HomeMy WebLinkAbout87-105 - Resolutions EES~,UTION NO. 87-105 A RESi]LUTION OF THE CITY COUNCIL OF THE CITY OF RAIqCHO CUCAMONGA, CALIFORNIA, OVERRULING AND DENYING PROTESTS AND MAKING CERTAIN FINDINGS IN A SPECIAL ASSESSMENT DISTRICT (ASSESSHENT DISTRICT NO. 86-2 ) WHEREAS, the City Council of the City of Rancho Cucamonsa (the "City'), has heretofore adopted its Resolution of Intention, pursuant to the '~unicipal Improvement Act of 1913", bein$ Division 12 (commencing with Section 10000) of the Streets and Highways Code, for certain public work and improvements and acquisitions, if necessary, generally described as follows: The construction and acquisition of drainage improvements including appurtenances and appurtenant work, acquisition, if necessary, and incidental expenses in connection therewith. (the '~mprovements"); and WHEREAS, the lands to be specially assessed for the Improvements shall be included within an assessment district designated as ASSESSNENT DISTRICT NO. 86-2 (the '~ssesement District"); and WHEREA,q, a public hearing has been noticed and held in the time and manner required by law, on all matters relating to the Assessment District; and WHEREA~, certain owners of property to be assessed for the Improvements have filed written protests in the time, form and manner required by law; and WHEREAS, at the public hearing, all protests and testimony on the method and formula of the assessment spread, the benefit to the property, the apportio~suent of the assessment in accordance with the benefit received by the property and all other matters relating to the assessment proceedings were duly heard and considered: NOI/, THEREFORE, the City Council of the City of Rancho Cucamonsa does hereby RES~,VE, DETERHINE ~qD ORDER as follows: SECTION 1. The above recitals are all true and correct. SECTION 2. The public hearing on the Assessment District is hereby closed. SECTION 3. The protests have been made by the owners of less than one-half (1/2) of the area of property to be assessed for the Improvements within the Assessment District. SECTION 4. The properties to be assessed within the Assessment District will each receive a benefit from the Improvements and the assessable costs and expenses have been apportioned and spread over the properties in proportion to the benefits received. SECTION ~. The protests, and each of them, are hereby overruled and denied. SECTION 6. The method of apportionment and spread of the assessable costs and expenses recommended by the Engineer of Work is hereby approved and adopted. Resolution No. 87-105 Page 2 SECTION 7. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of the City; and shall sake a minute entry of the passage and adoption thereof in the record of the proceedings of the City Council and in the minutes of the meeting at which the sase is passed and adopted.
