CALIFORNIA~ DE(7~ARII~ ITS INTENTION TO ORDER THE ANNEXATION TO STREET LIGHTING MAI1TR~ANCE DISTRICT NO. 1. AN ASSESSMENT DISTRICT: DESIGNATING SAID ANNEXATION AS ANNEXATION NO. 20 TO STREET LIGHTIN~ MAINTI~ANCE DISTRICT NO. 1; PURSUANT TO THE LANDSCAPING AND LIGHTIN~ ACT OF 1972 AND OFFERING A TIHE AND PLACE FOR HEARII~ OBJECTIONS NOlo THEREFORE BE IT RESOLVED by the City Council of the City of Rancho Cucamonge, pursues= to the provisions of the Lendscepin$ end Lighten8 Act of 1972, being Division 15 of the Streets end High~eye Code of the State of California, as follows: SECTION 1. Description of Wo~k~ That the public interest and convenience require and it is the intention of this City Council to form a · aintenance district in the City of Rancho CucamonEa for the maintenance and operation of those street lishte the boundaries of the proposed aeintenance district described in Section 2 hereof. Said maintenance and operation includes the cost and supervision of any lighting and related facilities in connection with said district. SICTION 2. Location of Work: The foregoin$ described work is to be located within roadway right-of-way ennaerated in the report of the City EnSineer and sore perticulerly described on maps which are on file in the office of the City Clerk, entitled "Annexation No. 20 to Street Lighting Hainte~ancs District No. 1'. SECTION 3. Description of Assessment District: That the contemplated work, in the opinion of said City Council, is of more than locai or ordinary public benefit, and the said City Council hereby makes the expense of the said work chargeable upon a district, which said district is assessed to pay the costs and expenses thereof, and which district is described as [ollovs: All that certain territory of the City of Rancho ~ucamonga included within the exterior boundary lines shown upon that certain ~Nap of Annexation No. 20 to Street Lighting Kaintenance District No. 1' maps is on file in the office of the City Clerk of said City. SECTION 4. Report of Engineer: The City Council of said City by Resolution No. 87-128 has approved the report of the ensineer of work which report indicates the ~,aount of the proposed assessment, the district boundary. asees~aent zoues, titled 'Ensineer~s Report [or Street Lighting Maintenance District No. Im is on file in the of[ice of the City Clerk of said City. Reference to said report is hereby made for all particulars for the amount and extent of the assessments and for the extent of the work. SECTION 5. Collection of Assessments; The assessment shall be collected at the same time end in the same manner as County =axes are collected. The City Engineer shall file a report annually with the City Council of said City and said Council will annually conduct a hearing upon said report at their first regular meeting in June. at which time asses~ents for the next fiscal year will be determined. SECTION 6. Time and Place of Hearina: Notice is hereby given that on April 15, 1987, at the hour of 7:30 p~ in the City Council Chambers at 9161 Base Line. in the City of Rancho Cucamonga, any and all persons having any objections to the work or extent of the assessment district, may appear and show cause why said work should not be done or carried out or why said distrlc= should not be formed in accordance with this Resolution of Intention. Protes=s must be in writing and must contain a description of the property in which each signer thereof is interested, sufficient to identify the same. and must be Resolution No. 87-129 Page 2 delivered to the City Clerk of said City prior to the tiaa set for the hearing. and no other protests or objections will be considered. If the signer of any protest is not eho~n upon the last equalized assessment roll of San Bernardino County as the o~ner of the property described in the protests, then such protest must contain or be accompanied by written evidence that such signer is the owner of the property so described. SECTION 7. Landacapin~ and Liihtins Act of 1972: All the work herein proposed shall be done and carried through in pursuance of an act of the legislature of the State of California designated the Landscaping and Lighting Act of 1972. bein~ Division 15 of the Streets and Highways Code of the State of California. SECTION 8. Publication of Resolution of Intention: Publlshed notice shall be sade pursuant to Section 61961 of the Government Code. The Hayor ~'~ shall sign this Resolution and the City Clerk shall attest to the same. and the City Clark shall cause the same to be published 10 days before the date set for the hearing, at least once in The Dail~ Report, a newspaper of general circulation published in the City of Ontario.
