DE(LARING ITS INT~TION TO ORDER THE ANNEXATION TO STREET LIGHTING HAINT~qANCE DISTRICT NO. 2. AN ASSESSMENT DISTRICT: DESIGNATING SAID ANNEXATION AS ANNEXATION NO. 15 TO STREET LIGHTIN~ NAINTq~ASCE DISTRICT NO. 2: PURSUANT TO THE LANDSCAPIN~ AND LIGHTIN~ ACT OF 1972 AND OPFERING A TIME AND PLACE FOR HEARII~ OBJECTIONS NiM, THEREFORE BE IT RESOLVED by the City Council of the City of Rancho Cuclmonga, pursuant to the provisions of th· Landscaping and Lighting Act of 1972. being Division 15 of the Streets and Highwqs Code of the State of C~lifornia, as follows: SICTION 1: Description of Work: That the public interest and convenience require and it is the intention of this City Council to form a maintenance district in the City of Rancho Cucaaon~a for the maintenance and operation of those street lights the boundaries of the proposed maintenance district described in Section 2 hereof. Said maintenance ·nd operation includes the cost and supervision of any lighting and related facilities in connection with said district. Sv-CTION 2: Location of Work: The foregoinA described work is to be located within roadway riAht-of-way enmaeratsd in the report of the City Engineer and nors particularly described on saps which are on file in the office of the City Clerk, entitled 'Annexation No. 15 to Street Lighting Maintenance District No. 2". SRCTION 3: Description of A~sasssent District: That the contemplated work. in the opinion of said City Council, is of sore than local or ordinary public benefit, and the said City Council hereby -akes the expense of the said work chargeable upon · district, which said distric= is assessed to pay the costs and expenses thereof, and which district is described as follows: All that certain territory of the City of Rancho Cut,songs included within the exterior boundary lines shown upon certain ~Hap of Annexation No. 15 co Street Lighting Maintenance Distric= No. 2" maps is on file in the office of the City Clerk of said City. SECTION 4: Repot= of Engineer: The City Council of said City by Resolution No. 87-134 has approved the repot= of the engineer of work which report indicates =he a~ount of the proposed assessment, the dis=ri== boundary. assess·iht zones, titled "Engineer's Rapor=, for Street Lighting Maintenance Dis=rict No. 2n is on file in the office of the City Clerk of said City. Reference to said repot= is hereby made for all particulars for the amount and ex=ant of the assesamen=s and for =he ex=ant of the work. SECTION 5: Collection of Assessments: The assess·ant shall be collected ac the same time and in the same manner as County taxes are toilet=ed. The City Engineer shall file · repor= annually with the City Council of said City and said Council will annually conduc= a hearing upon said report at their first reAular meeting in June. at which time assessments for the next fiscal year will be de=ermined. SECTION 6: Time and Place of Hearing: Notice is hereby given that on April 15. 1987. at the hour of 7:30 pm in the City Council (~smbers at 9161 Base Line. in =he City of Rancho Cucamonsa, any and all persons having any objections co the work or extent of the assessment distric=, may appear and shou cause why said work should not be done or carried out or why said district should no= be formed in accordance with this Resolu=ion of In=entlon. Protests mus= be in writing and must con=aim · des=rip=ion of the property in which each signer thereof is in=steered, sufficien= to identify the same. and must be Resolution No. 87-135 Page 2 delivered to the Ci~y Clerk of said City prior to the time set for the hearing. and no other protests or objections will be considered. If the signer of any protest is not sho~n upon the last equalized assessment roll of San Bernardino County aa the o~ner of the property described in the protests, then such protest must contain or be accompanied by written evidence that such signer is the o~ner of the property so described. SECTION 7: Landscapin~ and Lightina Act of 1972: All the work herein proposed shall be done and carried throush in pursuance of an act of the legislature oi the Sta~e of California designated the Landscaping and Lighting Act of 1972. bein~ Division 15 of the Streets and Highways Code of the Sta~e of California. SECTION 8: Publication of Resolution of Intention: Published notice shall be made pursuant to Section 61~1 of the Govar~ent Code. The Mayor ~.~ shall aisn this Resolution amd the City Clerk shall a~teat to the same. and the City ~lerk shall cause the sa~e to be published 10 days before the date set for the hearing, at lea~t once in The Dail~ Report, a newspaper of general circulation publi~hed in the Ci~y of Ontario.
