HomeMy WebLinkAbout87-052 - Resolutions RES(~UTION NO. 87-52 A RES~LUTION OF TIlE CITY COUNCIL OF THE CITY OF RANCBO CUCAHONGA, CALIFORNIA, OF PR~IMIN~Y APPROV~ OF CI~ ~GINE~'S RE~RT FOR ~N~TION NO. 1 ~ L~PE ~~ DIS~I~ NO. 6 I/HEREAS, on February 4, 1987, the City Council of the City of Rancho Cucamonia directed the City Engineer to make and file with the City Clerk of said City a report in writing as required by the Landscaping and Lighting Act of 1972; and ~IltEREAS, the City Engineer has made and filed with the City Clerk of said City a report in writing as called for pursuant to said Act, which report has been presented to this Cotmcil for consideration; and WEEREAS, said City Council has duly considered said report and each and every part thereof, and finds that each and every part of said report is sufficient, and that said report, nor any part thereof, requires or should be modified in any respect. NOW, TREREFORE BE IT RESC~VED by the City Council of the City of Rancho Cucamonsa as follows: SECTION 1: That the Engineer's Estimate of the itemized costs and expenses of said work and of the incidental expenses in connection therewith, contained in said report be, and each of them are hereby, preliminarily approved and confirmed. SECTION 2: That the diagram showing the Assessment District referred to and described in said report, the boundaries of the subdivisions of land within said Assessment District are hereby preliminarily approved and confirmed. SECTION 3: That the proposed assessment upon the subdivisions of land in said Assessment District in proportion to the estimated benefit to be received by said subdivision, respectively, from said work and of the incidental expenses thereof, as contained in said report is hereby preliminarily approved and confirmed. SECTION 4: That said report shall stand as the City Engineer's Report for the purposes of all subsequent proceedings, and pursuant to the proposed district. Authelet, City Clerk CITY OF RANCHO CUCAMONGA Engineer's Report for Landscape Maintenance District No. 6 (Caryn) ANNEXATION NO. 1 for Tracts 12936, 12938, 1293g, 12943 and 12944 SECTION 1. Authorit~ for Report This report is in con~)liance with the requirements of Article 4, Chapter 1, Division 15 of the Streets and Highways Code, State of California {Landscaping and Lighting Act of lg72). SECTION 2. General Description This City Council has elected to annex all new subdivisions into Landscape Maintenance District No.6. The City Council has determined that the areas to be maintained will have an effect upon all lots within Tract Nos. 12936, 12938, 1293g, 12943 and 12944 as well as on the lots directly abutting the landscaped areas. All landscaped areas to be maintained in the annexed tracts are shown on the recorded Map as roadway right-of-way or easements to be granted to the City of Rancho Cucamonga. SECTION 3. Plans and Specifications The plans and landscaping are as stipulated in the conditions of approval for the development and as approved by the City Engineering Division. Reference is hereby made to the subject tract map or development plan and the assessment diagram for the exact location of the landscaped areas. The plans and specifications for landscaped improvement on the individual development is hereby made a part of this report to the same extent as if said plans and specifications were attached hereto. SECTION 4. Estimated Costs No costs will be incurred for parkway improvement construction. All improvements will be constructed by developers. Based on historical data, contract analysis and developed work standards, it is estimated that maintenance costs for assessment purposes will equal thirty ($.30) cents per square foot per year. These costs are estimated only., actual assessment will be based on actual cost data. The estimated total cost for Landscape Maintenance District No. 6 (including Annexation No. 1 comprised of 771,110 square feet of landscaped area) is shown below: Total Annual Maintenance Cost YTD $.30 X 771,110 square feet - $231,330 Per Lot Annual Assessment  - $317.41 Per Lot Monthl~ Assessment $317.41 - $26.45 Assessment shall apply to each lot as enumerated in Section 6 and the attached assessment diagram. Where the development covered by this annexation involves frontage along arterial or collector streets, which are designated for inclusion in the maintenance district but will be maintained by an active homeowners association, these assessments shall be reduced. SECTION 5. Assessment Diagram A copy of 'the proposed assessment diagram is attached to this report and labeled "Exhibit A", by this reference the diagram is hereby incorporated with'in the text of this report. Resolution No. 87-52 Page 4 SECTION 6. Assessment Improvements for the District are found to be of general benefit to all lots within the District and that assessment shall be equal for each unit. SECTION 7. Order of Events 1. City Council adopts Resolution of Preliminary Approval of City Engineer's Report. 2. City Council adopts Resolution of Intention to Annex to Oistrict and sets public hearing date. 3. City Council conducts public hearing, considers all testimony and determines to Annex to the District or abandon the proceedings. 4. Every year in May, the City Engineer files a report with the City Council. 5. Every year in June, the City Council conducts a public hearing and approves, or modifies and approves the individual assessments.
