HomeMy WebLinkAbout87-061 - Resolutions RESOLUTION NO. 87-61 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAHONGA, CALIFO~IA DE(LARING ITS INTENTION TO ORDER THE ANNEXATION TO STREET LIGHTING MAINTENANCE DISTHICT NO. 1, AN ASSESSMENT DISTRICT: DESIGNATING SAID ANNEXATION AS ANNEXATION NO. 18 TO STREET LIGHTING MAINTENANCE DISTRICT NO. 1; PURSUANT TO THE LANDSCAPING A~D LIGHTING ACT OF 1972 AND OFFERING A TIME AND PLACE FOR HEARING OBJECTIONS NO~, THEREFORE BE IT R~SOLVED by the City Council of the City of Rancho Cucamonga, pursuant to the provisions of the Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the State of C~lifornia, as follows: SECTION 1. DescFip~ion of Work: That the public interest and convenience require and it is the intention of this City Council to form a maintenance district in the City of Rancho Cucamonga for the maintenance and operation of those street lishts the boundaries of the proposed maintenance distric~ described in Section 2 hereof. Said maintenance and operation includes the cost and supervision of any lighting and related facilities in connection with said district. SECTION 2. Location of Work: The foregoing described work is to be located within roadvsy right-of-way enumerated in the report of the City Engineer and more particularly described on maps which are on file in the office of the City Clerk, entitled "Annexation No. 18 to Street Lighting ltaintenance District No. 1". SECTION 3. l)escri~tion of Assessm~ District: That the contemplated work, in the opinion of said City Council, is of more than local or ordinary public benefit, and the said City Council hereby makes the expense of the said work chargeable upon a district, which said district is assessed to pay the costs and expenses thereof, and which district is described as follows: Ail that certain territory of the City of Rancho Cucamonga included within the exterior boundary lines shorn upon that certain '~ap of Annexation No. 18 to Street Lighting Naintenance District No. i" maps is on file in ~he office of the City Clerk of said City. SECTION ~. Report of Enain~er: The City Council of said City by Resolution No. 87-61 has approved the report of the engineer of york which report indicates the amount of the proposed assessment, the district boundary, assessmen~ zones, titled '~ngineer's Report, Street Lighting lta intenance District No. 1" is on file in the office of the City Clerk of said City. Reference to said report is hereby made for all particulars for the amount and extent of the assessments and for the extent of the work. SECTION 5. Collection of Assessments: The assessment shall be collected at the same time and in the same manner as County taxes are collected. The City Engineer shall file a report annually with the City Council of said City and said Council will annually conduct a hearing upon said report at their first regular meeting in June, at which time assessments for the next fiscal year will be determined. SECTION 6. Tim~ and Place of Hearina: Notice is hereby liven that on ~arch ~, 1987, at the hour of 7:30 pm in the City Council Chambers at 9161 Base Line, in the City of Rancho Cucamonga, any and all persons having any objections to the york or extent of the assessment district, may appear and shov cause why said work should not be done or carried out or vhy said distric~ should not be formed in accordance with this Resolution of Intention. Protests must be in writing and must contain a description of the property in which each signer thereof is interested, sufficient to identify the same, and ~ust be Resolution No. 87-61 Page 2 delivered to the City Clerk of said City prior to the time set for the hearing, and no other protests or objections will be considered. If the signer of any protest is not shown upon the last equalized assessment roll of San Bernard/no County as the o~ner of the property described in the protests, then such protest must contain or be accompanied by written evidence that such si~ner is the owner of the property so described. SECTION 7. Landscanina and Liahtin~ &Ct of 1972: All the work herein proposed shall be done and carried throuEh in pursuance of an act of the leEislature of the State of California designated the Landscaping and Lish~ing Act of 1972, beinE Division 15 of the Streets and NiEhways Code of the State of California. SECTION 8. Publication of Resolution of Intention: Published notice shall be made pursuant to Section 61~(~1 of the Gover~ent Code. The ~ayor shall si~n this Resolution and the City Clerk shall attest to the same, and the City Clerk shall cause the same to be published 10 days before the date set for the hearing, at least once in The Daily Report, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of ~ancho Cucamonsa, California.
