that alternatives should be presented in the text of the plan to make clear ghat will be 'developed on that site if the hospital does not develop; r. Gomez suggested that the Commission might consider alternative permitted uses, possibly with a primary focus on -a medical facility. He further recommended that if the Commission was comfortable with a hospital designation at that location, it could be forwarded to the City Council , but withhold approvals on the balance until further review. Chairman Stout replied that he did not have a problem with a hospital designation at that location, but did have a problem with' leaving loose ends in the plan. Further, that there is a big difference in permitted uses and primary uses and would not like to see the auto plaza reduced to simply a permitted use. James Markman, City Attorney, suggested that a hospital and medical care facility' use could be the only designations permitted, that way if; the play falls through the applicant will have to core back and redesignate permitted uses for those areas Planning Commission Minutes -9- April 10, 1985 Mot ion: Moved by Chitiea seconded by Barker, to adopt the Resolution recommending approval to the City Council, with changes to the Resolution title to reflect approval of the MHO designation for the hospital site only. Jim Barton, 8409 Utica, addressed the Commission in support of, the architecture of the project There were no further public comments. Commissioner_ Chitiea stated concern with the way the pedestrian area> was bisected by what appeared to be the major entrance/exit to the project. Chairman Stout stated the during Cosign Review the applicant indicated a difficulty in opening up the project due to site constraints; however, those constraints seemed self-imposed since the applicant also owns the property to the north. Further, that a number of solutions were suggested to the applicant and were rejected. He also stated that the Industrial Park' designations were in e de to provide an attractive place to work and, with minor modifications, this project could be brought into conformance with those general policies. Planning Commission Minutes _10 April 10, 1985 Commissioner Barker stated that the project does not reflect the streetsape as those projects which are considered to be some of the better Industrial Park projects in the City. Further, that he has told residents at Planning Commission meetings in the past that he would prefer to have an Industrial Park project next door to his house than a very high density project; however, could not says that in this instance. Commissioner Mc Niel stated that the project has come a lore way sine Design Review and didn't think it had that far to go to provide the pedestrian amenities necessary to snake It a good project. Chairman Stout asked Mr. Allen if he would be agreeable to continue the project to allow time to address these concerns. D. PARKING REQUIREMENTS - A consideration of potential amendment to parking ratio calculations Dan Coleman, Senior Planner, reviewed the staff report. Jack Corrigan, Don Corporation, outlined the reasons for the requested amendment to the parking ratio calculations and suggested that open space areas not, be `included in gross square footage calculations. Jim Barton, Barton Development, suggested that public space such as non- leasable areas be excluded from the parking ratio calculations. Motion: Moved by Barker, seconded by Mc Niel , unanimously carried, to direct staff to research' other cities to determine their method of parking ratio calculations, and to present alternatives to the Commission at a later date. PUBLIC COMMENTS: Cindy Davis, 8037 Thoroughbred, Rancho Cucamonga, voiced her disappointment regarding the Planning Commission's approval of Tentative Tract `10349, Anacal , at their April 24;, 19 meeting. Ms. Davis advised that this decision' has been appealed to the City Council. Planning Commission Minutes - - March 27, 1985 10. Restrictions on Rental Units revised to contain , provision that a person(s) not a target tenant may occupy an apartment unit if he/she occupied said unit with a resident occupant who is a target tenant and provides primary physical or economic support to the target tenant. Additionally, the reference to blood relatives was removed from the subparagraph referring to temporary tenants. 36. Rent Control amended to delete last sentence. Commissioner Rempel suggested that the expiration timeframe in subparagraph g be keyed to occupancy rather than building permits. Mr. Markman agreed and recommended that subparagraph g be revised to reflect an expiration date of three years from the effective unless a Certificate of Occupancy had been obtained for the entire project. Commissioner Chitiea stated that she would- like to have a provision for the keeping and maintenance of wall pets included in the agreement.' Chairman Stout opened the public hearing Terry Christensen, TAC- Development, stated agreement with the amendments proposed by Counsel and advised that he would include provisions for the maintenance and keeping of wall pets. Commissioner Rempel stated that the size of the proposed. multi-purpose room was inadequate in providing enough space for residents. Dan Coleman, Senior planner, advised that this issue was discussed with the Senior Citrons VIP Club and it was their determination that: since.: the applicant was providing occupants with shuttle bus transportation to the Neighborhood Center, the size of the recreation building was adequate. I Frank Gonzales, 1360 Chapman, grange, project architect, stated that the applicant was concerned with adding a second story to :this building because of problems' associated with stairs or ramps Wilma Brenner, representative of the VIP Club, stated that the Club felt the size of the building is adequate since not all residents would need to meet at one time. She stated that she felt it was more important to give greater consideration to the living' area and to keep the rental cost affordable to senior citizens. Jeff Hill , 9607 Cameron, Rancho Cucamonga, asked for discussion regarding the percentage of the units designated for the handicapped and if the units would be wiredi for connection to the future hospital Buel Anderson, 6526 Amethyst, Rancho Cucamonga, stated concerns with parking, , drainage, and affects on surrounding property values Planning Commission Minutes - arch 27, 1985 Frank Gonzales, project architect, responded to Mr. Hill 's questions by advising that both building codes and the State stipulate the amount of handicapped units to be provided in a project and that this project intends to provide more than the number of units required. Commissioner Darker asked what the square footage and proposed price range would be for the project Mr. Marq and replied that the square footage would range from CD to 2500 square feet and would estimate the price range to be in the neighborhood of 75,DDC'. Commissioner Chitiea expressed concern with the side and rear elevations and stated that that they looked 'very blank in the drawings. Mr. Marquard replied that the elevations would look different when built, Rick Gomez, City Planner, advised that corner elevations or -story elevations with public exposure would be conditioned in the Standard Conditions attached to the Resolution The following individuals spoke in opposition to the project based on concerns with decreasing property values as a result of the project, traffic on Thoroughbred if a through street and therefore recommended that. Thoroughbred be ;designed as a cul-de-sac, increased crime, lack of provisions for front yard landscaping, and compatibility with surrounding neighborhood. Mr. Bliss advised that Thoroughbred is a water carrying street and was intended to eventually go through. He also stated that the residents of Jennet and Rosebud would probably like to see some of the traffic removed from their streets and not have more traffic placed on ahem as a result of making Thoroughbred a cul-de-sac. Cal Quaral, Anacal Engineering, advised that the street pattern of this project is the sage one which was originally approved by the City for the previous application. He pointed out that if the tract had recorded in December, it would be going in with this sae street pattern. There were no further comments, therefore the public hearing was closed. Planning' Commission Minutes -7- March 27, 1985 Commissioner Chitiea stated that the people on Gardenia and Rosebud probably have the same concerns as those expressed during the public hearing. She further stated that it was not fair to the residents who live on Rosebud and Gardenia to have all of the traffic routed through their streets to Turquoise. She stated that she could appreciate the;concerns expressed, but would have to consider the other residents who world also be affected. Commissioner Barker stated that the street patterns are the same as when ;the existing houses were first built and are part of an overall design program. He further stated that the existing neighborhood has a specific design personality, and it was his opinion that the proposed project is incompatible. Additionally, he was not comfortable with a shift in design styles mid-block and was concerned with the house square footages as proposed. Commissioner Rempel agreed that Thoroughbred Street has to be a through street and advised that the street would be over the -foot minimum limit of for cul-de-sac. Additionally, drainage would be a problem if Thoroughbred didn't go through. He further stated that staff and the Design Review Committee could work with the applicant to come up with ' designs compatible with the surrounding area and address the transition issue and suggested that the first five or six lots on the north and south sues would make a reasonable transition r. Marquard replied that the color palette could be changed to be more compatible with the area, but he would have a problem with a -redesign. He advised the project had been before the various review committees and had,met all of the standards set Commissioner Rempel stated that he did not intend that a major fascade change needed to be accomplished, only that the Design Review Committee and staff could work with him on ways to make the homes on those lots more compatible with the existing neighborhood Mr. Marquard stated that to the west of this project is one which has Cape Code architectural styling, which he considered a major change. Further, that e would not be opposed to blending the color palette to achieve a more , Country 'Traditional look, but did not feel that new developers should be penalized for a small group of homes which already exist in one specific area and be required to redesign their projects Commissioner Chitiea stated that she would prefer to see 10 lots on the north and south sides transition with the existing homes. Rick Gomez, City Planner, advised that the Commission night want to include the lots on Bennet in the transitional issue Chairman Stout advised that he had lived in that area for ten years and that before the Miller" and Mayfair tracts were built Gardenia didn't have as much traffic on it either. He advised that the extra traffic on Gardenia is a Planning Commission Minutes March 27, 1985 problem because this area was designed" to circulate so that each one of the east/west streets ;drains to Sapphire* Further, that he understood and was sympathetic to the situation,; however, it would be unfair to place all of the traffic on Gardenia and Rosebud and was time that the other streets carry their fair share of traffic to Sapphire. On the compatibility issue, Chairman Moot stated; that an attempt could be made to transition;' this project compatibly with the enlisting hones so that it has the least impact. He further stated that he would be in favor of sending the color palette back to the Design Review Committee' and if and approval could not be made at that level , it should cone back to the Planning Commission. Motion. Moved by Rempol , seconded by McNiel, to issue a Negative Declaration and adopt the Resolution approving Environmental Assessment and Tentative Tract 10349 with revisions to Planning ' Division condition one to omit slunpstorne from the material to be used on the wall , and an added condition requiring the first tern lots north and south on Thoroughbred and ter; lots on Bennet to provide architectural transition. These designs are to be approved by the Design', Review Committee prior to issuance of building permits. He advised that truck traffic is very heavy at that location, and also stated concerns that there would be complaints from the apartment residents about noise generated from the plant during its peak hours of operation. Bruce Jordan,, architect for the project, stated that lighting, noise, an traffic had been considered by the applicant in the design of the project and felt that the concerns could be mitigated through landscaping. He additionally stated that building codes and Title 24 requirements could insure that these elements would be properly mitigated. Commissioner Rempel stated that this 'property should have been part of the Industrial Specific plan rather than residentially designated. Commissioner Barker stated that steps need to be taken to assure that these noise levels are properly mitigated. Edward Hopson;, Assistant City Attorney, advised that the Commission could continue its decision on this project until a noise attenuation study is completed. He pointed out that this may be the most effective way of assuring that the concerns are addressed. Commissioner Rempel suggested that another area to be researched would be a possible design to get adequate open space between the buildings. Chairman Stout read the findings outlined in the Development Code. Planning Commission Minutes 5- March 13, 1985 Mr. Coleman advised that the findings as read by the Chairman should replace those outlined in the Resolution Charles Wear, representing the applicant, presented landscaping renderings for the project.. Mr. Wear stated, that all the findings outlined in the Cevleopme xt Code would apply to granting a variance for this project Alan Tibbets 7957 Gardenia, Rancho Cucamonga, stated that he did not agree that substandard setbacks could be justified on the basis of hardship. He also presented the Commission with a sketch of a project he was proposing on his property. He further stated that this project shows a large' disregard for the intent of the Industrial Specific Plan. Mr. Tibbts further stated objections to the appearance of the project, and advised that if it were designed in keeping with the density, setbacks, and landscaping of the surrounding area he would consider it a legitimate addition and support it as a neighbor. He also expressed concerns that this project would cause a serious traffic constraint to his project Charles 'Wear replied that the applicant would be hapy to work with Mr. Tibbets on a redesign of this project, if the Commission felt this would be a viable location for a mini-storage facility. There were no further comments, therefore the public hearing was closed. Commissioner Rev el stated that the use creeds to be looked at, along with design of the use and its compatibility with the surrounding area. Commissioner Barker stated appreciation to both parties for their clear and articulate comments. He further started that the applicant indicated that there would be a practical hardship. A practical difficulty is not the same as the deprivation of privileges. Further that he could not say that approval , of this variance would not constitute a special privilege,; therefore would be inclined to deny. Commissioner Chitiea agreed that approval would constitute granting a special privilege. She advised that other people in this special area are making design considerations and landscaping in keeping with the C t 's policies Commissioner McNiel stated that this, project would be detrimental to the surrounding property owner. He advised that he would have no objections to a continuance, but dad not know if a solution exists Chairman Stout stated that he was not aware of a design proposal for the adjacent parcel when this project came before the Design Review Committee. He suggested that both parties 'get together with staff to see if compatibility, access and landscaping problems could be worked out. STREAMLINING DEVELOPMENTLDESIGN REVIEW Dan Coleman, Senior Planner, reviewed the staff report. Commissioner Barker stated that if staff were given very strong policies, very strong guidelines, and very strong procedures to approve routine items, he could see where this would allow the Commission to make better use of its time on projects such as overlays and special projects. Further, that he was in favor of 'finding a vehicle for delegating routine, non-controversial decisions allowing an appeal process and input when requested by the public. However, there needs to be protection of due process, protection of an appeal process, and an understanding that if someone doesn't like staff's decision, it can be appealed to the Planning Commission. Commissioner McNiel stated that he would like to see the process streamlined; however, was concerned with not allowing the public an opportunity to voice objections in a public forum. Chairman Stout agreed and stated that putting the burden on the public to ask for a public hearing goes against the grain. Commissioner Rempel stated that some people may hesitate using a process which necessitates an appeal of staff's decision to 'the Planning Commission. He further stated that staff should not have to take the, heat for decisions made. Commissioner Chitiea agreed, and stated further concern with using this process on Conditional Use Permits. Rack Comet, City ; Planner, advised that with this input staff had enough direction from the Commission to fine tune this process and return to the Commission with more specific recommendations. He further' advised that staff would be meeting with the new City Attorney to receive his input. K. SIGN ORDINANCE INTERPRETATION-- VIDEO ZONE Rick Gomez, City Planner, reviewed the staff report. Planning' Commission Minutes -7 March 13, 1985 Chairman Stout advised that he had visited the site in question and couldn't see any other purpose for the fights other than to draw attention to the business He further stated that the ordinance is clear and specific enough and that the Tights in the window of the video zone are clearly a sigh. Dan Coleman, Senior Planner, reviewed the staff report. Chairman Stout opened the public hearing. John O'Meara, 270 S. Bristol , Costa Mesa, stated that the applicant's understanding is that they would be reimbursed for one-half of the median island and signal costs on Haven Avenue, and would like that to be a part of the Resolution. Craig Nelson, 10 57 Lemon, Rancho Cucamonga, opposed the project due to increased traffic which would be generated. Commissioner Barker stated that he sat on the first Design Review Committee and that the project had come a way sine that time, but questioned if it had come far enough in terms of the site plan, architecture, parking, etc., to bring it into conformance with the policies of the Development Code. He reiterated his concerns withthe five straight buildings as proposed and the provisions for pedestrian access Commissioner McNiel staged that while the project had improved, it had not yet achieved the desired level for Haven Avenue and still appears like any other shopping center. Commissioner Chitiea stated that she was dissatisfied with the project _ and suggested it be entirely revised. Chairman Stout stated that although he appreciated the applicant's efforts, this shopping: center was designed without Rancho Cucamonga in mind. He further stated that the architectural statement is typical for general Commercial areas and not appropriate for Neighborhood Commercial . Commissioner gamer stated that he had no problems with either continuing or denying the project. However, if the applicant would concur, it would be preferable to continue the public 'hearing on the project to allow time to work with staff and the applicant on a redesign John O'Meara stated that he -Would prefer to continue the project if he would have guidelines sett to avoid a repeat of this situation. She further stated that she would prefer' to place more side-on garages on `'lots other than those on the corners as presently proposed. r ell stated that the applicant would be willing to work with City staff on some designs addressing the Commission's concerns-. Rick.. Gomez, City Planner, advised that staff could work with the applicant on these design concerns and bring them back to the Design Review Committee. Chairman Stout stated that this situation and the transfer of density wouldn't be allowed in any other part of the Cite. He further stated concern with front ,bards across the street from a higher density project. Commissioner Rempel stated that adequate buffering through landscaping would mitigate that concern, and that placing back yards facing the higher density project would be even worse. Planning Commission Minutes -9- February 27 198 Mr. Bell stated that Lewis would agree to submit a master plan for this area. He stated that timing had become critical due to HUD Title 10 financing`. Additionally, it would cost a great deal of money to change the map at this time, and requested that the Commission consider allowing the applicant and staff to research other design approaches to mitigate the stre;etscape concern. Mr. Gomez advised that the master plan approach would set parameters for what the Commission aunts on the east side by an amendment to the area plan. Commissioner McNiel pointed out that this project canto before the Commission without Design Review Committee approval because the Committee was aware of a condition that needed mitigation of the full Planning Commission level . He stated that his concern is not a new one and has been talked abort many tires. Steven Ford stated that the William Lyon Company was anxious to have the project completed and would be grilling to cooperate with the Commission's desires. Commissioner Chi.tiea stated that the Trails Committee had granted to move the trail to the north side in order to accommodate a Crider trail. She suggested that an alternative to achieve the desired 10-foot aide trail be submitted to the Trails Committee. Commissioner Barker agreed and further stated that the trails standards should be utilized. Commissioner Rempel stated that the ground cover should not be so dense that it would preclude the use by pedestrians walking on the trail. He further suggested that some of the original plan concepts should be retained Regarding the roadway edge treatment, it was the consensus of the Commission that alternative one 'which provided for uniform rolled curb edges with a rounded berm area of one foot rise on the south parkway be utilized. The applicant agreed to work with the City Engineer on the appropriate design of this alternative. C., REVIEW OF CONCEPTUAL PLAN FOR D HILL COMMUNITY PARK Think Mayer, Park Project Coordinator, reviewed the staff report. The Commission expressed concern with the grade of the slopes on the park site and requested that special attention be directed towards reducing the slope as much as. possible.
